Some clearing and grubbing has occurred at the site beyond the permitted boundaries, and of the proposed area requested to be permitted. All of this site is in the floodway and becomes inundated by 8+ feet of water during high river flow and most hurricanes during recent years, per the equipment operator Brian Jones. Jay Edwards and myself were signed in by Lynn Hill, The Mine Site Manager. I presented to Chris Pulinger, DWR-401, that a JD was likely a good idea, and the POM details be required on the Mod. Mining Plat which is to be recorded prior to proceeding beyond what is presently permitted. That way the operations, as well as inspectors will have an idea of what has actually been approved as far as dewatering, all discharges, as well as all Mining activities. This mine is located upstream of the town's intake for the area's water supply, and is classified as WS-IV; NSW; CA. I expect DWR's comments will place a hold on the discharge, at least until an POM is approved and placed on the Mining Plat. The old dirt bag discharge went to a farm ditch then crossed Kennedy Home Rd and into that UT where the new discharge will go at some point. There are no impacted wetlands. Wetlands exist south of the floodway line along the Neuse where mining will never occur back there. They're won't be any dewatering along that back portion of the mine either, so we should have no impacts. I guess that's easy for me and the Owner. We will adjust the SP3 plan and make sure his monitoring is in -place during dewatering. We'll go ahead and submit to DLR for the mining permit and it may come across your desk in that process. I've copied Judy Wehner for her file as necessary. It looks like both the old and new discharge points still ultimately flow to the same UT. Could you verify that? In that case, there's nothing to change on the Certificate of Coverage. I see the dirt bag dewatering system on the original plans in the file, presumably discharging in the northwest corner of the mine site. On S-1, the new dewatering/settling basin appears to lead to the same UT running through the middle of the mine footprint, southward and on the other side of that stream. Is that the correct description of the relocation? Are there wetlands nearby that are.potentially affected? If that's the case, a Pumping O&M Plan will be required (submitted and approved by the Washington Regional Office) prior to dewatering activities. That's probably the bigger concern than amending the permit for the new outfall location here —that's not something we normally need to do if the receiving water noted on the COC isn't changing. It's the responsibility of the Mining Permittee to revise SPPP documents and adjust monitoring if discharges are relocated (as long as it's ultimately the same receiving water with the same classification, etc.). However, a Pumping O&M Plan approval is an action that requires DEQ approval, Could you advise us further on your needs here? I dealt with Jennifer Jones and Amy Chapman originally. But this NPDES Permit needs to be amended to include a new discharge on the property. Here's the updated mine plans attached. If you look back through your old files, the original discharge is no longer active. It was technically only active for about 3 months back in 2010. It was the dirt bag system and they haven't used it since 2010 b/c they don't mine that actively even though it's still part of the overall mine permit. This is a new proposed dewatering/settling basin for a future dewatering planned, so they don't have to wet mine so much. The calculations and details are provided on Sheet DET-2. I am inclined to go ahead and issue this permit with the caveat that "A requirement of this permit is compliance with the Division of Land Reso!irces' (DLR) Mining Permit; therefore, you must hold an updated, approved DLR permit before any mining industrial activities take place." That's what I've added to another similar permit where DLR couldn't issue the permit yet. I'd like to get this permit off the books since I've had it for about 2 years now and have been ready to issue it for about... 1.5 years.,. So if you don't have any issues with issuing this permit, I'd like to go ahead and issue it. Arg — sorry! Their DWQ permit application say they are applying to discharge 1 mine dewatering discharge point, but that must be for their ``expansion". I seem to remember that you and I and Ashley had talked about them discharging or being caught discharging mine dewatering :,rater last year? ! thought that's why they were applying for this permit in the first `mace thought maybe they had put the dirt bags in and they had some evidence of dewatering. Do you remember any of the specifics about that? Anyway, I am a bit suspicious that they are not doing any dewatering — they are very close to a river and there are wetlands all around the mines. Ashley is going to ask the DLR guy (Gary?) to pay them a visit and see what they are doing, because it seems odd that they were made to get this permit, but just have not "gotten around" to posting the bond yet to DLR. The maintenance states that bags will be removed and replaced with new bags once they are half -full. An existing 20-foot grassed path surrounds the vegetated berms and are to remain after mining in order for people to be able to drive around and fish in the future pond. This path will serve as maintenance access for the dirt -bag system. 9) The ditch bank was higher than the adjacent grade, therefore water would pond behind the ditch with no outlet. A swale with a check dam is proposed to ensure positive drainage towards the ditch. Low flow conditions will still occur over the rock weir and through the rock filter. The blind swale will act primarily as secondary sediment storage. (e) Property Ownership Documentation shall be provided to the Division consisting.of: (1) legal documentation of ownership (i.e., contract, deed or article of incorporation); (2) written notarized intent to purchase agreement signed by both parties, accompanied by a plat or survey map; or (3) written notarized lease agreement signed by both parties, specifically indicating the intended use ofthe property, as well as a plat or survey map. Clean water discharges through dirt -bags where it is collected in a blind swale. The blind swale acts as a secondary treatment device and allows sheetflow overflows that drain into the existing ditch off -site. The existing ditch travels to the Unnamed Tributary of the Neuse River. "Dirt -bags" will be removed and replaced once they reach 1/2 full capacity. MINING PERMIT EXPIRATION DATE: June 23, 2016 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources, hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is nat' complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Expiration Date This permit shall be effective from the date of its issuance until June 23, 2016. Conditions This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: OPERATING CONDITIONS: A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. Page 3 B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of Water Quality to secure any necessary stormwater permits or other approval documents_ 2. A. Any mining process producing air contamination emissions shall be subject to the permitting requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During mining operations, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. A. Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. Any mining activity affecting waters of the State, waters of the U. S.,'or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. 4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. All drainage from the affected areas around the mine excavations shall be diverted internal to said excavations. C. No dewatering activities shall occur at this site. D. Mining activities shall occur as indicated on the Mine Maps, Sheet 1 of 3 last revised May 19, 2006 and Sheets 2 and 3 of 3 dated March 2006, including the supplemental information received by the Land Quality Section on April 3, 2006 and May 24, 2006. E. No mining activities shall occur in Area 31 LR9 as indicated on the 8'/2 X 11 map attached to the May 19, 2006 Memorandum from Mr. Peter Sandbeck from the North Carolina Department of Cultural Resources until testing of said area has been completed by the Office of State Archeology. 5. All affected area boundaries (85.1 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. Page 4 6. The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. B. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. Sufficient buffer (minimum 30 foot undisturbed) shall be maintained between any excavation and any mining permit boundary to protect adjacent property. 10. A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. v-belts 5. steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal: the approximate boundaries and size of the refuse disposal area; Page 5 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and, 5. verification that a permanent vegetative groundcover will be established. 11. An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 12. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit or any approved revision to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 13. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $59.200.00 Irrevocable Standby Letter of Credit, is sufficient to cover the operation as indicated in the approved application. Page 6 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to restore the mine excavation to a lake area and to grade and revegetate the adjacent disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. The lake area shall be excavated to maintain a minimum water depth of four feet measured from the low water table elevation. Page 7 B. The side slopes to the lake excavation shall be graded to a 3 horizontal to 1 vertical or -flatter to the water line and 2 horizontal to 1 vertical or flatter below the water line. C.
