REGAN Secretary TRACY DAVIS Director On October 12, 2017 a site inspection was conducted for the Nash Brick facility located at 532 Nash Brick Road ,Nash County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG020000, Certificate of Coverage-NCG020765. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Fishing Creek, a Class WS-V; NSW waterbody in the Tar -Pamlico River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG020000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. The site discharges stormwater and process wastewater into both Fishing Creek (WS-IV, NSW) and Powells Creek (C, HQW). The NOI is attached. They had a mining permit already (42-01). They have also had an NCG07 — NCG070080 which they are asking to rescind. They are discharging process wastewater to a WS-IV stream so we will have to get approval from the DEH for them to discharge (although they already are discharging). The other thing I am concerned about is that they have an LCID/other landfill at their site. Do you feel that the NCG02 general permit provides adequate coverage for them in light of them having a landfills and hydrocarbon -contaminated soil disposal at their site? Additionally, they state they are not discharging groundwater. Thinking about that I am not sure if they can state there is not groundwater there mixed in with their other water from those pits — although we are considering it wastewater anyway. They have asked for representative outfall status. This is not really part of their mine application so you should address this separately to them — but NRDES WW does not allow Representative outfall status for WW discharges. We have also talked about as a unit and feel that WW ROS is problematic from a monitoring and enforcement point of view, so we are not endorsing it right now. They will need to monitor all of their wastewater discharges. I'll also send a copy of the plans in the snail -mail. Does the Raleigh Regional Office have any concerns about issuing this facility a COC for this general permit? If we don't receive any objections, we'll issue the COC in 30 days, pending DEH approval.
