On October 12, 2017 a site inspection was conducted for the Nash Brick facility located at 532 Nash Brick
Road ,Nash County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your
review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater
General Permit-NCG020000, Certificate of Coverage-NCG020765. Permit coverage authorizes the
discharge of stormwater from the facility to receiving waters designated as Fishing Creek, a Class WS-V;
NSW waterbody in the Tar -Pamlico River Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the
NCG020000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments
and observations made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff has any

In accordance with your application for a discharge permit received on March 1, 2010,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state —NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated -October 15, 2007 (or as subsequently
amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage:
This.general permit allows the discharge of stormwater and certain types of wastewater
from your facility. If separate point -source discharges of stormwater occur (i.e., stormwater nol
combined with mine dewatering water), you will be required to adhere to the conditions in this
permit for stormwater discharges.

Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all discharges draining to
to stream buffers, from portions of this site that have beer. constructed after January 1, 2000,
must be discharged through a correctly designed level spreader or another device that meets
diffuse flow requirements per 15A NCAC 2B .0259. Diffuse flow requirements are described in
Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

I think we agreed from our site visit that Be LOD contaminated soil landfill was a small enough area and is sited in a location where runoff would join the other
wet mine runoff (do I remember correctly?) that we can allow its existence to come under this permit.

As for the issue of groundwater, it will be mixing with the wastewater and be monitored as part of that, so I don't see any special concern of its presence.

Hi Myrl,
We've received an NOI from Nash Brick Company for their mine in Enfield (Halifax County) for coverage of their clay mine under NCG02 (Mining
SW/WW permit). The site discharges stormwater and process wastewater into both Fishing Creek (WS-IV, NSW) and Powells Creek (C, HQW). The
NOI is attached.
They had a mining permit already (42-01). They have also had an NCG07 — NCG070080 which they are asking to rescind. They are discharging
process wastewater to a WS-IV stream so we will have to get approval from the DEH for them to discharge (although they already are discharging).
The other thing I am concerned about is that they have an LCID/other landfill at their site. Do you feel that the NCG02 general permit provides
adequate coverage for them in light of them having a landfills and hydrocarbon -contaminated soil disposal at their site?
Additionally, they state they are not discharging groundwater. Thinking about that I am not sure if they can state there is not groundwater there
mixed in with their other water from those pits — although we are considering it wastewater anyway.
They have asked for representative outfall status. This is not really part of their mine application so you should address this separately to them —
but NRDES WW does not allow Representative outfall status for WW discharges. We have also talked about as a unit and feel that WW ROS is
problematic from a monitoring and enforcement point of view, so we are not endorsing it right now. They will need to monitor all of their
wastewater discharges.
I'll also send a copy of the plans in the snail -mail.
Does the Raleigh Regional Office have any concerns about issuing this facility a COC for this general permit? If we don't receive any objections,
we'll issue the COC in 30 days, pending DEH approval.

The following discharges are covered by NPDES general permit NCG520000 instead of NCG020000:
• Point source discharges of stormwater and wastewater from in -stream sand mining operations (i.e., sand
dredging or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For existin mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place -
Construction. modification or installation of any new treatment components at an existing site requires an
ATC. (if the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC prior
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of
treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139.
Construction of wastewater treatment facilities subject to the AMATO requirements in the NCG02 permit
at new or existing mining sites requires submission of three (3) sets of plans and specifications signed
