Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Per the requirements of the Jordan Lake Nutrient Strategy Buffer Rule, all stormwater drainage to stream buffers, from portions of this site that have been constructed after August 11, 2c,;,:9, must be discharged through a correctly designed level spreader or another device that meets diffuse flow requirements per 15A NCAC 213 .0267. Diffuse flow requirements are described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: http://portal.ncdenr.ora/webYwc1/ws/su/bmp- manual. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be required. It's an existing mine with what looks like an expired mining permit. Not sure if it was renewed yet but that was probably what prompted their application to DWQ. So they've been in operation for some time w/o a stormwater permit or inspection. Anyway, my primary concern is what appears to be multiple discharges from their sediment basins to intermittent streams adjacent to the facility via pumping (I assume). Being in Jordan Lake Watershed, the new rules require diffuse flow into stream buffers. And we have no calculations with the application to show that basin discharges will comply with the permit benchmarks. It would be beneficial, I think, to have someone visit the site and make sure everything looks alright before we move forward. Please let me know if you recommend we proceed with issuance of the COC or not within 30 days. Call me if you would like to discuss (807-6365). Thanks.
