The NCWRP, by acceptance of this payment, acknowledges that the
NCWRP is responsible for the compensatory mitigation requirements associated
with Action ID #20001398, and agrees to provide the compensatory mitigation as
specified in this permit. As specified, the NCWRP will restore 0.75 acres of
riparian wetlands in Cataloging Unit 03040201 of the Cape Fear River basin.

Dear Mr. Davis:
ENSR Consulting & Engineering (NC), Inc. (ENSR) provided a written project description
to you on June 15, 2000 describing Richmond County's proposed water system
expansion project. Included in the proposed work is replacement of the existing intake in
Blewett Falls Lake and construction of a second 2.5-mile raw water pipeline from the
intake to the existing Richmond County Water Treatment Plant northwest of Rockingham
(Figure 1). In addition, the County is proposing to construct approximately 11.3 miles of
new water line between its water treatment plant and an area south of the town of
Hamlet, N.C. to provide settled (non-potable) water for industrial,use (Figure 1).
The project has been designed to minimize the potential impact to natural and cultural
resources from pipeline construction through collocation of approximately 70 percent of
the proposed pipeline within existing water pipeline, utility, and roadway corridors. The
remaining segment falls within an existing utility easement that to date has not been
used, but is expected to be developed for construction of electrical transmission lines
within the next few years. Further reductions in potential impacts to natural resources
have been incorporated through the proposed use of a horizontal directional drill (HDD)
installation under several perennial streams and adjacent wetlands, including Hitchcock,
Solomons, and Marks Creeks (see Attachments A-C).
Based on our June 15`h correspondence, you provided verbal verification on June 19th
that the pipeline project is eligible for authorization under Nationwide Permit No. 12.
Construction activities will comply with the Nationwide Permit General Conditions issued
with the authorization from the U.S. Army Corps of Engineers, and with the State of
North Carolina's General Conditions for 401 Certification. Construction will also comply
with a Sediment and Erosion Control Plan that has been approved by the North Carolina
Division of Land Resources, Land Quality Section. Construction steps will include
necessary clearing and grading of the route, trenching or drilling, pipeline installation,
backfilling, restoration to original grade, and soil stabilization and re-vegetation.

Please note that the project as described in our June 15th transmittal has been modified
to utilize HDD for installation of the intake pipeline in lieu of the micro-tunneling
technique that was originally proposed. This modification was based on information
obtained through geotechnical surveys that indicated unfavorable conditions for the
micro-tunneling technique. The HDD will be operated from an upland area behind the
existing pump station and will not impact wetlands or. other sensitive environmental
areas. We do not consider adoption of the HDD approach to be a significant project
change as both techniques yield minimal impacts compared to an open cut
methodology.
With this letter, it is the intent of ENSR on behalf of Richmond County, to provide Pre-
Construction Notification (PCN) under Nationwide Permit No. 12 to construct the water
supply pipeline and associated structures. We have included information necessary to
support this PCN in the attachments provided.

2) Location of Project and Site Description:
The linear project is approximately 14 miles in length. It originates at the existing
Richmond County water intake on the eastern shore of Blewett Falls Lake just above
the dam, and predominantly parallels existing utility corridors in a southeasterly
direction to the proposed terminus south of the Town of Hamlet (Figure 1). The
pipeline corridor crosses various ecological regions including upland hardwood
forest, upland pine forest, agricultural lands and other open space, and assorted
wetland systems. More comprehensive descriptions of the corridor are included in
Attachment B (Wetlands Delineation) and Attachment C (Habitat Survey and Rare,
Threatened, and Endangered Species Evaluation).
3) Project Description
a) Project Purpose
Richmond County currently owns and operates a raw water intake at Blewett
Falls Lake for the purpose of providing a public water supply. The existing intake
is located just upstream of the existing dam (Figure 1). The existing raw water
intake system was designed to supply up to 8 million gallons per day (mgd) of
raw water to the County's water treatment plant northwest of Rockingham.
Submergence problems at the intake have reduced the system's actual capacity.
In addition, the County's water needs have grown substantially in the last five
years, and are projected to grow even faster through the year 2010. The County
is proposing a system modification that will eventually have a capacity of about
28 mgd in order to meet long-term water supply needs.
To meet these long-term goals, the existing intake must be replaced and an
additional raw water pipeline from the intake to the treatment plant will be
required. In addition, the County is proposing to construct approximately 11.3
miles of new water line between its water treatment plant and an area south of
the town of Hamlet, N.C. (Figure 1) to provide settled (non-potable) water for
industrial use.
b) Direct and Indirect Adverse Environmental Impacts.
Intake Structure
The existing intake is located in Blewett Falls Lake, a federally-licensed
hydroelectric facility owned and operated by Carolina Power & Light Company
(CP&L). The hydroelectric project operates under the jurisdiction of the Federal
Energy Regulatory Commission (FERC) as Project No. 2206. The new intake
will replace the existing intake pipe and pump structure and be located
immediately adjacent to it, partly on CP&L-owned land and partly on County-
owned land. Richmond County and CP&L have submitted an application for
approval of the intake and increased water withdrawal to the FERC, which is
currently preparing an Environmental Assessment for this component of the
project under the National Environmental Policy Act (NEPA).
The proposed construction methods and intake design will result in minimal
impact on the shoreline. Cofferdams, dredging, or alteration of the shoreline at
or below the waterline will not be required as the new 36-inch diameter intake will
be horizontally directionally drilled (HDD) into the reservoir from an upland area
on shore to a point where it daylights in the reservoir. At that point, the pipe will
be pulled into the drilled hole and a "Y" will be fixed onto the pipe using a barge-
mounted crane and divers. Each arm of the "Y" will end with a 42-inch, 12-foot
long passive intake screen. The screen design is sized to keep intake velocities
below 0.5 fps to minimize the potential for impingement and entrainment of fish.
A new pump station will be installed, and the existing pump station will be
disassembled and restored to grade. The existing auxiliary generator is
adequate to serve the requirements of the expansion project.
No significant impact to fisheries within Blewett Falls Lake is expected due to
construction or operation of the intake. No wetlands or other special habitat will
be affected, and construction and operation of the new intake will not interfere
with the operation of the existing hydroelectric facilities. There will be no change
in water levels or alteration of minimum releases from the hydroelectric project to
the Pee Dee River.
Raw Water Supply Pipeline to Water Treatment Plant
The proposed increase in capacity will require installation of a second raw water
pipeline between the intake and water treatment plant. The additional line will
consist of a 36-inch pipe installed parallel to the existing 2.5-mile long pipeline.
The new pipeline will require a 32-foot temporary construction easement and a
25-foot permanent easement, and will be installed parallel to the existing pipeline.
with a 10-foot offset. Only an additional 5 to 15 feet outside the existing right-of-
way will be temporarily disturbed during construction. Use of existing permanent

easements will substantially reduce potential impacts to cultural or natural
resources.
The raw water line corridor includes crossings of four perennial streams,
including two unnamed tributaries to the Pee Dee River, Cartledge Creek, and
the headwaters of Seaburn Branch (See Attachments B and C). Crossing of
these channels will utilize open cut installation, which will have only minimal and
short-term effects (see Section 4.1 in Attachment C). Appropriate sediment and
erosion control measures for stream crossings will be specified in a Sediment
and Erosion Control Plan that has been approved by the North Carolina Division
of Land Resources, Land Quality Section. Five wetland areas totaling
approximately 2.3 acres of emergent and shrub/scrub wetlands will be crossed
(Attachment B) using an open trench technique; however these will only be
temporarily affected and will return to their prior state following construction
(Attachment C, Section 4.3).
Settled Water Pipeline to South of Hamlet, NC
The final component of the proposed project is the construction of approximately
11.3 miles of 24" water line between the water treatment plant and an area south
of the town of Hamlet (Figure 1). The majority of the route (water treatment plant
to just south of State Route 1108 near Ashley Chapel) will be constructed within
existing, previously. disturbed highway or utility easements. This segment of
pipeline will also require a 32-foot temporary construction easement and a 25-
foot permanent easement. Approximately 5 to 15 feet outside the existing utility
right-of-way will be temporarily disturbed during construction, while the corridor
will occupy 25 feet along the existing roadway.
The remainder of the route to south of Hamlet will be entirely within an existing
unbuilt 100-foot utility easement. The pipeline in this segment will have a 50-foot
construction easement (40 feet within delineated wetland areas) and 25 feet of
permanent easement (10 feet in wetlands) within this corridor. An electrical
transmission line is also scheduled for construction within this easement in the
next few years.
The segment of the settled water pipeline route falling within the previously built
utility corridor includes crossings of an unnamed tributary to the Pee Dee River,
Hitchcock Creek, and Rocky Branch. The more southerly segment falling within
the existing unbuilt utility easement includes crossings of Black Branch,
Solomon's Creek, an intermittent tributary to Marks Creek, and Marks Creek
itself.
Hitchcock Creek, Solomon's Creek, and Marks Creek are tentatively scheduled
for crossing using Horizontal Directional Drilling (HDD), subject to acceptable
results from geotechnical surveys. HDD will largely preclude effects to water
quality and the adjacent wetlands. The remaining smaller stream crossings will
be crossed using open cut installation. Appropriate sediment and erosion control
measures for stream crossings will be specified in a Sediment and Erosion

Control Plan that has been approved by the North Carolina Division of Land
Resources, Land Quality Section.
The settled water line will cross approximately 6.7 acres of wetlands, including
2.2 acres of emergent and shrub/scrub wetland and 4.5 acres of forested wetland
(see Attachment B). The 2.2 acres will be only temporarily affected and will
return to their prior state following construction. The State's Conditions of
Certification stipulate that the pipeline construction corridor width cannot exceed
40 feet within wetland areas and that permanently maintained access corridors
within wetlands shall be limited to 10 feet. Based on these corridor widths and
assuming open-trench construction along the entire corridor, approximately 3.4
acres of the 4.5 acres of forested wetland outside of the permanently maintained
access corridor will become re-established. Under this scenario, the required
area for a permanent easement to maintain access and protect the integrity of
the pipeline would result in approximately 1.1 acres of forested wetland being
converted to emergent wetland.
As previously mentioned, Hitchcock Creek, Solomon's Creek, and Marks Creek,
as well as their associated wetlands, have been tentatively identified for crossing
using HDD technology based on engineering and environmental considerations
(again, subject to acceptable results from geotechnical surveys). HDD crossings
in these three areas will reduce both the total wetland acreage affected by settled
-water line construction and maintenance corridors, and substantially reduce the
acreage of forested wetland that will be converted to. emergent wetland. Using
the maximum corridor widths provided by the State's General Conditions (40' for
construction, 10' for maintenance), total affected wetland acreage in the settled
water line corridor would be reduced from 6.7 acres to 3.2 acres. Use of HDD
technology will reduce construction corridor clearing of forested wetlands from
4.5 to 1.5 acres, and the acreage of forested wetland converted to emergent
wetland in the maintenance corridor will be reduced to approximately 0.38 acre.
c) List of other Corps Permits Used for the Project
No other Corps permits will be required for project construction. Based on the
Corps' June 19, 2000 verification letter, the intake configuration will not require a
permit from the Corps.
4) Wetlands Delineation
ENSR Consulting and Engineering (NC), Inc. (ENSR) conducted a wetland
delineation and habitat survey of the pipeline corridor during October of 2000. The
results of these surveys, summarized in the previous section, are comprehensively
reported in Attachments B and C, respectively.
5) Rare, Threatened, and Endangered Species
Based on available information provided by the natural resource agencies cited in
Section 6, and on confirmatory results from field investigations conducted by ENSR,

no federally listed rare, threatened, or endangered species will be affected by this
project (Attachment C). One State Species of Concern, the Cumberland spurge,
was identified at one location within the pipeline corridor. Although State-listed
species have no regulatory protection outside of State lands, ENSR is working with
the N.C. Natural Heritage Program to potentially relocate the few individuals that
were identified.
6) Correspondence with Resource Agencies
Information packages for this project were submitted to the following agencies during
June of 2000:
• Federal Energy Regulatory Authority;
• N.C. Wildlife Resources Commission;
• N.C. Natural Heritage Program;
' N.C. State Historic Preservation Office;
• N.C. Department of Health, Public Water Supply Section;
• National Marine Fisheries Service; and
• U.S. Fish and Wildlife Service.
These information packages included a copy of the FERC application and associated
Environmental Report (ER) prepared for Richmond County and Carolina Power &
Light by Duke Engineering & Services, Inc. - Information obtained from the field
investigations conducted by ENSR between June and October of 2000 was.
submitted to FERC as an addendum to the application. FERC in turn forwarded the
supplemental information to the appropriate agencies.
FERC is currently preparing an Environmental Assessment for the intake and water
withdrawal under NEPA. The U.S. Fish and Wildlife Service is reviewing this facet of
the project for the FERC filing. The N.C. Wildlife Resources Commission has
indicated that it has no opposition to the project, and its comments were incorporated
into the final ER. N.C. Natural Heritage Program provided information on State
Species of Concern, which was also incorporated into the habitat and species
surveys. The N.C. Division of Water Quality Wetlands/401 Certification Unit
indicated that no review on their part was required as long as the Conditions of the
USACE NWP No. 12 and the State's General Conditions for Certification will be met.
The N.C. State Historic Preservation Office has provided its clearance for the project,
as has the N.C. Public Water, Supply Section and the National Marine Fisheries
Service. Preparation of an Environmental Document under North Carolina's
Environmental Policy Act was not required by the State. A complete compilation of
agency correspondence associated with this project is included as Attachment D.
