This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adiacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Section C, Part I -of your permit (Part III Page 5 of 9). Your Operation and Monitoring Plan was approved February 8, 2010. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and Vroundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be required. The application included a copy of an associated application for a mining permit submitted to the Division of Land Resources (MR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an associated mining permit from DLR. Our office will process your stormwater permit application once a DLR mining permit has been issued for your project. Please also be aware that your project is located near wetlands, so your NPDES permit will require dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available on our website, http://l12o.eiir.state.ne-us/su/Forins_Docutnents.l7tm. The 0&M Plan was reviewed and has been determined as incomplete. The following 3 paragraphs and the information on page 3 specifically pertain to information that is required for a complete O&M Plan. The additional information is presented as a checklist and to clarify the intent of an acceptable O&M Plan. A 404 Wetland Delineation of the entire permit boundary and permit limits, as well as adjacent andlor surrounding properties that are located within the cone of depressionlinfluence of the proposed dewatering activities must be presented. Also, any Isolated Wetlands or Other Waters of the State regulated by the DWQ, must be presented. Coordination with the DWQ 401 Certification Program is required for all proposed fill of any 404 Wetlands. Note: Groundwater drawdown data or a justification of all parameters used is to be presented for each cone of depression presented. Also, the additional information must be provided regarding the periods)/stage(s) of the operation with the most potential for wetland degradation and/or negatively impacting other waters of the state, such as: • the period in which the largest volume of water is to be discharged, therefore creating the largest cone of influence, and • the stages of the operation, when working in area(s) with the maximum potential for wetland degradation or negative impacts to waters of the state are expected. • If the waters of the state are located within the cone of influence, o evidence that a restrictive horizon is present that functions as a barrier and prevents the groundwater drawdown from impacting the wetlands and/or o all protective measures that are to be implemented to prevent negative impacts, must be presented. The General Mine Dewatering Permit (NCG02) application is being processed in the DWQs Raleigh Central Office (CO). No mine dewatering is allowable prior to the permit issuance. Dewatering activities prior to approval may subject you to appropriate enforcement actions in accordance with North Carolina General Statutes 143-215.6. Civil penalties of up to $25,000 per day per violation may be assessed for failure to comply with a permit required by North Carolina General Statute 143-215.1. Other references to O&M Plans are (included as guidance and a checklist, but presents details that are expected in an approvable O&M Plan): The DWQ has concerns about the proximity of the mining operation to the wetland areas, and requests that you provide adequate engineering documentation to ensure that there will be no wetland impacts from this mine. The North Carolina Administrative Code includes Wetland Standards, 15A NCAC 02B .0231(b)(5), requiring that, "Hydrologic conditions necessary to support the biological and physical characteristics naturally present in wetlands shall be protected to prevent adverse impacts," related to several items including, "Water levels or elevations." Because this mine is located adjacent to wetlands, engineering calculations are necessary to ensure compliance with the Administrative Code. And The 0&M Plan is a requirement of Part III Section C of the NCG02. The permit requires that the plan include, at a minimum: • "Groundwater monitoring strategies to demonstrate the effect of pumping and, as necessary, establish the pumping regime necessary to reduce impacts," and • "Detailed plans to maintain the surrounding hydrology and the respective monitoring to demonstrate compliance." And Part III Section A of the NCG02 requires, at a minimum: • Appropriate Best Management Practices (BMPs) shall be used to divert, infiltrate, reuse or otherwise manage stormwater runoff and wastewater discharges. Also The O&M Plan must also provide sufficient details to present all areas and stages of the project. Some of these areas are labeled as the Final Checklist on page 6 of 7 of the NCG02 application and are as follows: Site Map (Land Quality Mine Permit Plans): o Including the Corps 404 delineation of all wetlands and the calls for any navigable waters features. o The DWQ jurisdictional calls for all isolated wetlands, streams and other waters of the state, as well as noting any possible requirements of the 0 401 Certification program. o Well placements, o Borrow areas, o Overburden storage and o Stormwater controls/BMPs are necessary, as well as o Vehicle maintenance areas, o Product process areas, o Access roads, and o etc. that are located within the cone of influence. (As applicable) • Well information (design, depths, maintenance) • Physical monitoring for the wetlands areas (if required — Protective Measures to minimize impacts are preferred.) • Settling pond sizing information (As applicable) • Level spreader design (If required) 4 Cont. — Additional Information Requested -- O&M Plan — Brinn Mine — Beaufort Co. • Details about dewatering method • Description of BMPs and measures to prevent erosion and flooding. The information set forth in this letter, is presented as guidance to assist as additional information is gathered to complete an approvable O&M Plan. Discharge from the stilling; basin must be diffuse flow prior to entering the buffer. This information is mostly jests re-emphasizing items that have been mentioned or discussed, to highlight points of most interest, but the bottom line Is that I and not aware of any reason that the COC not be issued, if the mine is permitted. He is going to send you a set of plans directly so that you'll have the full package to provide any comments. Don't believe a State SW permit will be needed for this one. He said the only impervious area will the the 60'x20' gravel entrance, which is less than tine 10,000 sf trigger. The area labeled as road area will be the in situ soil. I asked him about why the mining permit limit juts out to the canal or the central north side Of -tile proposed pit. I told him that I thought we could handle that in the cover letter stating that if they do choose to do that in the Future, they must first get a 401/404 permit. I also asked him about the inconsistency b/t the plans and narrative for the settling basin size. He stated that the smaller 50'x25' basin shown on the plans is the minimum size based on the DLR settling basin sizing requirements for pumping. The dewatering water will be the only discharge to the settling basin. All the stormwater will flow on grade either to the pit or offsite at no specific discharge point. He stated that the settling basin will dicharge non-erosively via the rip rap apron on the plans to the wetlands. With the basin and sw generally flowing to the wetlands and/or the pit, I'm not sure there will be much of an impact on the wetlands. Also, the site if very flat-, only about a T drop across the I 1 acre pit. I'm wondering if they still need a basic O&M Plan to include some monitoring wells to be sure they are not impacting the wetlands. What's your fecling on this? Hope you have a Happy New Year!! They show the final reclamation plan... basically just showing the eIxcavation area as a big pond. They have a typical cross section of a settling pond, but don't show at all where it will be at any point as the mining progresses. I also just noticed another item ... they show the mine permit limits going into the wetlands up to the canal (appears as a blue line stream on the USGS map) of Pungo Creek. The facility drains to Pungo Creek (class Sc; NSW) in Belhaven (Beaufort County). No vehicle maintenance or haz waste. There is mine dewatering proposed. The not states that the water will be pumped to a temporary onsite settling basin (50' x 25' x 4'deep); and that the "facility will not overflow except during hurricanes". No volume calcs were included to verify whether or not it would discharge only in large events. They only submitting one site plan. It shows extensive wetlands (6.85 acres) along the northern part of the property. They have provided a 50' undisturbed buffer around the wetlands. But, on the not they marked number 10 as "no", so they apparently do not feel they need an O&M plan. I would think with that amount of wetlands 50' from the pit, we would want to require an O&M plan? hl a letter I sent the owner yesterday, I stated that they need to contact WARD about an O&M plan; and that we are also waiting on DLIZ to issue their mining permit before we can act oil this NPDES permit. The site plan also shows a I acre road entrance, so I included language In that letter that they may be required to get a State SW Permit. They have been directed to Scott Vinson for that. Does the WARO have any concerns about issuing this facility a COC for this general permit? ATC requests must be submitted at least 90 days prior to construction'. For existing mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities: This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place. Construction, modification, or installation of any new treatment components at an existing site requires an ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI). Some wastewater treatment facilities used to treat or recycle process wastewater (even if commingled with stonnwater) at mining sites will require an ATC prior to construction per 15A NCAC 211 .0138. Please see the NCG020000 General Permit for details about which treatment facilities require an ATC (summarized in Table 1 at the end of this form). For example, an ATC is required for treatment of mine dewatering discharge from clay pits and non -closed -loop wastewoter recycle systems. The authorization to construct or continue to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139.
