Lee, Jr. Lake Project, Pamlico County Smith Gut [03-04-10; 27-114; SC Sw NSW] Dear Mr. Rice, On February 13, 2001, the Division of Water Quality (DWQ) received your request for guidance on how the Neuse River Riparian Buffer Protection Rules (15A NCAC 2B .0233) would effect your proposed lake project. Please refer to our web site (http://h2o.enr.state.nc.us/ncwetlandsn or callus at 919-733-9726 for a copy of the permanent version of the rules approved last August. To set up a site visit to review your proposed activity, please call Ms. Deborah Sawyer of the DWQ Washington Regional Office at 252-946-6481. The protected riparian buffers apply to all surface waters and coastal wetlands indicated on the most recent version of either the USGS topo maps or NRCS Soil Surveys. You may verify the buffers by calling your regional office (Ms. Deborah Sawyer, Washington Regional Office, DWQ, 252-946-6481). If your proposed project impacts any of these areas you will be required to receive written authorization from the Division and may be required to mitigate for the proposed impact. [Mitigation for new ponds is required if the pond is authorized for construction without the requirement of establishing a riparian buffer per 15A NCAC 2B .0233(5) around the newly constructed pond.] To obtain written authorization you must submit a request for a "no practical alternatives" analysis. You can accomplish this by completing a PCN (Pre-Construction Notification) form and including all of the information identified within 15A NCAC 2B .0233(8). You can send seven copies of this information to our office for review. Once a complete request is submitted the Division has 60 days to respond. Please note that you may submit this request in conjunction with any application required for a 401 Water Quality Certification. Any activities not identified within the Table of Uses [15A NCAC 2B .0233(6)] are considered prohibited and will require a variance from the rules. This letter does not address or authorize any activity within the protected riparian buffers. Nor does it address or authorize any other Federal, State or Local regulations including (but not limited to) the 404/401 Wetland Permit and Water Quality Certification and local Sediment and Erosion Control permits. Lee, Jr. we are presenting the above enclosures for your review and comments. As enclosure one indicates, Mr. Lee proposes the construction of three deep water lakes encompassing approximately 73 acres of a 288 acre tract of land. The remaining property will be subdivided, with the lakes providing waterfront property possibilities. The northernmost lake will discharge into the center lake through a manmade stream-like conveyance not yet designed.
