No Comments: Mid 2009, the DLR requested comments regarding a mining permit modification with expansion(consisting of 37.9 total acres (AC) of affected area and 29.32 AC of excavation) for Permit #: 25-75. Following the proiect review, the DWQ Washington Regional Office (WaRO) staff determined the original Pumping O&M plan to be acceptable. After the Agency comment evaluation the DLR issued a modification to the permit on 12/10/09. On September 7. 2010. the Owner reauested another Minina Permit Modification Expansion. This reauest is to increase the -permitted area by 10.76-AC(consistinq of 51.64 AC as the total permifted boundary, with 48.5 AC of affected area and 39.74 AC to be excavated). The package notes that the discharge rate of 1.44 MGPD, as well as the maximum 35' depth of excavation, are not expected to change as a result. of the increase in area. In addition to the increased area another purpose for this modification request is to obtain approval to incorporate a gravel crushing operation within the excavation area. Also included within this package is the process utilized for washing and grading the sand. The description presents that excess water is comingled and discharged along with the wastewater. Note: Washing of sand and/or gravel creates "Process Water" and requires an Authorization to Construct (AtC). See the permit text for the requirements. Increasing the depth of this mine would also increase the amount of water which would need to be pumped / discharged and could potentially impact the neighboring wetlands and streams. Please submit to this Office at the address listed at the bottom of the page a revised Pumping Operation and Monitoring (O&M) Plan, as required under Part III, Seciion E., no.1 of General Permit NCG020000. The revised O&M Plan should include how this dewatering will occur and not degrade any neighboring wetlands and surface waters. It should also include the pump sizes, flow rates and frequency of proposed pumping events. Please submit the requested information by October 8, 2011. Mr. Manning is issuing an NOV for not meeting the permit condition to have an approved plan prior to dewatering. After knowledge of the requirements, proceed with comments to LQ request. 6/11/09 Had not seen NOV so I submitted comments prior to receipt. 6/11/09 My comments to the land quality request was USACE (Corps) contact & approval is required. A wetland delineation is required. Then a 401 certification review request must be made to DWQ to determine if an investigation is necessary. Currently dewatering will be issued a NOV for non compliance w/ permit condition that O&M plan is required. A modification to increase area and O&M plan to include expansion is required. Note when NCG020721 is brought into compliance by producing an O&M plan. 6/12/09 NOV was sent. 7/2/09 read over the response from Ed Warren to the NOV. O&M must have been lost in the mail because it was created. I quickly reviewed the O&M per mr. Jeffs request and asked Samir if level spreader was necessary 100' away from the wetland line and he said that Rip Rap would be acceptable. I discussed the plan with Mr. Al and he said that the activities and case across the wetlands should not be of much significance to the permitting and therefore I told Mr. Jeff that the plan appeared to be acceptable to me. 7/21/09 emailed these comments to Ed Warren as requested, for information of my expectations.
