In accordance with your application for a discharge permit received on February 23, 2007
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state--NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
The permit previously held by Hoopers Creek Quarry, NCG070165, is rescinded
immediately upon issuance of this new Certificate of Coverage for the NCG020000-general
stormwater permit due to a recommei dation;of Starr Silvis of the Asheville Regional Office
during a site inspection.
If any.parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting`an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect.the legal
requirements to obtain other permits which may be required by the Division of Water Quality or

This facility is actually a quarry. The facility has stated that their SIC code is 1411. The facility was advised to ask that
the NCG070165 permit be rescinded. The facility was given a copy of the NCG020000 NOI, general permit, and technical
bulletin.
Mr. Junius Grimes met the inspectors at the retail sales site. Inspectors then accompanied Mr. Grimes to the quarry site.

Dear Ms. Kiratzis:
Thank you for your letter dated September 10, 2003 with accompanying photographs
expressing your concerns regarding turbidity issues at the Hooper's Creek Quarry in Henderson
County, as well as the report dated April 25, 2003. ]apologize for the delay in responding, but it is
taking a while to try to determine the exact cause of your complaint.
Erosion and sediment control measures were installed at the quarry at the time of
inspections conducted at the site by personnel from the Division of Land Resources. Typical
erosion and sediment control measures do not prevent the escape of the really small clay size soil
particles that stay suspended and cause turbidity. We have also sought input from the Division of
Water Quality concerning your report. The mine operator has a pending modification request to
redesign the access to the site and improve the sediment control measures. 'The sediment basin
has now been designed to be much more efficient.
I understand that there may be other land disturbing activities upstream of the quarry that
may be causing turbidity problems. Our inspectors will also check these areas to see if the activity
falls under state jurisdiction for erosion and sediment control.

This letter serves as your notification that the Division of Water Quality (DWQ) has reissued the general
permit and that your facility's coverage will continue under the conditions of the reissued general permit.

is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection

herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of' North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmer'ttal Protection agency dated December 6, 1983.
If any parts, measurement frequencies Cr sampling requirements contained in this permit sre unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
rnade, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality mayi require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal recjuirei-lents to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management.Act or any other
Federal or Local governmental permit that may be required.
