Easley, Governor William G. Ross Jr., Secretary North Carolina Department of Environmem and Natural Resources December 31, 2007 Coleen H. Sullins, l]irector Division of water Quality The Division of Water Quality (DWQ) in the Wilmington Regional Office received the 0 & M plans for the following projects; NKT Projects No. 07144 (Old New Britton Road Mine, received December 20), 06148 (Henry Bryant Mine, received December 20), and 06188 (Hardee Sand Mine, received November 30), Each of the O & M plans have been reviewed and the following comments are provided for your consideration: NKT Project No. 07144: 1. Please provide a USGS quadrant map with an overlay of the mine site. The USGS map is helpful in identifying any blue line streams or potential wetlands outside the boundary of the mine site. The map should be large enough to accommodate the identification of the access roads, excavation area, settling basins, spoil piles, undisturbed buffers, and level spreader locations. The map provided showed wetlands mostly within the mine site (proper) but left some uncertainty that wetlands had been identified outside the mine site (specifically to the north of the mine site). DWQ is interested in the protection of all wetlands, including those located outside the mine site boundaries. 2. Provide a copy of the delineation certified by the US Army Corp of Engineers or a letter from the l .r USACOE indicating concurrence with the wetland boundaries identified on the m p provided. 3. j Monitoring wells should be of sufficient number to provide data on hydrology of each wetland that has the iy0 potential to be impacted by dewatering activities. The monitoring wells should be of sufficient depth to demonstrate wetland hydrology. Use of existing wells that are 40-50 feet deep are too deep to demonstrate wetland hydrology and should not be used to demonstrate whether wetland impacts are occurring, Ptacement of the monitoring wells should be in the wetlands, just outside the undisturbed buffer. The two monitoring wells identified on the map are located outside the wetland boundaries and are not shallow monitoring wells. 4. Mining roads or berms should not be built within the 50' undisturbed buffer, since an undisturbed buffer refers to an area that has not been disturbed. Building a road or berm is a disturbance. 5. The number of level spreaders and their locations should provide recharge to all wetlands that have the potential of being impacted by dewatering activities. 6. Include in the O & M plan a statement that requires the permittee to discontinue dewatering activities immediately and contact DWQ upon noticing any impacts to surface waters or significant changes in wetland hydrology and vegetation due to dewatering and will not resume dewatering until DWQ has conducted an inspection of the mine site. DWQ will be notified if the daily flow exceeds the projected flow or pump rates are increased to any level spreader exceeding those identified in the plans. 7. Please provide the calculations (including any assumptions made) that demonstrate the accuracy of the projected daily discharge of water that will need to be removed from the mine excavation pit. Please account as well for the contribution to flow from stormwater. Explain how adequate settling will be achieved during the early stages of digging (and dewatering) when the size of the pit is too small to provide adequate settling. 8. The flow and pump rates and dimensions of level spreader and stilling basin need to be identified in writing in the text of the O & M plan. NKT Project No. 006148: 1 , Please provide a USGS quadrant map with an overlay of the mine site. Please see justification above. The map provided showed wetlands mostly within the mine site (proper) but left some uncertainty that wetlands had been identified outside the mine site (specifically to the south, southeast and southwest of the mine site). DWQ is interested in the protection of all wetlands, including those located outside th@lonsthCwolina mine site boundaries. Monitoring wells should be of sufficient number to provide data on hydrology of each wetland that has the potential to be impacted by dewatering activities. The monitoring wells should be of sufficient depth to be able to demonstrate wetland hydrology (shallow wells required). Five new monitoring wells are proposed in the plan. Please be sure monitoring wells are within the wetlands in as close a proximity to the undisturbed buffer as possible, but not in the buffer. 4. Mining roads or berms should not be built within the 50' undisturbed buffer, since an undisturbed buffer refers to an area that has not been disturbed. Building a road or a berm is considered a disturbance. 5. Please provide a minimum length of 13' for each level spreader. The plan does not identify the length of the level spreader in the design (attachment C2). The number of level spreaders and their locations should provide recharge to all wetlands that have the potential of being impacted by dewatering activities. 6. Sullins, Director Divisiun of %Vatcr Quality November 16, 2007 Re: Hardee Sand Mine (Holden Beach) Brunswick County COC NCG020709 The Division is in receipt of your O & M plan for the above project. As requested, a review of the plan was conducted. The following items should be addressed in the O & M plan: 1. A map of the mining site should be provided with the following details; landscape and position of wetlands (based on the Army Corps of Engineers delineation), ditches, proposed monitoring well placement, borrow areas, overburden storage, vehicle maintenance areas (if conducted on site), mining roads, buffers, rain gauge locations, fuel and bulk storage areas, buildings and other impervious surfaces (if present), stornnvater controls, location of level spreader, and erosion and sediment control facilities (silt fencing). 2. Identify how the buffer around the mine will be marked to ensure the activities on site will not encroach the buffer. 3. Provide the design specifications for the level spreader and identify the amount of water to be discharged (worse case scenario). Level spreader should be able to handle the maximum discharge rate without exceeding velocities that would cause erosion of the vegetated buffer. 4. Provide the design specifications of the settling, detention or stilling basin and all calculations showing what size storm event the stilling pond was designed for in order to provide adequate settling time before discharge. Identify the frequency for which sediment build up will be monitored in the stilling basin. Provide the method used for conveving water from the stilling basin to the level spreader. 5. Provide details on the installation, data loggers, well maintenance schedule and depths of wells located in the wetlands. Provide the design of the shallow wells. Provide the frequency for inspecting the water levels in the monitoring wells and rain gauges on site. 6. Include an inspection schedule for the health of the vegetation in the wetland as a precautionary measure for protection. Provide an explanation of how monitoring well data will be analyzed to detennine wetland hydrology. 7. BMP plan should include all good housekeeping practices that will be implemented on site including clean up procedures for oil or fuel spills. Please evaluate these comments versus the O & M plan and modify the plan accordingly. Please note that this section only applies to waters that have specifically been determined to be isolated by the USACE. 8. Pond Creation NIA If construction of a pond is proposed, associated wetland and stream impacts should be included above in the wetland and stream impact sections. Also, the proposed pond should be described here and illustrated on any maps included with this application. Pond to be created in (check all that apply): ❑ uplands ❑ stream ❑ wetlands Describe the method of construction (e.g., dam/embankment, excavation, installatibn of draw -down valve or spillway, etc.): Proposed use or purpose of pond (e.g., livestock watering, irrigation, aesthetic, trout pond, local stormwater requirement, etc.): Current land use in the vicinity of the pond: Size of watershed draining to pond: Expected pond surface area: VU. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower -impact site layouts, and explain why these design options were not feasible_ Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant attempted to minimize wetland impacts to the P-reatest extent possible. Impact #1 is needed to gain access to uplands within the site. This crossing has been -positioned at an existing road crossing to minimize impacts. Impact #2 is needed at a small wetland finger that extends into the site. It would be difficult to avoid this finger and still maximize the amount of valuable gpland sand material_ to be mined around_ it. VIII. Mitigation DWQ - In accordance with 15A NCAC 2.H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Updated 11/12005 Page 5 of 8 USACE -- In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required .for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httl2://h2o-enr-state.ne.us/newetiands/strmgide,html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. The a licant will plant the edges of the mined areas with native herbaceous and wood vegetation as requested by the WRC._A 50' upland buffer will be maintained around a maiority of the wetlands (see site plan). Because total wetland impacts have been minimized, no further mitigation is proposed. _ 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 71510476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of the NCEEP is proposed, please check the appropriate box on page five and provide the following information: Amount of stream mitigation requested (linear feet): n/a Amount of buffer mitigation requested (square feet): n/a Amount of Riparian wetland mitigation requested (acres): n/a Amount of Non -riparian wetland mitigation requested (acres): n/a Amount of Coastal wetland mitigation requested (acres): n/a . Tunstali, P.E. N C J.A. Kuske, PE. of Counsel 9 s't&D CEIVED JA N 2 3 2008 In regards to your December 31, 2007 comment letter, the following are the responses: 1. An 11X17 Color Quad sheet with the approximate mine location has been provided. Due to scaling issues a true overlay is unattainable. Please contact me if you have any questions regarding this matter. 2. A copy of a letter from the US Army Corp of Engineers indicating the wetland boundaries is enclosed. 3. New monitoring well locations have been indicated and a max depth of 10' has been specified. 4. All mining roads are a sufficient distance from all wetlands. The necessary permit for the wetlands crossing is included. 5. Level spreaders will be provided as indicated. Please see the detail sheet for dimensional requirements. 6. See response #4. 7. Typically immediate dewatering is not required. As the excavation depth increases a pit will be excavated for collection and the mine will be sloped to drain. This will allow for a concentrated water collection area. This pit area will be pumped out periodically on an as need basis. The discharge will consist mainly of collected stormwater. The predominant soil type in the area is murville which has a low permeability therefore a large amount of groundwater exfiltratidn is not anticipated. 902 Market Street • Wilmington, NC 28401-4733 • Phone: 910.343.9653 • Fax: 910.343.9604 Ms. Linda Willis! DENR January16, 2008 Hardee Sand Mine NKT # 06108 Page 2 8. Pumps and flowrate data have been indicated on the detail sheet. 9. The approved permit for the necessary wetland permit is included within this package. 10. The requested statement has been added to the notes on the plan. Please contact us if you have any further questions or comments. Thank you for your assistance on this project. Sincerely, NORRIS, KUSKE 8r TUNSTALL CONSULTING ENGINEERS, INC. ?Joseph K. Bland, E.I.
