In accordance with your application for a discharge permit received on March 28, 2007,
and the subsequent issuance of your Division of Land Resources mining permit, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state --
NPDES general pen -nit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently.amended).
Please be aware that mine dewatering has the potential to impact adjacent wetlands. If
your facility has wetlands in close proximity to areas being dewatered, then specific
requirements may apply to you. These requirements for mine dewateringat facilities near
wetlands can be found in Part I11, Section E of your -permit. If this condition applies, you should
work with the Division's Washington Regional Office in the development and approval of an
Operation and Monitoring Plan. Contact Al Hodge at the Washington Regional Office at (252)
946-6481.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land --
Resources, Coastal Area Management Act or any other federal, state or local governmental
penilit that may be required.

I have mentioned to you a couple of times recently some old mining applications that I need to deal with. Well, I'm finally
passing these along. As you will see, there are really old and fell through the cracks for us. I dropped the ball after
original staff on these left our unit. I'm sorry about that. I'd like to talk with you about the best way to deal with the permits
for these. It is possible that we just want to issue them and then deal with any issues through inspections after the
permits are in place since all of these have had their DLR permits issued since applying to us. Give me a call and let's
talk about these. As you will see in the table below, we have previously requested regional office comments on all of
these but I think you guys were in some transition position -wise during this time period. If you need us to forward any
information back to you on them let us know.

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Ludlum Sand Mine on March 28, 2007. The application
included a copy of an associated application for a mining permit submitted to the Division of Land Resources
(DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an associated
mining permit from DLR. Our office will process your stormwater permit application once a DLR mining
permit has been issued for your project.
Please also be aware that your NPDES permit will require dewatering operations without impacts to
wetlands. The specific requirements for -mine dewatering at facilities near wetlands can be found in the text of
the general NPDES mining permit number NCG020000, available on our website,
littp:Hli2o.enr.state.nc.tis/su/Forms_Documents.htm. See Section C, Part I of the pen -nit on the page labeled,
"Part III Page 5 of 9". An approved Operation and Monitoring Plan is required for NPDES-permitted mining
facilities. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action.
A Plan for your facility must be submitted to the Washington Regional Office within 60 days of your receipt of
an NPDES permit. We encourage you to contact Al [-lodge at the Washington Regional Office at (252) 946-
6481 to address any wetland concerns for your facility in order to ensure a successful NPDES application
review.

2. Mine maps must be accurate and ' appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps alongwith their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that. are intended to be conducted during the life of the mining permit. All maps must
be of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at

A nonrefundable $50.00 permit application processing fee is required for minor permit modifications. Minor permit modifications include ownership transfers,
name changes, bond substitutions and permit renewals where the mine is inactive and fully stabilized. • A minor permit modification also includes lands added
to a permitted area, outside of the minimum permit buffer zone requirements, where no plans for mining related disturbance of the added lands have been
approved. All other changes are considered major modifications.
Acres for new permits and renewal pertxdts means the total acreage at the site. Acres for major modification of pernvts means that area of land affected by the
modification within the permitted mine area, or any additional land that is to he disturbed and added to an existing permitted area, or both.

SEEDBED PREPARATION
THE CONTRACTOR SHALL CUT AND DISPOSE OF WEEDS OR OTHER UNACCEPTABLE GROWTH ON THE AREAS
TO BE SEEDED. UNEVEN OR ROUGH AREAS SHALL BE SHAPED AND SMOOTHED TO PROVIDE FOR EFFECTIVE
SEEDING AND EASE OF MOWING. THE SOIL SHALL BE SCARIFIED TO A DEPTH OF NOT LESS THAN 5 INCHES.
CLODS SHALL BE BROKEN AND THE TOP 3-4 INCHES OF THE SOIL SHALL BE WORKED INTO A SEEDBED BY
THE USE OF PULVERIZERS, DRAGS, OR HARROWS. THE PREPARATION OF SEEDBEDS SHALL NOT BE DONE WHEN
THE SOIL IS FROZEN OR EXTREMELY WET.
LIMESTONE, FERTILIZER, AND SEED
LIMESTONE, FERTILIZER, AND SEED SHALL BE APPLIED WITHIN 24 HOURS AFTER COMPLETION OF SEEDBED
PREPARATION. LIMESTONE AND FERTILIZER MAY BE APPLIED AS PART OF THE SEEDBED PREPARATION, PROVIDED
IT IS WORKED INTO THE SOIL. IF NOT SO APPLIED, LIMESTONE AND FERTILIZER SHALL BE DISTRIBUTED UNIFORMLY
OVER THE PREPARED SEEDBED AT THE SPECIFIED RATE OF APPLICATION AND THEN HARROWED, RAKED, OR
OTHERWISE THOROUGHLY WORKED INTO THE SEEDBED. SEED SHALL BE DISTRIBUTED UNIFORMLY OVER THE
SEEDBED AT THE RATE OF APPLICATION SPECIFIED, AND IMMEDIATELY HARROWED, RAKED, OR DRAGGED AS
TO COVER THE SEED WITH A LAYER OF SOIL.

ALL SEEDED AREAS SHALL BE MULCHED. GRAIN STRAW MAY BE USED AS MULCH AT ANY TIME OF THE
YEAR. MULCH SHALL BE APPLIED WITHIN 24 HOURS AFTER THE COMPLETION OF SEEDING. CARE SHALL
BE TAKEN AS TO PREVENT DISPLACEMENT OF SOIL OR SEED FROM THE SEEDBED AREA DURING MULCHING
OPERATIONS. MULCH SHALL BE UNIFORMLY SPREAD BY HAND OR MECHANICAL SPREADER. AN ACCEPTABLE
APPLICATION WILL BE THAT WHICH WILL ALLOW SOME SUNLIGHT TO PENETRATE AND AIR TO CIRCULATE BUT
ALSO PARTIALLY SHADE THE GROUND, REDUCE EROSION AND CONSERVE SOIL MOISTURE.
MAINTENANCE
AREAS WHERE SEEDING AND MULCHING HAVE BEEN PERFORMED SHALL BE MAINTAINED IN SATISFACTORY
CONDITION UNTIL ACCEPTANCE OF THE PROJECT BY THE OWNER. AREA OF DAMAGE OR FAILURE DUE TO ANY
CAUSE SHALL BE REPAIRED OR REDONE AS NECESSARY.

C. ENTRANCE(S) SHALL BE LOCATED TO PROVIDE FOR MAXIMUM UTILITY BY ALL CONSTRUCTION VEHICLES.
D. PAD MUST BE MAINTAINED IN A CONDITION WHICH WILL PREVENT TRACKING OR DIRECT FLOW OF MUD
ONTO STREETS. PERIODIC TOPDRESSING WITH STONE WILL BE NECESSARY.
E. ANY MATERIAL WHICH IS TRACKED ONTO ADJACENT ROAD SHALL BE REMOVED IMMEDIATELY.

THE CONTRACTOR SHALL COMPLY WITH ALL APPLICABLE REQUIRMENTS OF THE EROSION
AND SEDIMENT CONTROL STANDARDS AND SPECIFICATIONS OF THE DEPARTMENT OF NATURAL
RESOURCES AND COMMUNITY DEVELOPMENT. SOIL EROSION AND SEDIMENTATION CONTROL
MEASURES SHALL BE PROVIDED ON ALL AREAS OF THE SITE WHICH ARE DISTURBED OR
GRADED. CONTRACTOR SHALL PROVIDE GROUND COVERS (SEE SCHEDULE BELOW) WITHIN 30
CALENDAR DAYS AFTER COMPLETION OF CONSTRUCTION WITHIN THE SPECIFIC AREAS. THE
CONTROL MEASURES SHALL BEGIN PRIOR TO ANY LAND DISTURBING ACTIVITY INCLUDING
CLEARING; SHALL CONTINUE DURING THE CONSTRUCTION AND SHALL CONTINUE WITH THE
NECESSARY MAINTENANCE UNTIL THE DISTURBED LAND IS STABILIZED, COMPLIANCE WITH LOCAL
AND/OR STATE SOIL EROSION AND SEDIMENTATION CONTROL LAWS SHALL BE THE ENTIRE
RESPONSIBILITY OF THE CONTRACTOR. THIS PARAGRAPH IS INTENDED TO SERVE ONLY AS A
GUIDE TO THE CONTRACTOR FOR COMPLIANCE WITH SUCH LAWS. ORDERS, RULES AND
REGULATIONS CONCERNING EROSION AND SEDIMENTATION CONTROL PROTECTION OF EXISTING
