The subject property is located adjacent to NCSR 345 in Wanchese, Dare County, North Carolina. A condition of the 401 water quality certification requires that a stormwater plan be in place prior to the specified impacts to the existing wetlands. Dorman cc: Pirate Marine Park, LLC Revised Stormwater Management Plan Narrative Pirate Marine Park July 30, 2001 General The following narrative will detail the proposed stormwater management plan for the proposed Marine Park, to be located adjacent to S.R. 345 in the Town of Wanchese. The proposed project will be located on a parcel occupying 1.68 acres on the east side of S.R. 345 approximately 0.25 miles south of the WOBR radio tower. The proposed development of this parcel will consist of a 8,000 s.f. metal building housing a boat building facility and 2,500 s.f. office building. All development is in compliance with the Dare County Zoning Ordinances. The proposed stormwater management method will be three (3) dry infiltration basins. The following narrative, will demonstrate the parameters of this design which will illustrate an effective stormwater management system. Stormwater Collection, Treatment, Storage, and Disposal Collection The stormwater will be directed into dry infiltration basins via sheet flow from the gravel parking area and roof drains on the proposed buildings will also direct stormwater to the basins. The basin bottom will be grassed according to the general seeding specifications and maintained according to the operation and maintenance plan. The runoff will undergo filtration of fine particulates and pollutants by the vegetation within not only the basin bottom but also the basin side walls which will also be seeded according to the general seeding specifications. The filtration by the vegetation is considered the primary treatment method. The enclosed plan has been included to illustrate the proposed location of the infiltration basins. The areas of the property that are not impervious, will intercept runoff and provide additional locations for stormwater infiltration. Treatment The proposed infiltration basins will be vegetated according to the general seeding specifications. Stormwater collected within these infiltration systems will undergo debris and pollutant filtration by this vegetation effectively treating it prior to infiltration or discharge. Storage The infiltration basins will provide adequate temporary storage of the stormwater runoff prior to infiltration. This infiltration basin system will offer adequate storage above the ground surface. The infiltration basins will offer storage in excess of the first inch of runoff. The first inch of runoff generated by all impervious surfaces will require approximately 2,070 ft' of storage. The storage available above the ground surface is 6,880 ft3 or over 3 times the storage required. This storage value is equal to approximately 3.3 inches of runoff over all impervious surfaces. Disposal The disposal will occur within the subsurface via infiltration. The proposed infiltration basin located adjacent to S.R. 345 will also be tied into the NCDOT roadside stormwater management system as an additional outlet for particularly large storm events. IV. INFILTRATION BASIN OPERATION AND MAINTENANCE AGREEMENT 1. After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re-seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over-excavating. Over-excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the design depth reads feet in the pretreatment unit, the sediment shall be removed from both the pretreatment unit and the infiltration basin. 5. If the Division determines that the system is failing, the system will immediately be repairedto original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed. The required additional information is as follows: 1. Typical Plan Detail Please provide a typical plan detail for the infiltration basins. See pages 83 and 84 of the NCDENR Stormwater Best Management Practices Manual, April 1999. 2. Design Requirement Information Please provide the following information: • Soil infiltration rate. • The volume of the 1 inch rain from the area tributary to each basin. The Division review process utilizes the Simple Method for determining the 1 inch storm volume to be controlled. This method is outlined in NCDENR Stormwater Best Management Practices Manual, April 1999. 3. Drainage Area Please delineate the drainage area including offsite drainage to each basin. 4. Operation and Maintenance Agreement An operation and maintenance agreement is required. Typical requirements for an operation and maintenance plan include the following: • Vegetation management schedule + • Semi-annual inspections - • Debris check after every storm event • Benchmark for sediment removal (specific elevations listed) • Designation of a responsible party The operation and maintenance agreement must also be signed by the responsible party and notarized. Also, I have attached a copy of relevant sections State Stormwater Permit application form. An example operation and maintenance agreement as well as a check list for an infiltration basin design review is included. This form is also available on line at http://h2o.enr.state.nc.us/su/PDF Files/State _SW-Program _forms/SWU103_Infiltration Basin Supplement.pdf. However, please be advised, a formal application and fee is not required in this instance. Disposal The disposal will occur within the subsurface via infiltration. Croatan Hwy., Suite 103 Kill Devil Hills, NC, 27948 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Perry: You have our approval, in accordance with the attached conditions, to place fill in 0.08 acre of wetlands for the purpose of commercial fill on your property in Dare County, as you described in your application received by the Division of Water Quality on February 17, 2001 and in additional correspondence received on May 17, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This Certification allows you to use Nationwide Permit 18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. - If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre; compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: An additional condition is that a final, written stormwater management plan shall be approved in writing by this Office before the impacts specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and operational, and the stormwater management plan, as approved by this Office, shall be implemented. The structural stormwater practices and well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You mlTst act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
