Number N00020675. In accordance with your request, Certificate of Coverage Number NCG020675 is rescinded ,
effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwate'r to waters of the State
without valid coverage under an NPDES permit will subject the responsible party to a civil peiialty of up to $25,000 per
duty. It is the intention of DWQ that enforcement proceedings will occur for persons -that have voluntal'ily relinquished
permit coverage when, in fact, eolltillllirla permit coverage was necessary. If, in retrospect, you feel the site still requires
permit coverage, you should notify this office irii101edlately. Furthermore, if in the future you Wish to again discharge to
the Slate's stirface waters, you must first apply for mid receive a r1ew NPD1--.S permit.
If the facility is in the process of being sold, you will be performing a public service if you WOlild iilform the llew or
prospective owners of their potential need forNPDCS.permit coverage.

Patrick Whitehurst, Operations Manager [phone] and I met on January 27, 2010 for an onsite
inspection. The mine is in the reclamation stages with no additional mining to be conducted. There is
no equipment onsite and all evidence of dewatenng has been removed. I recommend that NCG020675
be rescinded.

In accordance with your application for a discharge permit received on March 6, 2006,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility, and that all stormwater will drain into the mine and be pumped into
the detention ponds. If separate point -source discharges of stormwater occur (i.e., stormwater
not combined with mine dewatering water), you will be required to adhere to the conditions in
this permit for stormwater discharges.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

This certificate of coverage shall become effective June 23, 2006.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
