Resources (DEMLR) is forwarding herewith the reissued Certificate of Coverage and
Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently
amended.) The following information is included with your permit package:

The General Permit authorizes discharges of stormwater and/or wastewater (as applicable to your site),
and it specifies your obligations with respect to discharge controls, management, monitoring and record
keeping. Please review the new permit to familiarize yoursclf with all changes i❑ the reissued permit.
Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law. rule, standard, ordinance, order,
.judgment or decree.

In accordance with your application for a discharge permit received on January 9, 2006,
we are forwarding herewith the subject certificate of coverage to discharge under.the subject
state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This general permit allows the discharge of stormwater and certain types of wastewater
from mining facilities. In your application, you specified that only stormwater would be
discharged from this site, which is reflected on the certificate of coverage (COC).
Please take notice that this certificate of coverage (COC) is not transferable except after
notice to the Division of Water Quality. The Division of Water Quality may require
modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land,
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

Al asked me to look over this NOI request. I have not been to the site, however,
since there is no dewatering activity, flows should not be sufficient enough to cause
a problem. Also, it travels through a swampy area before it reaches Ready Branch so
hopefully there will be no turbidity issues. Go ahead and issue the NOI. If you have

Hi Al,
Ronnie Revels 'Backhoe and Septic Tank Mine' in Martin County near Williamston has
applied for coverage under NPDES stormwater general permit NCG02. The facility will
mine sand and fill dirt, and will discharge only stormwater from a settling pond (no
dewatering or other wastewater discharge). The discharge is to a UT to Ready Branch
(C waters) in the Roanoke Basin. A copy of the NOI is attached.
Does the Washington Regional Office have any concerns about issuing a COC to this
facility? There will be no dewatering, so I don't think wetlands issues would arise
with this one. If we don't receive a response, the Central Office plans to issue the
COC in 30 days.

We are currently going through a renewal of the mining permit. The renewal has not
been issued to date. The number recently changed to 59-28.

APPLICATION FOR A MINING PERMIT
2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. AU aspects of the mine site must be clearly labeled on the
maps along with their corresponding (appro)dmate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that are intended to be conducted during the life of the mining permit. All maps must
be of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at
a minimum:
a.
Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b.

indicate the sequence and general methods to be used in reclaiming this land. This must include the
method of reclamation of settling ponds and/or sediment control basins and the method of restoration
or establishment of any permanent drainage channels to a condition minimizing erosion, siltation and
other pollution. This information must be illustrated on a reclamation map and must correspond
directly with the information provided on the mine map(s). In addition, design information, including
typical cross -sections, of any permanent channels to be constructed as part of the reclamation plan and
