In accordance with your request, Certificate of Coverage Number NCG020672 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stop nwater to waters oftlle State without valid coverage under an NPDIES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage vdien, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public ser_vicc ifyou would inform the new or prospective owners of their potential need for NPDES t;ermit coverage. Your assistance and cooperation of Mr. Brown was very helpful and appreciated. 1. NCG020406-Barnhill Contracting Company -Highway 97 Mine. This mine was not active at the time of the inspection and had ceased to discharge. Due to the current workload this mine has been inactive for two years. Barnhill has chosen to keep the permit active for the Highway 97 Mine. Continue to implement your Stormwater Best Management Practices Plan and conduct Analytical and Qualitative monitoring as required by Part III Section A and B of your General Permit. 2. NCG0020717-Logsboro Pit This mine was not active during the time of the inspection. The mine had ceased to discharge. The Logsboro Pit had not been active for one year. Due to the current workload, this pit will not operate. Barnhill has chosen to keep the permit active for the Logsboro Pit. This mine was not active during the time of the inspection. As per Barnhill, this mine has been completely mined out. There is no discharge outlet. This mine has been inactive for two years. Please submit a letter requesting permit rescintion for NCG020672-Anderson Pit. The facilities Stormwater Best Management Practices (BMP) Plan and implementation must address and comply with all items of Part III, section A as required by Stormwater General Permit NCG020000. Please update your Stormwater BMP and provide precise implementation details. Provide a copy of these updated plans to the Raleigh Regional Office within 90 days of receipt of this letter. You should be sure to address all items set forth in Part III A Stormwater Best Management Practices Plan of your General Stormwater Permit. Continue to implement your program as required by Part III, section A and B of General Stormwater Permit NCG020000. SITE DESCRIPTION Stormwater run-off generated at the site is discharged via one stormwater discharge outfall (SDO) located on the eastern side of the site. Stormwater is discharged to receiving waters known as Fishing Creek, this segment of which is classified as a water supply IV (WS-IV), nutrient sensitive water (NSW) in the Tar Pamlico river basin. INSPECTION SUMMARY 1. Outfall 001 was inspected and no problems were observed. There were no problems noted with the effluent. The right-of-way (ROW) to outfall 001 was sufficiently maintained to allow access to the outfall. 2. There was no best management practices plan (BMPP) or other documentation at the site. A BMPP that is site specific, and all related documentation, must be developed and implemented at the site. 3. Neither analytical nor qualitative monitoring has being accomplished yet. It is noted that the permit just became effective on 6 October 2006, so you do have a considerable amount of time before analytical monitoring is required. You mentioned during the inspection that this site would likely be closed soon and turned back over to the landowner.
