On 6/30/2009, the Division of Water Quality received your request to rescind you coverage under Certificate of'Coverage
Number NCG020672. In accordance with your request, Certificate of Coverage Number NCG020672 is rescinded
effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stop nwater to waters oftlle State
without valid coverage under an NPDIES permit will subject the responsible party to a civil penalty of up to $25,000 per
day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished
permit coverage vdien, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires
permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to
the State's surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public ser_vicc ifyou would inform the new or
prospective owners of their potential need for NPDES t;ermit coverage.

In accordance with your application for a discharge permit received on January 9, 2006
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This permit has specific limits on pH, settleable solids, total suspended solids, and
turbidity as shown in Part I11, Section C of your permit. Discharging mine dewatering or other
wastewaters from your facility that exceed the permit limits constitutes a violation of your
permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other Federal or Local governmental permit
that may be required.

plan or other document filed or required to be maintained under Article 21 or regulations of the Environmental

Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a fine

individual permit.

1. 1 agree to abide by the approved Mining Permit for this mining activity. (A copy of the valid
mining permit must be attached to this request.
2. 1 agree to not discharge any sanitary wastewater from this mining activity except under the
provisions of another NPDES permit specifically issued therefore.
3. 1 agree that bulk storage of petroleum products and other chemicals shall have adequate
protection so as to contain all spills on the site.
4. 1 agree that solid wastes will be disposed of in accordance with N.C. statutes and rules
governing solid waste disposal.
5. 1 agree that maintenance activities for vehicles and heavy equipment will be performed so as to
not result in contamination of the surface or ground waters.
I agree to abide by the provisions as listed above and recognize that the provisions are to be considered as
enforceable requirements of the General Permit

Staff from the Division of Water Quality, Surface Water Protection of the Raleigh
Regional Office conducted site visits at the following Barnhill sites on June 22, 2009.
Your assistance and cooperation of Mr. Brown was very helpful and appreciated.
1. NCG020406-Barnhill Contracting Company -Highway 97 Mine.
This mine was not active at the time of the inspection and had ceased to discharge.
Due to the current workload this mine has been inactive for two years. Barnhill has
chosen to keep the permit active for the Highway 97 Mine. Continue to implement
your Stormwater Best Management Practices Plan and conduct Analytical and
Qualitative monitoring as required by Part III Section A and B of your General
Permit.
2. NCG0020717-Logsboro Pit
This mine was not active during the time of the inspection. The mine had ceased to
discharge. The Logsboro Pit had not been active for one year. Due to the current
workload, this pit will not operate. Barnhill has chosen to keep the permit active for
the Logsboro Pit. Continue to implement your Stormwater Best Management
Practices Plan and conduct Analytical and Qualitative monitoring as required by Part
III Section A and B of your General Permit,

This mine has completely been mined out. There is no discharge outlet. This mine

On I March 2007, Ronald Boone, of the Division of Water Quality's (DWQ) Raleigh Regional Office
(RRO), conducted a stormwater Compliance Evaluation Inspection (CEI) of your Anderson pit. Your
assistance and cooperation was helpful and appreciated. Inspection reports are attached for your records.
Inspection findings are listed below. Please use the permit references listed throughout this report for
further details as needed.
SITE DESCRIPTION
Stormwater run-off generated at the site is discharged via one stormwater discharge outfall (SDO)
located on the eastern side of the site. Stormwater is discharged to receiving waters known as Fishing
Creek, this segment of which is classified as a water supply IV (WS-IV), nutrient sensitive water (NSW)
in the Tar Pamlico river basin.
INSPECTION SUMMARY
1. Outfall 001 was inspected and no problems were observed. There were no problems noted with the
effluent. The right-of-way (ROW) to outfall 001 was sufficiently maintained to allow access to the
outfall.
2. There was no best management practices plan (BMPP) or other documentation at the site. A BMPP
that is site specific, and all related documentation, must be developed and implemented at the site.
3. Neither analytical nor qualitative monitoring has being accomplished yet. It is noted that the permit
just became effective on 6 October 2006, so you do have a considerable amount of time before
analytical monitoring is required.
You mentioned during the inspection that this site would likely be closed soon and turned back over to
the landowner. You also indicated that this is how the majority of your sites are operated, i.e. they're

only active for a limited amount of time and then closed down and turned back over to the landowner
(often less than one year). Despite this relatively short period of operation, you will still have to apply
for and comply with a permit at each site. It is suggested that while you do need to have a BMPP that is
site specific, it is possible to use the same one at each site and simply include those components that are
site specific for each site.
Additionally, there are other pits that Barnhill has that are currently inactive but have active permits.
You stated during the inspection that one of these pits, the Jenkins pit (NCG020501), would be reopened
soon for a short period of time. Please Iet Mr. Boone know when this site reopens so he can schedule an
inspection of the facility. Also, if there are any sites with active permits that will not be reopened, or
have been turned back over to the landowner, please contact Stormwater Permitting Unit by letter at the
below address to request that the permit be rescinded.

Inspection Summary:
This site has only been permitted since 10/06/06. The permittee notified me during the inspection that the site will likely be
closed soon and the land turned back to the owner. Permittee indicated that most of their sites are only open for a short
period of time (i.e. less than a year). Permittee told they'll have to develop a BMPP that is unique to each site that they
have permitted.
For this inspection, there is no BMPP and no monitoring, qualitative or analytical, has yet been done. Site, outfall and
sedimentation pond with gravel filter and weir mechanism looked good except for oil spill at the dewatering pump.
Permittee informed of requirements for stopping, cleaning and reporting. Permittee stated that oil is only peanut oil and is
environmentally friendly. Permittee then informed that oil still has pollutant capacity and must be cleaned up appropriately
and future spills stopped, cleaned up and reported ASAP.

Hello Ron,
Here's the e-mail that I sent to Ken back in February. I'm sending it
to your attention now since I recently received RRO's list of county
assignments, and I see that you have Edgecombe. What I'm looking for is
whether or not there are any special. circumstances I.need to look at for
the facility. Such as whether or,not any mine dewatering has the
potential to affect adjacent wetlands, or if they have a history of
violations that the region has been called out on over the years.
I'll still need to run the application bay Public Water Supply since I
see that they drain to Fishing Creek where it has a WS-IV, NSW
classification.
I'm sorry if you've sent something about this in the past and I've just
misplaced it.
