This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. This permit has specific limits on pH, settleable solids, total suspended solids, and turbidity as shown in Part I1I, Section C of your permit. Discharging mine dewatering or other wastewaters from your facility that exceed the permit limits constitutes a violation of your permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Director Division of Water Quality On January 27, 2005, Mr. Garcy Ward with the Division of Water Quality inspected your sand mine off Hwy. 258 just north of Murfreesboro. Mr. Ward observed that your mine was dewatering through a silt basin into an adjacent swamp off the Meherrin River. This discharge of wastewater requires a NPDES perm! (NCGS or G.S.) 143-215.1(a)(1). The initial twenty (20) acres had the top seven feet of material removed for a NCDOT project, of this 20 acres 7.5 acres has been mined an additional six feet and is presently a pond with six feet of water. There is currently about 2.5 acres of stockpiled material on the remaining 12.5 acres. The remaining area will have the topsoil stripped, stockpiled and seeded. Material will be removed as needed for construction projects. The final excavated area will be reclaimed as a pond with the slopes top dressed and seeded. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to prevent offsite sedimentation (include specific plansfor sediment and erosion control for mine excavation(s), waste piles, access/aline roads and process areas), and give a detailed sequence of installation and schedule for maintenance of the measures. Locate and label all sediment and erosion control measures on the mine nnap(s) and provide typical cross-sections/construction details of each measure. Engineering designs and calculations are required to justify the adequacy of any proposed measures. A type `A' silt basin has been installed for allowing water to leave the site once the water level has been achieved for the final pond. All side slopes will be graded no steeper than two to one and then seeded. All topsoil stockpiled will be braded and seeded with silt fence installed as needed to prevent erosion. A buffer will be required between any mining activity and any mining permit boundary or right-of- way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion & sedimentation control pleasures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located within the alining pennit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider bu ffer may be needed depending on site conditions. Show all buffer locallons and w dlhs on the mine t t ICI f) (s). A fifty (50) foot buffer zone is being maintained within the permitted boundary. b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining pennit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet may be needed. See the mine maps. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including specifications for benching and sloping. Cross -sections for all cut slopes ranust be provided on the mine rnap(s). All cut slopes will be graded to a two (2) to one (1) slope below water and a three (3) to one (1) slope or flatter above the water level. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections of the mine excavation clearly !toting the angles of the cut slopes, widths of all safety benches and mine benches, and the expected maximum depth of the excavation. NIA 7. Describe other methods to betaken during mining to prevent physical hazard to any neighboring dwelling house, public road, public, commercial or industrial building from any mine excavation. Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. A dirt berm is located between the roadway and the mine execavation. 8.
