Your facility was covered for stormwater discharge under NPDES Permit NCG020655, however, this
permit expired on 12/31/2009. To assure consideration for continuing coverage under your permit, you
must apply to the Division of Water Quality (DWQ) for renewal of your permit. Enclosed you will find a
permit Renewal Application Form, Supplemental Information request, and a Stormwater Pollution
Prevention Plan Certification for your facility. Filing the application form along with the requested
supplemental information will constitute your application for renewal of this permit. .
"rhe application and supplemental information must be completed and returned to DWQ by May
15, 2012. Failure to request renewal within this time period will result in the inactivation of your expired
permit in our system. Discharge of stormwater without coverage under a valid stormwater NPDES permit
constitutes a violation of N.C. General Statute 143-215.1 and may result in the assessment of civil
penalties of up to $25,000 per day.

Dear Mr. Horne,
I conducted an inspection of the two mine pits, Meares and Haynes, on June 14, 2011. This inspection was
conducted to verify that the facility is operating in compliance with the conditions and limitations specified in
NPDES Permit No. NCG020000. The findings and comments noted during this inspection are provided in the
enclosed copy of the inspection report entitled "Water Compliance inspection Report".
Please respond in writing to this office within 30 days upon your receipt of this letter regarding your plans or
measures to be taken to address the following issues: When you will have a written Stormwater Pollution
Prevention Plan for each pit. Please ensure in the future that you are complying with the monitoring
requirements specified in NCG020000 permit. This office will forward a copy of your certificate of coverage for
the Haynes Pit (NCG020756) once we have secured a copy for our records from the Central Office.

Inspection Summary:
The inspector spent a considerable amount of time providing technical assistance to the site manager (Chuck Stanley)
concerning all the requirements specified in the NPDES General Stormwater Permit NCG020000. This site has never
had an inspection, therefore it was deemed appropriate to provide education to the permittee and forgo any assessments
related to deficiencies in complying with the NPDES Permit at this time. Future violations will be addressed in a
consistent manner.

Comment: Technical assistance was provided whereby each requirement of the
Stormwater Pollution Prevention Plan was discussed with the permittee. The SP3
became a requirement in the permit effective as of January 4, 2010, Please contact this
office in writing to acknowledge this requirement and provide a date upon which the
SP3 will be completed.

Comment: This pit has not been active and no discharges have been occuring. The
pit has a settling basin that discharges to a wetland adjacent to Gapway Swamp, a class
C-Sw water of the State in the Lumber River Basin. There was no discharge at the time
of the inspection. Please ensure that the semi annual qualitative monitoring is
conducted if/when the mine pit becomes active again and the need to discharge
wastewater arises.

Comment: The heavy equipment on site is fueled on site, the oil changes occur at the
Frank Horne construction office located in Fair Bluff. You should maintain records of all
oil changes and quantity of oil used on a monthly basis. Please ensure that the
quarterly analytical monitoring occurs should any discharge of wastewater be needed.
The site is graded such that all stormwater flows internal to the pit.

Comment: This pit is active. The permittee is currently dewatering the new excavation
area in an existing pond (old excavation area). The pond is roughly 3.5 to 4 acres in
size and had approximately a little over 2 feet of freeboard. Dewatering to this pond
may eliminate any discharges from the receiving pond. The edge of the pond is lowest
at the southwest corner. The permittee was instructed, should the pond level rise
enough to discharge to the adjacent ditch, qualitative monitoring of that discharge will
be required.

Comment: There has been no record of analytical monitoring. The permittee was
instructed should the pond to which they intend to dewater to should discharge,
analytical monitoring will be required. Any discharge within any given quarter will be
considered a valid sampling event. The permittee was instructed on the parameters
that are required. Enclosed is a copy of all certified laboratories in the State. The
permittee was instructed to utilize a certified laboratory for analyses. Vehicles are
fueled using fuel trucks and oil change/maintenance activities are conducted at the
garage owned by Frank Horne in Fair Bluff.

In accordance -with your application for a discharge permit received on May 10, 2005, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to. the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your Notice of Intent (NOI), you specified that only mine dewatering
would be discharged from this facility. If point -source discharges of stormwater occur, you
will be required to adhere to the conditions in this permit for those discharges.
In addition, please ensure your site does not have the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found
in Section C, Part 1 of your permit (Part III Page 5 of 9). If your activities will have potential
to impact nearby wetlands, you must have an approved Operation and Maintenance Plan
before mine dewatering discharges occur at your facility. Discharging mine dewatering
wastewater without Plan approval will be subject to enforcement action. An Operation and
Maintenance Plan for your facility must be submitted to the Wilmington Regional Office within
60 days of your receipt of this permit, if this requirement applies to your site. Contact Ed Beck
at the Wilmington Regional Office at (910)395-3900 for more information about the approval
process if applicable.

under the S/W General Permit for Mining (COC #NCG020655) for mine
dewatering activities at Meares Pit in Columbus County.
The borrow and sand pit is located about 2.5 mi southeast of Fair Bluff on
NC904 before SR1356, and the operation will discharge mine dewatering
water into a stilling basin. Stormwater discharge is to Gapway Swamp

Does the Wilmington Regional Office have any concerns about issuing this

The application for a mining permit for the above referenced mine site has been f0t.lnd
to meet the requirements of G.S. 74-61 of The Mining Act of 1971, As we have received the r
required security to cover this application, I am enclosing the mining permit.
The conditions of Mining Permit No. 24-21 were based primarily upon information
supplied in the application with conditions added as necessary to insure compliance with The
Mining Act of 1971. This permit expires on July 42,2014. G.S. 74-65 states that the issuance
of a mining permit does not supersede or otherwise affect or prevent the enforcement of any
zoning regulation or ordinance duly adopted by an incorporated city or county or by any
agency or department of the State of North Carolina.
As a reminder, your permitted acreage at this site is 7.73 acres and the amount of land
you are approved to disturb is 6.82 acres.
