Stevens Division of Water Quality February 22, 2001 Wake County DWQ Project #: 010237 APPROVAL OF 401 Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules Beazer Homes Corp 3701 National Drive Raleigh, NC 27612 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to impact 0.55 acres of wetlands (0.21 acres temporary fill) and, 176 linear feet of streams (40 feet temporary fill) to construct a sewer road crossing and lot fill at Mitchell Mill subdivision at SR 2224 and SR 2049, as you described in your application dated February 15, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3288, 3287, and 3289. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 39 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when-the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. (Latitude/Longitude: 35°52'49" N 78°30'52"W) S&EC Project #: 98-4133 Dear Mr. Dorney and Ms. Jones: On behalf of Beazer Homes Corporation (property owner), we hereby request authorization from the US Army Corps of Engineers (USACE) to use Nationwide Permits 12, 14, & 39 for the subject project to cover temporary and permanent impacts to stream channels and wetlands. We also request written concurrence from the NC Division of Water Quality (NC-DWQ) that the project complies with the 401 Water Quality Certifications (WQC) associated with Nationwide Permits 12, 14, & 39 and Neuse River Buffer (NRB) Rules. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. S&EC delineated the wetlands and jurisdictional waters present on the subject site, which were verified by Mr. Todd Tugwell of the USACE on August 9, 1999 (Action ID #199921173). Mr. Steve Mitchell of the NC DWQ confirmed the stream channels present on the site that are subject to the NRB Rules on December 8, 1998 (letter attached). It is important to note that the proposed project is located within the headwaters portion of an unnamed tributary to the Neuse River. Please refer to the attached map (Figure 1) for the project's location on a USGS topographic quadrangle. The property comprises approximately 118 acres, f5 acres of which are jurisdictional wetlands. Construction of roads to serve the proposed subdivision will impact two unnamed tributaries to the Neuse River and their associated jurisdictional wetlands and riparian buffers. Installation of sanitary sewer service for the project will impact two jurisdictional areas. An area of jurisdictional wetlands that protrudes into two of the lots will be filled to provide adequate area for constructing the houses. The tables below summarize both the temporary and permanent impacts to wetlands, stream channels, and riparian buffers associated with the project. The applicant requested a delineation of wetlands present on the property prior to site plan development in order to avoid jurisdictional wetlands to the February 15, 2001 S&EC Project #: 98-4133 Page 3 of 4 maximum extent practicable. However, stream channels and/or the beaver impoundment separate areas of the project that require adequate access to accommodate the number of anticipated residents. Both road crossings were designed to cross the stream channel and beaver impoundment and their associated riparian buffer at a perpendicular angle to minimize the impacts associated with the crossing. As required by the Neuse River Buffer Rules, vegetative buffers will be preserved around the stream channels and beaver impoundment present on the site. Please refer to the letter provided by Mr. Dan Burud of Priest, Craven & Associates for information regarding the project's compliance with Federal Emergency Management Agency construction guidelines. Due to the avoidance and mitigation measures described above, S&EC does not believe mitigation should be required by the USACE. NC-DWQ's current policy does not require mitigation for wetland and stream channel impacts below 1 acre and 150 linear feet. Because the proposed permanent impacts resulting from the project do not exceed the aforementioned thresholds (0.34 acre/136 linear feet), S&EC believes that wetland or stream channel mitigation should not be required. It is important to note that the road crossing of the beaver impoundment will impact jurisdictional wetland, and that this crossing does not involve any stream channel. As noted above, two of the proposed roads cross features subject to the NRB Rules. These roads were designed to cross the stream channel/beaver impoundment and corresponding riparian buffer at a perpendicular angle to mirnimize impacts. Both road crossings impact less than 150 linear feet of stream channel/beaver impoundment and less than 1/3 acre of riparian buffer at each road crossing. Current NC-DWQ policy allows road crossings without mitigation if the impacts are less than or equal to 150 linear feet of stream channel or 1/3 of an acre of riparian buffer per tributary. Because the project impacts are within these thresholds, S&EC believes that riparian buffer mitigation should not be required. One of the sanitary sewer lines will also cross a buffered channel using 40-foot-wide construction corridor. This perpendicular crossing is an exempt activity under the NRB Rules. Please refer to the letter prepared by Mr. Dan Burud of Priest, Craven & Associates and attached to the PCN, which explains the necessity for the sanitary sewer crossing. C. 27609 Subject: Neuse River Basin Riparian Buffer Rules ICD NBRRO 99-003 i Forestville Road Wake County Mr. Zarzecki: On December 8, 1998, I met with you at the subject property to conduct a site visit for the above referenced project. This project is referenced by the Raleigh Regional Office as NBRRO-99-003. As a result of that site visit, it was determined that there is a small beaver impoundment and several features present on the property subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The waters' edge at the beaver pond is shown as buffered on the attached map (highlighted in pink). The buffer protection for four of the features that begin at or near the property line are depicted by flagging. Flag 100 on the southern edge, Flag 203 toward the west, northward at Flag 509, and to the east at Flag 328 represent the beginning of the buffered zone. Two additional features are subject to protection and are delineated on the map at Flag 402 and.a line between Flags 601a and.601b. These features and flags are represented on the map received by this Office on December 8, 1998. (Map Number 37183CO 190 E). There is going to be a road crossing and some lot filling due to the design of a residential subdivision. Priest Craven and Associates, Inc. is doing a flood study and design of a culvert. Once this is finished, it will be submitted to the City of Raleigh for there approval. Upon their approval, they will forward it to the appropriate governmental agencies. There was also some concern about a sanitary sewer impact.
