Do we have any problems with this site? Do you want to see the NOI application? Ken Went to the site yesterday with Land Quality. There is a swamp nearby but their dewatering should not cause any problems due to the fact that it is a flooded hardwood. Therefor the pumping should keep the wetland static. I have no issues at this time. If their are problems in the future we will require them to get a pump and monitoring plan! Go ahead and issue the permit. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion & sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located Within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site conditions. Show all buffer locations and widths on the mine map(s). 100' setback from permit boundary and 50' from wetlands, as shown on mine map. For the purpose of determining buffer limits, the woods line has been considered to be the wetland limits because all of the cleared land has been prior converted.
