We received your package concerning the renewal modification of NCG020642 and the associated mining permit (#70-
25). The NPDES permit for this mine site does not expire until 12/31/2014. We will be sending out notifications about
the renewal process for the NCG020000 permits in the near future. For general permit renewals, we have started using
an online renewal process. Please have your client watch for later correspondence about this renewal process. This
does not change any of your responsibilities with regard to renewal/modification associated with your mining permit —
70-25. Please continue to work with the Mining Staff in DEMLR in this process.
I will forward the submitted Operation and Maintenance Plan to staff in our DEMLR regional office in Washington for
their review and files.
We have made the changes you requested in the Owner Name and Facility name. Since the permit will be up for
renewal later in the year we will not reissue a new certificate of coverage for the facility, but this will be reflected in the
updated renewal your client will receive later in the year.

This permit application is fora renewal and modification of existing mining permit. #70-
25, and renewal of dewatering permit #NCG020642, a 13.5-acre sand mine excavation
constructed by Stevenson Sand, Inc. and operated by Thomas F. Stevenson, Jr., on property
they lease from Mr. and Mrs. David L. Sanders at 630 Luciford Road, I liiabeth City, NC 27909,
in Pasquotank County, first permitted in 2004. The permit area is located on St high, sandy
65.32-acre parcel and, upon establishment of proposed erosion & sediment control measures,
will not present any problems regarding runoff to adjacent areas. The purpose of the
excavation is to serve as a source of sand for resale, and to establish a pond for recreational
use by the landowner.
In regards to the existing mining permit Mr. Stevenson is requesting a renewal of the
permit and a modification to the permit which will expand the excavation area. Revised mining
and reclamation maps are included with this modification request. In addition, Stevenson
Sand, Inc. is requesting a corporate name change on the permit to Stevenson Sand, ]tic. and a
name change of the mine from 'I:E. Stevenson Mine to Stevenson Sand Mine # 1.
Stevenson Sand, Inc. has established a 300ft undisturbed buffer between the mitung area
and the Peartree 1Jast subdivision inside the northwest boundary of the permit area, and a
200ft undisturbed buffer between the mining area and Ludford Road inside the northeast:
boundary of the permit area. 50ft undisturbed buffers are established around the rest of the
mining area per Pasquotank Countti' requirements.
Modification of this permit involves expansion of the excavation area from 13.5 acres to
39.55 acres and the affected area to 42.88 acres. The excavation will be performed in phases
and will utilize an existing 0.54-acre sediment pond for dewatering the excavation. All work
will be performed inside the existing permitted acreage of 65.32 acres.
Stevenson Sand will dewater the excavation down approximately 20 feet below natural
ground level, into the sediment basin. Clear overflow water is allowed to flow through a
stabilized ditch 750 feet from the sediment basin to Newbegun Creek wetlands, 0.3 miles to
Newbegun Creek and then 7.75 miles to the Pasquotank River. Quarterly samples will be
taken from the riprap outfall of the sediment pond, and will be analyzed for quantities of
sediment at a State certified laboratory and documented as required by NCDE.NlZ.
At the time of final reclamation of the excavation area, Mr. Stevenson plans to remove all
berms and sediment pond with overflows. All areas surrounding the remaining pond will be
graded, leveled and seeded .with groundcover, then allowed to be returned to a natural state as
pasture and field. A low 1 ft tall berm will be cstabhshed around the 39.55 excavation for
erosion control. A 39.55 acre pond will remain with an average depth of 25 feet and a
maximum depth of 30 feet..
All new excavation areas will have proper sediment and erosion controls installed, and all
new pert -nit boundaries will be properly marked. The excavation area is located geographically
450 feet from the nearest dwelling (Peartree E?ast subdivision) and 225 feet from the nearest

public highway in a lightly populated area, and is accessible only by a private, gated access road.
An existing hedgerow serves as a visual screen between the mining area and 11cartrec F',ast
Subdivision.
All adjacent landowners are being contacted by Pasquotank County Planning and
Inspections to be made aware of this nulling operation and modification of the permit and
new land entry agreements have been obtained. The tvinc, area has been well marked with
warning and keep out signs to prevent inadvertent public access.
Stevenson Sand, Inc. does hereby request approval for this permit modification, and asks
that it be expedited as soon as possible. Mr. Stevenson appreciates your consideration of this
permit application and looks forward working with NCDI NR in coming years.

The following discharges are covered by NPDES general permit NCG520000 instead of NCG020000:
• Point source discharges of stormwater and wastewater from in -stream sand mining operations (i.e., sand
dredging or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For existin mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction modification or installation of an new treatment components at an existinq site requires
an ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle process wastewater (even if commingled
with stormwater) at mining sites will require an ATC prior to construction per 15A NCAC 2H .0138.
Please see the NCG020000 General Permit for details about which treatment facilities require an
ATC (summarized in Table 1 at the end of this form). For example, an ATC is required for treatment
of mine dewatering discharge from clay pits and non -closed -loop wastewater recycle systems. The
authorization to construct or continue to operate will be issued at the same time as the Certificate of
Coverage (COC) for the NCG02 permit. Design of treatment facilities must comply with requirements
of 15A NCAC 2H .0138 & .0139.

This plan defines responsibilities for operating, inspecting, and maintaining equipment and structures
used for constructing and dewatering the Stevenson Sand Mine #1 safely, and that dewatering will not
degrade or negatively impact any wetlands or waters of the state. Stevenson Sand, Inc. is applying to
the Division of Water Quality to renew his current dewatering permit #NCG020642.
Description and Operation of the Stevenson Sand Mine #1:
The Stevenson Sand Mine #1 is a proposed 39.55-acre sand mine excavation operated by Thomas E.
Stevenson, Jr., Stevenson Sand, Inc., in a 65.32 acre permit area located near the intersection of Pitts
Chapel Road and Ludford Road, at 630 Ludford Road, Elizabeth City, NC. The permit area is on high
sandy farmland owned by Brenda S. and David L. Sanders. At this time Mr. Stevenson is submitting an
application with the NCDENR Division of Energy, mineral and Land Resources to renew and modify his
current Land Quality permit #70-25 to operate the sand mine which was first permitted in 2004. Mr.
Stevenson is also applying to the Pasquotank County Planning and Inspections Department to renew the
Special Use Permit issued in 2004 to operate the sand mine.
Sand Mine Dewatering:
The operator is utilizing a 0.54 acre sedimentation pond located 30 feet from the east corner of the
main excavation. The 10 foot deep pond has been excavated and constructed with 3-ft tall by 12-ft wide
sand berms surrounding it which have full groundcover installed. Dewatering the main pond allows for
full depth excavation and proper reclamation of the edges of the pond. It is the intention of Mr.
Stevenson to only dewater the excavation as needed, which will not entail full-time dewatering.
The operator has installed an 8-inch dewatering pump between the 2 ponds at the east corner of the
main excavation. Discharge from the dewatering pump enters the sediment pond on its west side, and
there will be a constructed water height control device (see attached diagram) discharge point located
on the east side of the sediment pond. The discharge point releases clear water to a 25 foot long
constructed riprap-protected ditch, leading to an existing farm irrigation ditch and then 0.44 miles to
Newbegun Creek and 7.75 miles to the Pasquotank River (see attached map for outflow route and
discharge point locations).
Water is pumped from the main pond to the sediment pond by an 8in gasoline -powered transfer pump
operating at idle speed. Estimated maximum flow from the pump is 2,000 gallons/min. and generally
operates 4 hours per day pumping approximately 480,000 gallons per day as needed. It is the intention
of Mr. Stevenson to drop the water level in the main pond approximately 20 feet below natural ground
level when needed.
The overflow from the sediment pond is controlled by a rock baffle/weir constructed in the east
sediment pond berm, 2 feet below the top lip of the berm, and consists of NC DOT Class B stone lined
with NC DOT #5 or #57 stone on upper side (see attached diagram). This control structure allows water
to flow through the baffle into an existing 6ft wide field ditch located at the east berm of the sediment
pond. For erosion control, the overflow water exits the rock baffle onto a 20ft long riprap-lined apron in
the ditch (see diagram).
Time and distance allows all sedimentation to occur to acceptable levels before the overflow water
reaches outfall and then the waters of the State. Water will have to travel a minimum of 120 feet to
reach the overflow point which will give enough surface area to allow sufficient sedimentation to occur.
There will be a minimum aft tall berm around the perimeter of the sediment pond to prevent offsite
stormwater from entering the sediment area and damaging sedimentation rates.
Sedimentation and Erosion Control
Sediment pond overflow will drain into a constructed 25ft x 6ft wide feeder ditch that leads 2000 feet
through a field drainage ditch to Newbegun Creek and then 7.75 miles to Pasquotank River. Overflow
into the feeder ditch is stabilized by riprap installed in the feeder ditch at the overflow (see diagram) to
prevent erosion of the ditch.
All erosion and sedimentation remains inside of the permit area. During mining operations and
dewatering, the majority of the water leaving the excavation will remain inside of the permit area and
will only overflow occasionally. The sediment pond is approximately 10 feet deep, and there is a sand
layer below the bottom of the area. The porosity of the soil under the sediment pond will allow some of
the water pumped into the pond from dewatering to seep back into the ground naturally. Any excess
water overflowing from the sediment pond flows downstream through existing irrigation and drainage
ditches 2000 feet towards Newbegun Creek, and then 7.75 miles to the Pasquotank River.
Access road has been constructed adjacent to existing drainage ditches. Existing ditches adjacent to the
access road drain into the sediment pond basin. All runoff from stockpile areas is routed directly to the
sediment basin or drains into the mine excavation.
Maintaining the Sediment Pond Overflow Control Structure, Settlement Pond and Ditches
Inspections and maintenance are required to obtain the intended function of safely dewatering the sand
mine, and to maintain the life of any adjacent wetlands or waters of the State. Items to inspect and
maintain during the 5 year life of the mine dewatering permit are:
• Inspect the water control structures regularly, especially following heavy rains and runoff, or
during periods of operation of the structure.
• Remove accumulated debris from the concrete block overflow control structure.
• Inspect the structure for excessive settlement or seepage.
• Inspect all components of the structure, including appurtenances, and repair or replace any
damaged items as needed.
• Inspect embankments, berms and appurtenant structures, and repair as needed.
• Repair any damage to vegetated areas or berms with compacted earth fill, reshaping, sodding,
reseeding and mulching as needed.
• Inspect riprap outlet stabilization structures in ditches regularly, replace dislodged rock as
necessary.
• Promptly repair all leaks in delivery facilities by replacing valves, fittings, gaskets, and worn or
damaged parts.
• Maintain all screens, filters, valves, timers and other electrical and mechanical equipment in
good operating condition, following manufacturer's recommendations
Monitoring the Process and Effects of Dewatering
Analytical and qualitative monitoring of mine dewatering wastewater will be in accordance with the
NCG020642 permit, as follows:
• All ponds in the Stevenson Sand Mine #1 permit area will be inspected daily by the operator to
identify any abnormal conditions.
• All berms and erosion control and sedimentation control structures will be inspected following
significant (1/2-inch) rainfall events for damages, and all structures will be repaired immediately.
• Special inspections will be conducted immediately following severe storms, vandalism, and
other significant events.
• Dewatering process will be inspected daily during periods of dewatering the excavation.
• Overflow of wastewater process will be inspected daily during periods of dewatering the
excavation.
• Outflow of dewatering wastewater will be monitored quarterly at the overflow exit stabilization
structure for pH, settleable solids, turbidity, and total flow. Samples will be collected and tested
onsite for pH, and the remainder will be tested for the remaining parameters by a North
Carolina certified lab.
• Rain gauge data will be collected by monitoring rain gauge data monthly and after each rain
event.
Records
Data will be collected as follows:
• Data will be collected from samples taken from the wastewater point source discharge in
operation at the time.
• Point source discharge data: data from the site taken quarterly, date & time, general weather
conditions, pH of sample, status of process at point source, inlet or outlet, other DWQ required
data.
• Visual monitoring of adjacent farmland for potential dehydration during mining or dewatering
activities will take place weekly. Solutions to any degradation caused by any mining activity will
include alteration of dewatering process. DWQ will be consulted as needed; alterations to
process will be recorded.
• Elliott Consulting will maintain the following records in a permanent file at the Elliott Consulting
office at PO Box 112, 202 Elliott Road, Aydlett, NC 27916: a record of all significant actions
taken; as -built drawings; permits; analytical results from sampling; and related material. Copies
of all inspections, monitoring reports and lab analyses shall be provided to NCDWQon a regular
basis and as requested.
BMP Conditions
• The permittee will utilize best management practices to ensure that dewatering the Stevenson
Sand Mine #1 will not degrade or negatively impact any wetlands or waters of the State.
• The permittee shall obtain authorization from the Director of the NCDWQ prior to utilizing any
chemical flocculants at Stevenson Sand Mine #1.

standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission and the Federal Water Pollution Control Act, as amended, this permit is
hereby issued to all owners or operators, hereafter_permittees, which are covered by this permit as
evidenced by receipt of a Certificate of Coverage by the Environmental Management Commission to
allow the discharge of stormwater, mine dewateriitg wastewater, and process wastewater to
the surface waters of North Carolina or to a separate storm sewer system conveying discharges
to surface waters, from active and Inactive mining sites_, in accordance with the terms and
conditions set forth herein.
Coverage under this General Permit is applicable to:
♦ Stormwater point source discharges associated with mining and quarrying of non-
metallic minerals (except fuels), mine excavation, processing, and vehicle maintenance;
♦ Mine dewatering wastewater discharges;
♦ Wastewater discharges from sand and/or gravel operations;
♦ Operation of non -discharging closed -loop recycle systems (and infrequent overflows);
♦ Process wastewater discharges from non -closed -loop recycle systems.
The following activities and associated discharges are excluded from coverage under this permit:
♦ Borrow Pits covered by the DOT statewide stormwater permit,
♦ Peat Mining,
♦ Coal Mining,
♦ Metal Mining,
♦ Oil and Gas Extraction Operations, and
♦ Combined Mining/Asphalt Operations (where asphalt operation is not covered by a separate
permit).
The General Permit shall become effective on January 1, 2010.
The General Permit shall expire at midnight on December 31, 2014.

Our records indicate that you have been issued a Stormwater General Permit and a Certificate of
Coverage for your facility. These permits have specific conditions that must be met in order for you to
be in compliance with your permit. It is your responsibility, as the permit holder, to read and. comply
with the conditions contained in the permit.
It is our responsibility, as the issuing authority, to make sure that the operation and maintenance of
your facility complies with the conditions contained in your permit. To assist you in complying with
these conditions, we are attaching a Technical Bulletin specific to your permit requirements. We are
currently in the process of developing our inspection schedule. 'Therefore, you should have all of
your records up to date as we may be contacting you in the near future to set up an inspection of your
facility.

In accordance with your application for a discharge permit received on June 2, 2004 we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NI'DES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Please also take notice that this general permit allows the discharge of stormwater and
certain types of wastewater from your facility. In your Notice of Intent, you specified that only
mine dewatering would be discharged from this facility. If point -source discharges of
stormwater occur, you will be required to adhere to the conditions in this permit for stormwater
discharges.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, 11, 111, IV, V, V1 and
VII of General Permit No. NCG020000 as attached.
This certificate of coverage shall become effective February 11, 2005.
This Certificate of Coverage shall remain in effect for the duration ofalte,General Permit.
