Enviromental Professionals, Inc. (EPI) is please to submit this report for water quality
monitoring for the Green Acres mine site located in Currituck County, North Carolina. Water
quality samples and water level measurements were obtained as required in the mine permit, for
three onsite monitoring wells. The attached may illustrates the locations of the monitoring wells
on the subject site.
EPI scientists visited the site on October 12, 2005 to collect groundwater samples from the three
onsite monitoring wells (MW-1 through MW-3). Water level measurements were taken prior to
connecting the wells to the surficial aquifer by purging the wells three well volumes. Samples
were collected utilizing dedicated bailers, placed in laboratory provided containers, and shipped
in ice to Environmental Chemists Laboratories (Envirochem) under chain -of -custody. The
groundwater samples were analyzed for fecal Coliform bacteria and pesticides.
The following tables represent the results for water quality monitoring; a copy of the laboratory
results is also attached:

In 2004 you were issued coverage under the Mining NPDES stormwater general permit. This permit was renewed in early
2005 by the Division of Water Quality (DWQ) and we are forwarding herewith the reissued stormwater general permit. Please
review the new permit to familiarize yourself with the changes in the reissued permit. The general permit authorizes
discharges of stormwater and some types of wastewater. You must meet the provisions of the permit for the types of
discharges present at your facility. This permit is reissued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection
Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

to receiving waters designated as UT to Currituck Sound, a class SC stream in the Pasquotank River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
11, III, IV, V, and VI of General Permit No. NCG020000 as attached.
This certificate of coverage shall become effective April 8, 2005.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

Dear Mr. Klimek:
This letter is to inform you of the problems associated with the operations of the
above referenced mine.
This mine has serious operational and design flaws, of which your department
has been made aware, but has yet to act in any manner which adequately
solves the problems to the extent of alleviating their negative impact on
adjacent properties. Specifically, when this mine breached its reservoir berm
and flooded surrounding properties last spring, your department's response was
to quickly secure a dewatering permit for the sole benefit of the mining
company. Adjacent property owners; who suffered as a result of the flood, were
not informed of this decision, and would have opposed such a permit. The
permit was approved so quickly that it was obvious that no downstream impact
study was done. I have been told by your department that, as long as the
applicant meets the criteria, a permit is issued without any downstream studies,
i.e. that it is assumed that there are no downstream problems. I have also been
told by Environmental Professionals, an expert in these matters, that you do, in
fact, consider the impact of downstream issues prior to approval to off site
dewatering. In any event, someone needs to connect the dots here and
determine if this mining discharge permit is in everyone's best interest and not
just the mining company's.

Our property is adjacent to the mining operation. We are located at 150 Black
Forest Lane, off of Forbes Rd. in Jarvisburg. We have approximately 1850 if of
property line that boarders this mine, to the north and east. Our property has
been flooded at least twice by the operations of this mine, of that we know; how
many other times is up for debate. Today was the second time. Approximately
2.5 to 3 full acres of high hardwood forest ground were flooded to anywhere
from ankle depth to knee deep. There was a current running through our forest.
The mining operation obviously knew about this; upon inspection of the source
of the breach, myself and a Currituck County Soil and Water expert, Mr. Mike
Doxey, observed where Green Acres had used bull dozing equipment to push
soil into my forest to act as a temporary berm to deflect the overflow. Heavy
tractor ruts attested to their freshness and obvious attempts to redirect the
thousands of gallons, if not millions of gallons of water, into the designated
ditches. Jeff Newbern, owner of the mine, never called to inform us of any
problems from any flooding. This is hardly acting in good faith.
This is a totally unacceptable use and abuse of our land. This company has no
right to flood my property to discharge their water. They have no right to disturb
my land nor trees to alleviate their flood problems without permission. We
request that your office put a stop to this and address the discharge problems
immediately to the mutual satisfaction of all parties involved.
Last April (2004) we were very concerned about the overfilled ditches on our
property which were running with a strong current containing milky white water.
This was particularly alarming because it was during a drought. All other
drainage ditches to the north and west this mine were completely bone dry, but
the ditches coming away from the mine were at capacity. We contacted
Currituck County Zoning as well as your Washington, NC office to notify them
that this mine was operating illegally by off site dewatering without a permit. We
sent several letters by certified mail (April 26, 2004 and May. 5, 2004) outlining our
concerns. We also spoke to several people in the office including Mr. Pat
McClain during this time.
While waiting for a response to the May 5, 2004 letter we found out, causally,
from a friend, that the mine had breached its berms and lost millions of gallons
of water which did in fact flow through my land and eventually flooded the
properties of several other homeowners, stranding some of them in their homes
for a day. One business lost his soft shell crab operation, and according to the
newspaper, this was not the first time. Furthermore, part of a newly paved road
(Jarvisburg Rd.) was washed out. I found out through the "grape vine" that the
State (perhaps your office?) shut down the mine temporarily. I was made aware
of this approximately 3 days after the event (May 9, 2004). This company never

informed us. The State never informed us, even though we were in direct
communication with Pat McClain at that time precisely inquiring about this mine
and water discharge problems. When we called the Division of Water Quality,
we spoke to Robert Tankard and were told that your office gave Green Acres
the discharge permit May 14, 2004, (interestingly his application was dated May
6, 2004, day of breech). All this with no input from the very people who are
impacted, and impacted negatively, by this mine. Unless we were reading the
paper in which this permit notice was run, we did not have the opportunity to
oppose this permit. We think this was absolutely irresponsible and
unconscionable for your office to grant this permit without doing an impact
study to find out where all this water was supposed to go and how it would go
there.
Our drainage ditches were hand dug approximately 150 years ago by the
farmers who lived here. This is a fact. These ditches are not streams. They are not
rivers. They are man made devices which were for the use of the local farmer.
Green Acres has no access to the sound to discharge except through the
ditches which run through my property. It is not my responsibility to maintain
these ditches for his use. There are several choke points along the main ditch -
way that is causing the problem for Green Acres discharge. These are severe
problems that are caused by Green Acres and will need to be rectified by .
Green Acres in order for them to operate legally. One problem is that his flow
pipe discharges way too much water for the ditches in their current form to
handle.
Secondly, Green Acres installed a 15" culvert pipe on our property about 8.years
ago which is a formidable choke point. From that point on, the ditch is so badly
maintained from decades of neglect and there are dozens of old trees and
debris clogging the flow. These ditches are only good for field drainage and
nothing more. Mr. Newbern really needs to obtain some sort of right-of-way to
his northern boundary and run a culvert to go under SR 1118 (Forbes Rd.) and
drain into the ditch along the Jarvisburg Church of Christ and from there into the
ditch along Jerry Wright's property which is big enough to handle the kind of
flow that he needs. Even if we were to allow him to maintain our ditches or install
bigger culverts through them, I am told by Jerry Wright (who is a large
landowner/farmer in the area, who's family was the previously owner of the
Green Aces land, and is quite knowledgeable about what the problems are
and how they should be addressed) that this is still not a solution because of all
the choke points east of my property. We need relief from this flood problem.
Soon we will have to take some sort of legal action if this problem persists. This
problem was not caused by us; it is a creation of Green Acres Land
Development.

Thanks to Robert Tankard we now understand a little more about the roles of the
different sections of the Department of Natural Resources. However, we are still
very concerned that no one is seeing the overall picture like the old adage, "the
left hand doesn't know what the right is doing." We really need someone to step
up to the plate here and recognize that there is a serious problem and the mine
owner isn't going to fix this problem out of the generosity of his heart. This
company needs to be inspected, directed, and made to adhere to rules, that,
hopefully, the State has on the books, to ensure everyone's rights are respected.
As a final concern, your office should be made aware of the ongoing threats
made to us by Jeff Newbern and the several' documented cases of vandalism
that we have had to endure whenever Jve contact authorities about this
company. We have great concerns,fo"r our safety and the safety of our children.
We have been shot at on our property from their property. We have continual
problem of trespassing and illegal hunting from people associated with that
property. We have had our trees vandalized and cut down:,Me have caught
Jeff Newbern's step -son illegally hunting and installing,a deer stand not 50ft from
my children's playground. We finally resorted to a seurity camera to keep an
eye on our property line to try to catch the people_ coming from the pit hunting
and. trespassing on our property only to have it blown to bits;by people in their
pit shooting it with dozens of rounds on September 3, 2004 (it lasted about 5
days). On Oct 14, 2004 a skinned, gutted deer complete with entrails and sac
cut opened was bagged up and allowed to rot before being dumped at the
foot of my driveway along with the bag they carried it in. On Oct 22, 2004
another illegal deer stand was discovered (identical to the first one) on my
property and the access was obviously' through their property. Just feet away,
on their property, was a 50 pound bag (now empty) of deer bait. Their land is
deforested, and they are all hunters. All of these instances can be verified
through the Currituck County Sheriff's department and now the Wildlife
Enforcement office is involved. Pictures are available. Of course, we cannot
prove who is doing these acts of vandalism. But there is a pattern of illegal
activity going on and my rights and my property rights are being constantly
trampled and invaded. We have a very real concern of retribution at our
property. Thus, if one day something really bad should happen as in one of us
gets shot or killed, the State of North Carolina will be held accountable for its
role in allowing this situation to exist. It is in everyone's best interest to hold this
company accountable for its actions and help to make peace in the
neighborhood.

Alan, you should be receiving or have received a letter from Ms. Stacy Justice
concerning the Green Acres Land Development mine in Jarvisburg, NC.
Ms Justice call me on October 27, 2004 with a complaint that Green Acres was flooding
her property by their mine dewatering activities. At that time I contacted Land
Quality and asked if they knew anything about the situation. They did not, but told
me that they had just issued their mining permit which allowed the mine to dewater
and discharge the wastewater off site. I then called Mr. Jeff Newbern, owner of the
mine, to find out the situation at the mine site. He was not there but his secretary
took my number and told me he would call me back that day. I then called Ms. Justice
to inform her of the facts as I knew them and told her that Mr. Newbern would be
calling me and would let her know what was determined. The day past and Mr. Newbern
had not returned my call. I then called on the 28th and left another message with
the secretary. She apologized that he had not returned my call and then gave me his
cell phone number! I called Mr. Newbern at this number and he explained the
situation to me. Mr. Newbern had shut his pumps off and had stopped the discharge.
Mr. Newbern stated that Currituck County had stopped them from dewatering because.
they did not have the proper permits from the County. Mr. Mike Doxey, Currituck
County Soil and Water Representative, met with Ms. Justice and then later met with
Mr. Newbern to discuss options of correcting the problems.. Ms. Justice was going to
allow Mr. Newbern to clean the woody debris out of her ditches to allow for better
flow of the water.
I then called Ms. Justice to tell her what I had found out about the situation. I
then told her that myself and Richard Peed (Land Quality) was going to try to visit
her site the following week and it would probably be Nov. 3. She then informed me
that she was going to write you a letter concerning her problems with the site! She
emailed me a copy that day.
Back during the summer, Green Acres Mine flooded the adjacent properties from a
breached dike wall which discharged some six million gallons at one time. Land
Quality responded and stopped them from dewatering. At that time Mr. Newbern was
dewatering his mine site and was trying to store this water in an elevated storage
pond with inadequate dike walls. Garcy ward, Pamlico Rapid Response, went to the
site the next day to evaluate the problems. Garcy did not go on the mine site.
Garcy then explained the situation to me and T planned a trip to the mine site. I
visited the site and found that the dike did breach and that most of the dike
material had settled out in the adjacent field. Most of the silt and sediment
remained in the mine site because a portion of the storage basin was below grade. 1
then looked downstream on the mine site property and did not see any impacts. I then
went further downstream adjacent to NCSR 1118. DOT had been regrading the roadside
ditches and this water had caused scouring in the ditches. Therefore there was some
sediment that went further downstream but we could not measure for it. After
visiting with Mr. Newbern, I informed him that he needed a NPDES permit to discharge
his mine dewatering activities and that this should prevent this from happening
again. He applied for the application and we received his NOT on May 6. The permit
was -issued on May 14.
Land Quality would not let him operate until he modified their mining permit to
dewater. They stated that a permit would not be issued unless the settling basin was
below grade to prevent another breached dike. At this point, I thought that the site
issues were resolved!
Richard Peed, Mike Doxey and myself met with Mr. and Mrs. Justice at their home on
November 4, 2004. We first discussed some of the issues that they had presented in
her letter dated September 27, 2004. I explained the General Permitting process to
her, that with a general permit, the Division did not give public notice when a

certificate of coverage was issued. She understood and then we proceeded to the area
that was flooded. The area that flooded was a good distance from her house. I would
approximate a thousand yards. The reason for the flooding is two fold. First, when
the Justices built their house they paid Mr. Newbern to put in approximately 200 feet
of 15" plastic tile in the ditch that drains the upstream property where the mine is
located on. This was approximately eight years ago and before the mine site was
planned! The ditch could have accommodated approximately a 24" to 36" culvert. The
15" the was now a choke point which backed up the water but did not spill over its
banks. Second, the area flooded where the ditch elbowed. With the ditch full of
water, the velocity now caused the water.to ride over the bank and flood the area at
this point!
I then explained to the Justices that the NPDES permit did not allow for downstream
impacts and we would try to correct this issue by incorporating procedures into Green
Acres Best Management Plan! We also told them to call us anytime that they were -
having impacts or concerns and we would try to address them. We then went downstream
where the ditch crosses NCSR 1118 to check the culvert size. The culvert was 36
inches and should not be a problem. At this point we went to the mine site to
discuss with Mr. Newbern.
Mr. Newbern met us at the mine site. He explained that Currituck County would not
let them discharge until he modified his county permit. He told us that he felt like
he would not be able to get one. He then told us that he was going to try to dewater
by pumping from one pit to the other. We explained to him that we had no problems
with this method. I also informed him that he was not allowed to impact downstream
property owners from his discharge. He understood and said he would comply. I told
him that the Division had no problem with him discharging as long as he met the
stream standards and would not cause any problems to his downstream neighbors. I
informed him that the 15" culvert was his choke point and that he needed to get with
his engineer to determine the volume that he could discharge without causing
problems! He agreed, but still said he was going to try to mine by dewatering from
one pit to the other. At this time we concluded our meeting.
Allan, I believe we have taken care of this problem, however who knows. There is
alot of animosity among the Justices and Mr. Newbern and therefore further issues may
arise. We will deal with them as they occur. If you should have any questions

mine being operated and also the mine was being dewatered with the water being discharged to
an unnamed tributary.
You are hereby notified that the operation of the mine and the disposal of this wastewater
requires a NPDES permit. North Carolina General Statutes (NCGS or G.S.) 143-215.1 requires,
among other things, that you apply for and receive a permit before you "Construct or operate any
sewer system, treatment works, or disposal system within the State". Disposal of this
wastewater from the subject facility without first obtaining a permit constitutes a violation of this
Statute.
You are advised that "a civil penalty, in accordance with the maximums established by N.C.G.S.
143-215.6(a)(2), may be assessed against a person who is required but fails to apply for or to
secure a permit required by G.S. 143-215.1, or who violates or fails to act in accordance with the
terms, conditions, or requirements of such permit." NCGS 143-215.6 further provides that "if
any action or failure to act is continuous, the Commission may assess a penalty for as long as the
violation continues."

I am in receipt of your letter dated April 26, 2004 concerning the referenced Mine site. I
apologize for not getting back to you earlier.
The following are specific operating conditions, in mining permit 27-17, relating to discharges
from this mine site:
Any waste water processing or mine dewatering shall be in accordance with the permitting
requirements and rules promulgated by the N.C. Environmental Management Commission.
No discharge of water from the mine site shall be allowed until a modification request has
been submitted to and approved by the Division of Land Resources (DLR) to allow such
activities.
Any mining activity affecting waters of the State, waters of the U.S. or wetlands shall be in
accordance with the requirements and regulations promulgated and enforced by the N.C.
Environmental Management Commission.
To date, this office has not received a permit modification request for the discharge of water
from the mine from the operator. Neither have we been notified by either Mr. Newbern or the
Environmental Management Commission that a discharge permit has been issued. I have forwarded
a copy your letter to the Division of Water Quality for their response to the questions (1, 2 & 4)
concerning the actual discharges as I cannot answer them beyond what is stated above.

Subject: NOTICE OF VIOLATION 1 NOTICE OF INTENT TO ENFORCE
Green Acres Land Development Mine, Permit No. 27-47

Dear Mr. Newbern:
On May 11, 2004, you had a discharge of wastewater from the settling/holding basin at the above
mine site. This wastewater discharged into an unnamed tributary to the Currituck Sound. Robert
Tankard with the Division of Water Quality, inspected the sand mine located on NC 158,
Jarvisburg on May 13, 2004. Mr. Tankard's inspection showed the wastewater had breached the
dike wall on the settling/holding basin and flowed into an adjacent farm field and then into the
unnamed tributary. There were no discharges at the time of the inspection.
You are hereby notified that the operation of the mine and the disposal of this wastewater
requires a NPDES permit. North Carolina General Statutes (NCGS or G.S.) 143-215.1 requires,
among other things, that you apply for and receive a permit before you "Construct or operate any
sewer system, treatment works, or disposal system within the State". Disposal of this
wastewater from the subject facility without first obtaining a permit constitutes a violation of this
Statute. Our records show that an application has been filed and Permit No. NCG020641 was
issued on May 14, 2004.
You are advised that "a civil penalty, in accordance with the maximums established by N.C.G.S.
143-215.6(a)(2), may be assessed against a person who is required but fails to apply for or to
secure a permit required by G.S. 143-215.1, or who violates or fails to act in accordance with the
terms, conditions, or requirements of such permit." NCGS 143-215.6 further provides that "if
any action or failure to act is continuous, the Commission may assess a penalty for as long as the
violation continues."
