NCG020629 April 1], 2012, the Division of Water Quality (DWQ) is forwarding herewith the reissued
Certificate of Coverage and stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of the stormwater General Permit
• A copy of a Technical Bulletin for the General Permit
• Copies of the Discharge Monitoring Report (DMR) Form
• Copies of the -Annual Discharge Monitoring Report Form (if applicable)
• Copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with
respect to stormwater discharge controls, management, monitoring, and record keeping. Please review
the new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the
General Permit are outlined in the attached Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by
DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Comment: This inspection was as a result of the recent mining permit renewal review of 07-49. The
operation was not operating during the inspection and no a ui ement or personel were on site.
The DWR comments dated 9/15/2014 have no concern regarding the renewal of the permits,
nor the continued operation. No O&M Plan is required per DWR.

Your facility was covered for stormwater discharge under NPDES Permit NCG020629, however, this
permit expired on 12/3t/2009. To assure consideration for continuing coverage under your permit, you
must apply to the Division of Water Quality (DWQ) for renewal of your permit. Enclosed you will find a
permit Renewal Application Form, Supplemental Information request, and a Stormwater Pollution
Prevention Plan Certification for your facility. Filing the application form along with the requested
supplemental information will constitute your application for renewal of this permit. .
The application and supplemental information must be completed and returned to DWQ by May
15, 2012. Failure to request renewal within this time period will result in the inactivation of your expired
permit in our system. Discharge of stormwater without coverage under a valid stormwater NPDES permit
constitutes a violation of N.C. General Statute 143-215.1 and may result in the assessment of civil
penalties of up to $25,000 per day.

issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

On March 26, 1997 I received a complaint from Mr. David
Gossett of Washington Park. Mr. Gossett's property is bordered on
the north by Maple Branch; he reported the condition of the branch
to be severely turbid. Mr. Gossett also reported this situation to
Mr. Pat McClain of the Land Quality Section. Mr. McClain & I
discussed the complaint and decided to jointly investigate it. Mr.
McClain informed me that there were two mines in the immediate area
which were actively mining and dewatering. We visited the Randy
Hodges pit first. Upon our visit we found a backhoe digging and
groundwater dewatering underway. The pump being used was very large
with a six inch outlet, the inlet end of the pump appeared to be
set too low and in the sediment of the pit. The settling basin
being used was a half circle with a radius of approximately eight
feet. The outlet of the settling basin was directly across from the
outlet pipe of the dewatering pump. The effluent stream from the
pump extended approximately two feet horizonally before falling
into the settling basin. This horizontal distance indicates a high
velocity which may have been reduced. A sample was taken of the
effluent from the settling basin for turbidity with the results
being 6,300 NTU.
Mr. McClain & I proceeded to the other pit in the area and
found that no dewatering was underway on that day. The groundwater
in the pit which at some point must be dewatered appeared to be of
a very high quality and would likely have no problem in meeting its
permit limits.
The surface water into which the discharge from the Randy
Hodges pit entered into, Maple Branch, was located and samples were
taken upstream of the influence of the discharge and at the
junction of the discharge stream and Maple Branch. The upstream
turbidity was 3.4 NTU and the turbidity at the junction was 2,220
NTU.

The analysis of the samples was not able to be performed in a
manner which will allow enforcement beyond an NOV. I was not able
to return to the office in time to get the samples in the courier
on the 26th. As you know, the Washington Lab is down at present and
with the Good Friday holiday and the 48 hr holding time the Raleigh
labortory could not be used. I therefore decided to ask the City of
Washington Laboratory to analyze the samples.
The NPDES permit has an effluent limit of 50 NTUs monthly
average. The water quality standard is also 50 NTUs as per 02B
.0211 (b)(3)(k).
I have continued to monitor Maple Branch visually each day with the
turbidity levels changing very little. In order for the soil
particles to remain in suspension for this period of time they are
very small and likely clayey and/or silty in nature. The samples I
took have settled to a great degree which shows it is possible to
improve the quality of the discharge.
Mr. McClain has given me a letter which reports the mine in
question was not using adequate BMPs on the day of our inspection.
It is therefore possible to consider enforcement action. Please
find attached a Notice of Violation letter for your signature if
you should agree.

Dear Mr. St. Clair:
An investigation of the mine dewatering at the Randy Hodges
pit was made on March 26, 1997. Division of Water Quality(DWQ)
staff observed the quality of the discharge and took a sample.
Also, staff of the Division of Land Quality observed the "Best
Management Practices" in use and judged them to be inadequate. The
DWQ staff also investigated the location where the dewatering
discharge enters Maple Branch and took samples upstream and
downstream. The investigation and samples have shown that your
activities resulted in the violation of your NPDES permit NCG020409
for turbidity and Water Quality Standards for turbidity. A
violation of your permit and Water Quality Standards is subject to
civil penalties as authorized by General Statute 152-215.6. The
Environmental Management Commission has the authority to assess a
penalty of not more than ten thousand dollars($10,000) per day for
as long as the violation continues.
It has been determined that because of the circumstances
regarding the Randy'Hodges pit, level of cooperation and length of
operation that a recommendation for an assessment of a civil
penalty for the. above noted violations will not be made at the
present time.
