we just received a copy of the Past Due Invoice for the Davis Mine NCGO20616 permit (dated 7/10/13) which I believe
was undeliverable to the previous permittee's consultant Mr. Hood Richardson. We've recently transferred this permit
to the new owner/permittee Mr. James M. Davis. Can a new invoice be prepared and sent to the Mr. Davis at his
mailing address: 521 Foreman Ln., Belhaven, NC 27510? 1 thought of just forwarding this older invoice, but that could
very likely confuse Mr. Davis since the invoice has the name and address of the consultant for the previous permittee on
it and we just performed the ownership change a month ago. Let me know what you think.

I have no problems nor questions regarding this mine permit renewal and transfer to new owner.
Mr. Davis does still need to pay the annual NCG02 fee for this year, but it is only recently due, so no major problem
there.

We received a copy of the dewater permit transfer to Mr. Davis dated August 12, 2013. Do you know if since then he
has submitted the $100 annual fee?
Hi Scott,
I checked into BIMS, even though I realize you already had done the some before me. 1 confirm that BIMS shows that
we accomplished the Ownership change earlier this month, and that this year's annual fee amount is past due. Scott,
we're generally prettyquick with de ositin the money and logginq that deposit into BIMS 1 — 2 days, I think. I
must conclude that he really is still past due, and that this not a case of the money is here, but we just haven't logged
it in, yet.
Also, do you know if Mr. Davis submitted or has an O&M plan since he has recently taken over the mine?

I can't find the paper permit file in our SPA file room that would allow me to confirm whether we have such a
document from either this owner or the previous one. That usually indicates that the file is on somebody's desk, but 1
don't see it on Sheri's desk top. Eventually all name%wnership changes go through Sheri, so I'm not sure whether
there is an O&M Plan, new or old, or not, at this point. (in a brief walk -around this morning, I don't see it on anyone
else's desk top, either.)
I thought the Regions kept O&M/pumping plans for our NCGO2 permittees in the Regional files. No?
I'll send around a separate file location notice to our group.

WARO received a permit ownership change request July 29, and forwarded it up to me yesterday. The request is on a
Stormwater Permitting Program form, and is for our permit NCG020616. New business name: Davis Sand; new owner
name: James Michael Davis (long-time owner of the land, but not the previous mining business.)
Despite absence of full legal documentation, we intend to process this permit ownership change to the land owner
(previously NCG02 had been issued to a tenant on the land, Mr. Selby.)
It's not clear to me that he has alerted you all to the change in the mining permit. Have you got a record of the new

Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:

• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Reference is made to your recent request for rescission of the subject NPDES General Permit. In the letter
provided by you dated March 16, 2004. the mine was found to be satisfactorily reclaimed. In accordance
with your request, NPDES General Permit NCG020419 is rescinded, effective immediately,
Please he advised that this permit rescission is based wholly upon your statement that the activities which
would require general permit coverage at the site have ceased or been eliminated. Division staff has not
visited the site to obtain independent verification. Operating a treatment facility. discharging wastewater
or discharging specific types of stormwaler to waters of -the State without a valid NPDES permit will
subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be
certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing pern>;t
coverage was necessary. If, in retrospect. you feel the site still requires permit coverage, you should notify
this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface
waters. you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public: service if you would inform
the new or prospective owners of their potential need for NPDES pernvt coveragc.

In accordance with your application for discharge permit received on September 4, 1997, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Water Quality, The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act
or any other Federal or Local governmental permit that may be required.

in accordance with the effluent limitations, monitoring retluirements, and other conditions set forth in Parts I, 11, III,
IV, V, VI and VII of General Permit No. NCG020000 as attached.
This certificate of coverage shall become effective March 7, 2000.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
