On December 6, 2006 Western Materials received a Notice of Violation for impacting a
stream adjacent to their mining operation in Clay County. Western Materials contacted McGill
Associates on December 12, 2006 to coordinate the remediation of the stream impact. McGill
Associates scheduled a site visit for December 19, 2006 and after the visit produced a letter,
which was delivered to NCDENR-DWQ on December 21, 2006. The December 21, 2006 letter
addressed two main points: 1) Western Materials acknowledged that sediment from a stockpile
area at their Mission Quarry entered an unnamed branch on their property, and 2) Western
Materials will do whatever is necessary to repair the stream. A broad outline of the stream repair
work was presented in the December 21" letter, addressing the need to first stabilize the source
of sedimentation to the stream and then secondly, listed the tasks needed to do the stream repair
work. There was not a sufficient amount of tune by December 21 to address all of the issues
presented in the November 29, 2006 Notice of Violation Letter. A follow-up letter on January
16, 2007 from McGill Associates to NCDENR-DWQ listed the dates of the stockpile
stabilization work and outlined the steps taken to that point to hire a stream repair specialist.
Western Materials has hired Soil & Environmental Consultants, a firm that is experienced and
respected on stream repair projects.
McGill Associates & Soil and Environmental Consultants have developed the following
schedule, with dates, for implementing the items requested in the Notice of Violation and
reiterated in the NCDENR-DWQ January 19, 2007 letter:

experience that permits from the Corps and DWQ are not required for this type of temporary
impact to a stream, however; if 404 and 401 permits are required, it could add an un-known
amount of time to the schedule prior to any in -stream work. Additionally, inclement weather
could impede the progress of the in -stream work.
As mentioned in previous letters, Western Materials has responded to the NCDENR-
DWQ Letter of Violation promptly and in good faith and wishes to do whatever is necessary to
repair the impact to the stream and ensure that future impacts are avoided.

On November 16, 2006 Starr Silvis and Jim Reid of the Division of Water Quality and
Cathy Tyndall of the Division of Land Resources performed a site inspection of the
Western Materials Mission Quarry.
During; the site visit, the investigators took .photographs and made observations of
unauthorized impacts to an unnamed tributary to the I-liawassee River (Classified: WS IV
waters). The overburden/pond tailings waste pile is and has been failing. The sediment
from the pile flows downhill approximately 75-100 feet from the toe of.the slope into the
unnamed tributary. The largest impacts were caused by the deposition of this sediment to
approximately 2,800 linear feet of streams and the tin -permitted installation of a sediment
basin in the stream.
A DWQ file review confirms that impacts to stream and riparian (streamside) areas
occurred prior to the submission of a Pre -Construction Notification or any authorization,
permit, or 401 Water Quality Certification from the Division of Water Quality. As a
result of the site inspections and file review, the following; violations are noted:
1) Failure to secure a 401 Water Quality Certification
2) Preclusion of best usage
3) Other Waste (in -stream sediment)

Item I. Failure to secure a 401 Water Quality Certification
Impact to stream has occurred at this tract from mining activities. However, a 401 Water
Quality Certification has not been issued for this impact, and a 401 Water Quality
Certification or authorization has not been sought. A 401 Water Quality Certification is
required for the above -mentioned impacts pursuant to 15A NCAC 2H .0500.
The restoration of the stream affected by these impacts must be permitted through a
respective 404 Permit from the US Army Corps of Engineers and corresponding 401
Water Quality Certification from DWQ must be obtained. If you need assistance in with

Item II. Preclusion of Hest Use
A DWQ site visit and file review confirmed that stream impacts occurred to unnamed
tributaries to the I-Iiawassee River, class WS IV, to the Hiawassee River Basin.
Furthermore, these impacts occurred prior to the proper securing of a Permit from the US
Army Corps of Engineers and a 401 Water Quality Certification from the Division of
Water Quality. These impacts include the unauthorized placement of rip -rap and in -
stream excavation for installation of a sediment control structure, as well as in -stream
sediment deposition in the unnamed tributary to the Hiawassee River. This severe impact
has resulted in a stream standard violation.
Specifically, 15A NCAC 213 .0211 (2) states that the preclusion of best usage, which
includes aquatic life propagation, biological integrity, wildlife, secondary recreation, and
agriculture represent a water duality standard violation.
Item II. Other Waste (In -Stream Sediment)
Impact to the stream has occurred on this tract from mining activates. Specifically; of
sediment has been deposited in the streatn as a result of an unstable overburden/pond
tailing waste pile. Approximately 2.800 linear feet of stream has been impacted. The
stream has an average of 5-6 inches of sediment deposited throughout the length of the
tributary.
Specifically, 15A NCAC 02B .0211 (3)f states that oils; deleterious substances; colored
or other wastes: only such amounts as shall not render the waters injurious to public
health, secondary recreation or to aquatic life and wildlife or adversely affect the
palatability of fish, aesthetic quality or impair the waters for any designated uses.

This Office requests that you respond to this letter in writing within 15 days of

Your response should address each the following items:
You shall provide a restoration flan and an implementation schedule for the
impacted stream segments. Specifically, you must remove the deposited rip -rap and
sediment from the stream. It is recommended that you use band labor (buckets,
shovels and wheelbarrows) to remove deposited rip -rap and sediment from the stream
channel. The rip -rap and sediment should be removed from the channel and taken to
high ground. (It is recommended that your consultant contact Kevin Barnett of the
Asheville Regional Office for additional guidance during; stream restoration plan
development.) Please provide a stream stabilization plan (with mass balance
calculations for the amount of sediments lost and an accounting summary
methodology for the sediment removal activity), for review and approval by the
Division of Water Quality. This plan should include a schedule with dates that
indicate when you propose to complete the removal of the sediment. Please also
include a diagram of the stream channel that shows those areas where you propose to
remove sediment. Your plan must include a stream monitoring plan and
methodology for stream stability for a period of' at least 3 years and a contingency
plan should instability occur. Regular submissions of results to this agency should
also be included in your plan.
Thank you for your attention to this matter. This Office is considering; sending a
recommendation for enforcement to the Director of the Division of Water Quality
regarding these issues and any futurcicontinued violations that may be encountered.
Your above -mentioned response to this correspondence will be considered in this
process. This office requires that the violations, as detailed above, be abated
immediately. 'These violations and any future violations are subject to a civil
penalty assessment of up to $25,000.00 per day for each violation. Should you have

The facility has a stormwater best managment practics plan in place and has begun monitoring.
The facility has a failing overburden storage area. The overburden storage area is failing into the
headwaters of an unamed tributary to the Hiawassee River. The tributary is filled with sediment from the
overburden pile. The facility has installed a sediment trap in the creek. The overburden pile must be
stabilized so that it does not contribute sediment to the creek. Once the overburden pile is stabilized
remedial action may need to be taken to return the creek to pre -impact conditions. }'
The facility was made aware of the failing overburden pile on June 20, 2006. Mary Stone and Starr Silvis
walked the length of the creek from downstream to upstream to determine the source of the sediments:..
Depth of sediment ranged from 5-6 inches deep along the entire length of creek observed.
During the June 20, 2006 visit it was observed that dust supression water was flowing directly into the
creek. Measures must be taken to prevent this illegal discharge from occuring.

Enclosed please find a copy of the Inspection Report from the inspection conducted June
2, 2006. The Compliance Evaluation Inspection was conducted by James R. Reid and Starr
Silvis of the Asheville Regional Office. The treatment facility was found to be in violation of
Permit NCG020606 for the following:

No plans have been generated in accordance with the requirements
of the facility's permit. Some monitoring has been done. However,
the monitoring needs to be conducted during storm events.
Please refer to the enclosed Inspection Report for any additional observation and comments. Along
with the inspection report, included are the general permit for mining operations and a technical
bulletin summarizing aspects of the general permit. The facility owners are responsible for
implementing all requirements of the permit.
To prevent further action carefully review these violations and deficiencies and respond in writing to
this office within fifteen (15) working days of receipt of this letter. You should address the causes of
noncompliance and all actions taken or planned to prevent the recurrence of similar situations. If

The facility does not have a BMP plan. The facility has been doing quarterly sampling of the outfail on the
sediment pond. However, sampling is not been done during a storm event. Sampling must be done during
a representative storm event as detailed in the permit.
The facility has a small unnamed tributary to the Hiawassee River on site. The facility manager was
advised that any work conducted on the stream may require a permit from both the US Army Corp of
Engineers and NC DENR DWQ.
There is a significant amount of sediment in the creek. The facility manager was advised that runoff from the
parking lot and across the flat area adjacent to the creek needs to be directed into a sediment basin prior to
discharge to the creek.

If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
