Stevens Division of Water Quality February 20, 2001 Jackson County DWQ Project # 010231 APPROVAL of 401 Water Quality Certification David & Nancy Tatum 2820 Stoneglen Close Roswell, GA 30076 Dear Mr. & Ms. Tatum: You have our approval, in accordance with the attached conditions, to place fill material in 700 square feet acres of wetlands for the purpose of stabilizing a shoreline at 103 Lake Trail on Lake Glenville, as,you described in your application dated February 14, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3280. This Certification allows you to use Regional General Permit Number 3280 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a. copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. In the last two years, we have experienced serious erosion along our shoreline, primarily from the wakes of boats and jet skis. Despite the law regarding no wake areas, most watercraft operators are ignoring it, coming to within a few feet our dock. We have lost about two feet of bank across most of the width of our property since the fall of 1998. We plan to contract with Jason Smith of Carolina Land Works to do this installation. Mr. Smith has told us that he is up to date with your current requirements. We have attached a copy of Mr. Smith's proposal which outlines what he plans to do on the shoreline. He has assured us that his work will be in full compliance with your published standards and guidelines for this type of work. Would you be so kind as to review his proposal, and indicate your approval of this project? It would be much appreciated if you could provide that approval in writing. As we are anxious to get it done before the lake begins filling up, please let us know within 10 days of the date of this letter.
