After reviewing your application, we have determined that this fill is covered by General Water Quality Certification.Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to place stone riprap along 645 feet of bulkheaded shoreline. Chapman Lumber Company, Inc. Field Investigation Report Page Two Project Setting Chapman Lumber Company, incorporated owns 5 lots totaling 3.8 acres located east of Bells Island Road in the Currituck community, Currituck County, adjacent to the Currituck Sound. The five lots are 300' deep and front Currituck Sound a total distance of 645 linear feet. To access the project site turn northeast off Bells Island Road (SR 1245) onto a 1200' long soil drive which ties into a short section of 12' wide asphalt pavement located 400' landward of the sound. Elevation of the lots ranges 4'-6' above mean sea level. Vegetation noted on the propery includes live oak (Quercus virginiana), loblolly pine (Pinus taeda), eastern red cedar (Juniperus virginiana), yaupon (Ilex vomitoria) and established lawn grasses. Man-made features noted on the lots include a 4' wide x 50' pier capped with reinforced concrete, 645 linear feet of old wooden bulkhead, a 16' x 52' four-bay garage and 300 linear feet of 12' wide asphalt pavement. Development on the neighboring residential lot to the north consists of several sheds located 30' - 100' landward of a shoreline protected by several severely deteriorated wooden groins. The shoreline of the neighboring lot to the south is protected by a new wooden bulkhead. The waters of the Currituck Sound in the vicinity of the project are classified as SC by the NC Division of Environmental Management. These waters are classified as Joint Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission. Water depths in the project area (out to 5' waterward of the existing bulkhead) measure 1.5' - 2.5' below NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of the project. Review of available information suggest that there are archeological sites or geological formations associated with the applicant's property. Project Description The applicant proposes to place stone riprap along the 645 linear feet of bulkheaded shoreline a maximum distance of 5' waterward of NWL. Water depth averages 2' and 300 cubic yards of fill are proposed below NWL. CAMA General Permit No. 20913A was issued on September 16, 1998 authorizing the replacement in place of the southern most 500 linear feet of wooden bulkhead damaged by Hurricane "Bonnie". The work authorized by the General Permit was completed prior to the December 15, 1998 expiration date. Anticipated Impacts The placement of stone riprap along 645 linear feet of shoreline a maximum distance of 5' waterward of NWL would fill 3,225 square-feet of Estuarine Waters/Shallow Water Habitat.
