All,
am not sure what I can do. Even if I catch the people doing it, l don't know what leverage I have. Question - Aren't the
chemicals used in fire extinguishers inert?
Our permit does not address this activity nor the quality of the discharge from the mine. We do address disposal of off -
site generated materials such as: construction debris, land clearing debris, etc..
With that said, according to the permit they are to be in compliance with other applicable permits — water quality permits.
Please advise if they are out of compliance.

I received a call 4-21-2011 from Thomas Moore (1190 North Side Rd. Elizabeth City, NC — 252-489-0839) reporting the
following issue at the Superior Sand Mine in Elizabeth City (see attachments for location):
Fire Extinguisher company (ECO?) out of Virginia is emptying fire extinguisher contents into the sand pit. Activity causes
water in pit to become murky/cloudy. Reports a 100 yard long plume of cloudy water. Moore reports that the pit is
pumped 24 hours a day to keep it dewatered. Moore is concerned about environmental impacts/contamination
resulting from the discharge of the cloudy water. Moore reports that he and others are on well water in the area.
Moore is especially concerned about water supply wells being contaminated too. Moore reports that the mine owner
may not be aware that the fire extinguisher company employee is emptying fire extinguishers in the pit.
Moore requests assistance/help to address "contamination" concerns.
Curtis Chambers (252-335-2965) is the contact for the mine.
RIMS Incident Report attached for reference also.
John, it appears that any "potential groundwater contamination" is from an unpermitted discharge and would be a
Waste Management matter. Would your office be following up on any groundwater contamination concerns or with
Mr. Moore about his concerns over his well being contaminated?

I received a call 4-21-2011 from Thomas Moore (1190 North

be in compliance with your permit. It is your responsibility, as the permit holder, to read and comply

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:

• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater

Your coverage under this general permit is not transferable except after notice to DWO. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Inspection Summary;
History: 4/21111 David May (252) 948-3939 of WaRO-APS took the inbal report and set up the incident number. 4/26/11
DLQ said that no violation of the mining permit was reported. Therefore, as related to the NPDES general SW permit, the
WaRO-DWQ-SWPS responded to the incident. 512111 Samir Dumpor, PE (252) 948-3959 contacted Waste
Management to inform of the incident, but learned the section was also investigating the incident. Sue Robbins,
Hydrogeologist, IHSB, Superfund Section, NC Division of Waste Management, Wilmington Regional Office (910)
796-7411, reported the owner had stated he was not knowledgeable of the reported activity; until called out and visited by
the sheriffs department. Ms. Robbins stated, Thomas Moore (252) 489-0839 reported an alledged 100 yard plume of
cloudy/murky water, as a result of fire extinguisher contents being despensed into the water of the pit by a Virginia
company (EOC?). Mr Moore reported of the potential for contamination of supply wells for area drinking water. He also
reported that the operation was pumping water continuously, therefore creating potential for downstream contamination.
But Mr. Moore stated that the mine owner was Curtis Chambers (252) 335-2965. Ms Robbins reported that she had
identified that Mr. Chambers was no longer the owner of the operation, and that Scott Garland (252) 338-4948 was the
current owner. Ms. Robbin's stated that the duputy did not observe evidence, that the alledged had occurred.] "**5/4/11
Samir Dumpor, PE and myself visited the site with the owner - Scott Garland (252) 335-2965. Upon initial contact, as well
as while onsite, Mr. Garland did not sound or appear to be aware of the alledged activity. Mr. Garland reported he was
first notified regarding the event when called out to the mine, by the Sheriffs deputy investigating. I took photos at the
site. No dewatering was occurring nor was there evidence of recent pumping (The water level was stable and low in the
mine and very little water was in the stilling basin J 5' freeboard]. The Outfall was also dry with no recent activity). I,
suspect these described conditions are similar to what the deputy witnessed_ Samir and myself discussed the permit with
Mr. Garland and explained the potential for being required to be permitted through an individual NPDES SW permit, if any
activities not covered by the existing general permit were proposed or were to occur, Mr. Garland did not give me, the
impression that he was aware of the alledged or would intentionally violate conditions of the permit. Samir and myself
informed Mr Garland of the consequesces/severity of receiving evidence that the alledged occurred, or were to occur
especially following documentation of our visit. We consider this complaint as being closed. Therefore, the incident on the
public portal, has been closed.

Comment: This was investigating a complaint. No evidence was observed that the
reported occurred. The owner was informed that any material discharged other than
SW or mine dewatering, would require an individual NPDES permit. We discussed the
permit requirements and advised the owner to be very familiar with the requirements
and to contact us with any questions.

Hi Al,
I'm following up on this complaint. I wanted to know if anyone from your office has or is planning a site visit. IHSB may
be able to perform WSW sampling if needed and if there is a confirmed report of hazardous waste dumping. I talked
with the mine contact, Garland Scott 2S2-338-4948 and it didn't sound like he was aware of any dumping. He did say
that the complainant had called 911 and the Sheriff's office did visit the site and didn't observe anything.

I received a call 4-21-2011 from Thomas Moore (1190 North Side Rd. Elizabeth City, NC— 252-489-0839) reporting the
following issue at the Superior Sand Mine in Elizabeth City (see attachments for location):
Eire Extinguisher company (ECO?) out of Virginia is emptying fire extinguisher contents into the sand pit. Activity causes
water in pit to become murky/cloudy. Reports a 100 yard long plume of cloudy water. Moore reports that the pit is
pumped 24 hours a day to Keep it dewatered. Moore is concerned about environmental impacts/contamination
resulting from the discharge of the cloudy water. Moore reports that he and others are on well water in the area.
Moore is especially concerned about water supply wells being contaminated too. Moore reports that the mine owner
may not be aware that the fire extinguisher company employee is emptying fire extinguishers in the pit.
Moore requests assistance/help to address "contamination" concerns.

John, it appears that any "potential groundwater contamination" is from an unpermitted discharge and would be a
Waste Management matter. Would your office be following up on any groundwater contamination concerns or with
Mr. Moore about his concerns over his well being contaminated?

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps along with their corresponding (approximate) acreage. Asa reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that are intended to be conducted during the life of the mining permit. All maps must be
of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a
minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including casements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f. Outline and acreage of all stockpile areas.
g. Outline and acreage of all temporary and/or permanent overburden disposal areas.
h. Location and acreage of alI processing plants (processing plants may be described as to location and
distance from mine if sufficiently far removed).
i. Locations and names of all streams, rivers and lakes.
j. Outline and acreage of all settling and/or processing wastewater ponds.
k. Location and acreage of all planned and existing access roads and on -site haul roads.

C. PROTECTION OF NATURAL RESOURCES
Describe in detail the sequence of events for the development and operation of the mine and reference the
sequence to the mine map(.5). Attach additional sheets as needed.
Visible markers to be set at pit limits, in an effort to bring mine back into compliance. Remove stockpile
within buffer and bill excavated area encroaching; into buffer area, continue mining within permitted area.
2. Describe specific erosion control measures to be installed prior to lane disturbing activities and during
mining to prevent offsite sedimentation (include specific plans for sediment and erosion control for mine
excavation(v), waste piles, access/mine roads and process areas); and give a detailed sequence of
installation and schedule for maintenance of the measures. Locate and label all sediment and erosion
control measures on the mine map(s) and provide typical cross-sections/c•onsiruction details of each
measure. I -Engineering designs and calculations are required to justify the adequacy of any proposed
measures.

proposed mine locale is served by a public water system or private wells.
Current pumping rate is still approximately 12hours per week at 2,000 gpm for an average of 205,714
per day rate. To the best of my knowledge there has been no impact w local wells.
d. If' you answered yes to any of the above questions, provide evidence that you have applied for or
obtained the appropriate water quality permit(s) (i.e., non -discharge, NPDES, Stormwater, etc.) from the
Division of Water Quality, Water Quality Section. In addition, the applicant is required to register water
use with the Division of Water Resources if the operation withdraws more than 10,000 gallons per day
and needs a capacity use permit from the Division of Water Resources if the operation lies in a capacity
use area and withdraws more than 100,000 gallons per day.

a. A buffer will be required between any mining activity and any mining permit boundary or right-of-
way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion &
sedimentation control measures may be installed within it), an undisturbed bufffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note
that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary
or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer
may be needed depending on site conditions. Show all ba{ffer locations and widths on the mine
100' buffer is required per county regulations when joining roads and residential areas. We may seek
relief' from this requirement due to low volume of public traffic on these roads. All other
buffers to remain the same.
b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing; activities
within the mining permit boundaries and any natural watercourses and wetlands unless smaller
undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet may
be needed.

technical justification can be provided to allow steeper slopes.

disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any benches
and/or slope drains (with supporting design information) if needed, and the method of final

Mine is located in a rural area , 650' from SR 1416 and surrounded on the south, east and west by
wetlands and large timber. The north side is joined by residential parcels and posted with no
trespassing signs.
b. Could the operation have a significantly adverse effect on the purposes of a publicly owned park,
forest or recreation area? If so, how will such effects (i.e., noise, visibility, etc.) be mitigated?
Not to my knowledge.
11. Will explosives be used? Yes ❑ NoX.
Ifyes, specify the types of'explosive(s) and describe what precaution(s) will be used to prevent physical
hazard to persons or neighboring property from flying rocks or excessive air blasts or ground vibrations.
Depending on the mine's location to nearby structures, more detailed technical information may be
required on the blasting program (such as a third -party blasting study). Locate the nearest offsite occupied
.struclure(s) to the proposed excavation(s) on the mine map and indicate its approximate distance to the
proposed excavation.

D. RECLAMATION PLAN
Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate
the sequence and general methods to be used in reclaiming this land. This must include the method of
reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment
of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This
information must be illustrated on a reclamation map and must correspond directly ivith the information
provided on the mina map(s). In addition, design information, including typical cross -sections, of any
permanent channels to be constructed as part of the reclamation plan and the location(5) of all permanent
channels must be indicated on the reclamation map.
Reclaimed area will be side sloped to 3:1 from top of' bank to top of water and stocked with fish for
recreational use.
2. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes ❑ No ❑.

6. Describe the method of control of contaminants and disposal of scrap metal, junk machinery, cables, or

from the NC Department of Environment and Natural Resources, Land Quality Section and either
the Division of Waste Management (DWM) or local governing body. If a disposal permit has been
issued by DWM for the site, a copy of said permit must be attached to this application. All
lemporary and permanent refitse disposal areas must be clearly delineated on the mine map(s) find
reclamation map, along with a list of items to he disposed in said areas.

7. Describe your plan for revegetation or other surface treatment of the affected areas. This plan must
include recommendations for year-round seeding, including the time of seeding and the amount and type
of' seed, fertilizer, lime and mulch per acre. The recommendations must include general seeding
instructions for both permanent and temporary revegetation. Revegetation utilizing only tree plantings is
not acceptable. Recommendations can be sought from:
a. Authorized representatives of the local Soil and Water Conservation District;
b. Authorized representatives of the Division of Forest Resources., Department of Environment and
Natural Resources:
c. Authorized county representatives of the North Carolina Cooperative Extension Service, specialists
and research faculty with the Colleges of Agriculture and Life Sciences and Forest Resources at
North Carolina State University;
d. North Carolina licensed landscape architects;

F. NOTIFICATION OF ADJOINING LANDOWNERS
The "Notice" form, or a Facsimile thereof, attached to this application must be sent certified or registered mail,
return receipt requested, to:
(1) the chief administrative officer of each county and municipality in which any part ofthe permitted
area is located as indicated on the mine map(s);
(2) all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary; if an adjoining tract is owned or leased by the applicant or is owned by the lessor
of the mine tract, all owners of record of tracts adjoining these tracts must be notified (that are
within 1,000 feet of the mining permit boundary) as indicated on the mine map(s); and
(3) all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary which lie directly across and are contiguous to any highway, creek, stream, river,
or other watercourse, railroad track, or utility or other public right-of-way. If an adjoining tract is
owned or leased by the applicant or is owned by the lessor of the mine tract, all owners of record of
tracts adjoining these tracts must be notified (that are within 1.,000 feet of the mining permit
boundary) as indicated on the mine map(s). "Highway" means a road that has four lanes of travel
or less and is not designated as an Interstate Highway.
The only exception to the above method of giving notice is if another means cif notice is approved in advance by
the Director, Division of Land Resources.
A copy of a tax map (or other alternative acceptable to the Department) must be mailed with the completed
"Notice" form (the proposed overall permit boundaries and the names and locations of all owners of
record of lands adjoining said boundaries must be clearly denoted on the tax map).
The "Affidavit of Notification" attached to this application must be completed, notarized and submitted to the
