APPROVAL of 401 Water Quality Certification
Dear Sirs:
You have our approval, in accordance with the attached conditions, to place fill in 145 linear feet of Barkers Creek in
order to construct a road crossing in Wake County, as described in your revised application received by the Division of
Water Quality on April 2, 2001. After reviewing your application, we have determined that this fill is covered by General
Water Quality Certification Number 3289. This Certification allows you to use Nationwide Permit Number 14 when it is
issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

On February 8, 2001 the Division of Water Quality (DWQ) was notified by receipt of
your application regarding your plan to fill 270 feet of streams for the purpose of constructing
road crossings at Branton Village subdivision in Wake County. Approval from DWQ is required
to disturb these streams. Please provide seven copies of a large scale site plan so we can
determine if other determine if other impacts are likely from this project.
Please call me at (919) 733-1786 if you have any questions or would require copies of
our rules or procedural materials. This project will remain on hold as incomplete in accordance
with 15A NCAC 2H .0505(c). The processing time for this application will begin when this
information is received. If we do not hear from you by writing within three (3) week we will

Dear Mr. Dorney:
This letter is in response to your request for additional information concerning
this project. As we discussed on the phone, Amanda Jones of the Corps of Engineers has
performed an on-site review of the project in response to the application. She determined
that Norris Branch did require a permit. She issued a Nationwide Permit #39 for the 145
linear feet of stream impact.
The other crossing which was requested in the permit request was reviewed and it
was determined that there was no jurisdictional channel or wetland at this location.
Please process the permit with the amendment of items 10 and 12 on the application. The
notifications of action by the Corps of Engineers are enclosed. If you have questions, I

Size and Location of Property (waterbody, Highway name/number, town, etc.): The site is located
on Holly Thorn Trace in the Braxton Village Subdivision, which is located on the north side of Avent
Ferry Road (SR 1115), approximately 1. 3 km west of its intersection with SR 1116, west of Holly
Springs, Wake County, North Carolina.
Basis for Determination: The site contains stream channels with indicators of ordinary high water
marks, which includes Norris Branch and its unnamed tributaries, above headwaters, in the Cape Fear
River Basin. A small pond in the northwestern portion of the property was determined to be isolated and
non jurisdictional. There was not a jurisdictional channel or wetland connecting the pond to Norris
Branch as depicted on the USGS New Hill Quad Map.
Indicate Which of the Following Apply:
There are waters of the U.S." to include wetlands, on the above described property which we strongly suggest
should be delineated and surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.
Because of the size of your property and our present workload, our identification and delineation of your wetlands
cannot be accomplished in a timely manner. You may wish to obtain a consultant to obtain a more timely
delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
review it, and, if it is accurate, we strongly recommend that you have the line surveyed for final approval by the
Corps. The Corps will not make a final jurisdictional determination on your property without an approved survey.
X The waters of the U.S., to include wetlands, on your lot have been delineated, and the limits of the Corps
jurisdiction have been explained to you. Unless there is a change in the law or our published regulations, this
determination may be relied upon for a period not to exceed five years from the date of this notification.
There are no waters of the U.S., to include wetlands, present on the above described property which are subject to
the permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law
or our published regulations, this determination may be relied upon for a period not to exceed five years from the

Placement of dredged or fill material in wetlands on this property without a Department of the
Army Permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A

on Holly Thorn Trace in the Braxton Village Subdivision, which is located on the north side of Avent
Ferry Road (SR 1115), approximately 1.3 km west of its intersection with SR 1116, west of Holly
Springs, Wake County, North Carolina.
Description of Activity: This permit authorizes mechanized landclearing, excavation, the installation of
culverts, and the placement of fill associated with the construction of a road crossing. Impacts to waters
authorized by this permit include 0.03 acres (145 linear feet) of Norris Branch in the Cape Fear River
Basin.
Applicable Law: X Section 404 (Clean Water Act, 33 USC 1344) only.
Section 10 (River and Harbor Act of 1899) only.

Size and Location of Property (waterbody, Highway name/number, town, etc.: The site is located
on Holly Thorn Trace in the Braxton Village Subdivision, which is located on the north side of Avent
Ferry Road (SR 1115), approximately 1.3 km west of its intersection with SR 1116, west of Holly
Springs, Wake County, North Carolina.
Basis for Determination: The site contains stream channels with indicators of ordinary high water
marks, which includes Norris Branch and its unnamed tributaries, above headwaters, in the Cape Fear
River Basin. A small pond in the northwestern portion of the property was determined to be isolated and
non jurisdictional. There was not a jurisdictional channel or wetland connecting the pond to Norris
Branch as depicted on the USGS New Hill Quad Map.
Indicate Which of the Following Apply:
-There are waters of the U.S., to include wetlands, on the above described property which we strongly suggest
should be delineated and surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.
-Because of the size of your property and our present workload, our identification and delineation of your wetlands
cannot be accomplished in a timely manner. You may wish to obtain a consultant to obtain a more timely
delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
review it, and, if it is accurate, we strongly recommend that you have the line surveyed for final approval by the
Corps. The Corps will not make a final jurisdictional determination on your property without an approved survey.
X The waters of the. U.S., to include wetlands, on your let have been delineated, and the limits of the Corps
jurisdiction have been explained to you. Unless there is a change in the law or our published regulations, this
determination may be relied upon for a period not to exceed five years from the date of this notification.
There are no waters of the U.S., to include wetlands, present on the above described property which are subject to
the permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law
or our published regulations, this determination may be relied upon for a period not to exceed five years from the
date of this notification.
Placement of dredged or fill material in wetlands on this property without a Department of the
Army Permit is inmost cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A
permit is not required for work on the property restricted entirely to existing high ground. If you
