received July 28, 2010, the Division of Water Quality (DWQ) is forwarding herewith the reissued Certificate of
Coverage and stormwatcr Gcneral Permit. This permit is reissued pursuant to the requirements oi' North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S.
Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended)

forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general pert -nit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environtnentat
Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of' coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.

Enclosed is an application package fora modification to the Brooks Pit (permit 496-45) located off of
NCSR 1912 in Wayne County. The proposed modification will add acreage along the western boundary of
the current site. The proposed site consists of mostly woodlands. The site has the Neuse River as a
boundary to the south. The land is owned by Mr. Thomas G. Best.
Six copies of the N.C. Mining Permit Application, six copies of all maps, and a check for the permit
application fee is enclosed. All adjoining property owners have been properly notified along with the
manager of Wayne County and the N.C.D.O.T.

Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on
the maps along,with their corresponding (approximate) acreage. As a reminder, mining
permits can only .he issued for up to 10 years; thus, all mine and reclamation maps must only
denote those activities that are intended to be conducted during the life of the mining permit.
All maps must be of a scale sufficient (see minimum requirements listed below) to clearly illustrate the
following, at a minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f. Outline and acreage of -all stockpile areas.
Outline and acreage of all temporary and/or permanent overburden disposal areas.
li. Location and, acreage of all processing plants (processing plants may be described as to location

i. Locations and names of all streams, rivers and lakes.
j. Outline and acreage of all settling and/or processing wastewater ponds.
k. Location and acreage of all planned and existing access roads and on -site haul roads.

installed with a float to keep it near the surface and prevent. the discharge of sediment. The water will then be
pumped and discharged to the adjacent pit as shown on the mine map. No water will be discharged into waters of
the state or wetlands, thus no NPDES permit will be required from DWQ.

way. It may be an unexcavated buffer (no.excavation, but roadways, berms and erosion &

Mining activities at the Brooks Pit might require occasional dewatering as allowed by our NPDES
permit, although for the most part water from the pit is used to wash sand and put directly back into the
pit. However, since the mining activity will take place within 400' of delineated wetlands we have created
and Operation and Maintenance Plan to ensure no negative impact will occur to the wetlands.
First, we will install a permanent depth marker in wetlands that hold water year round, marking winter
water level and summer water level. This will allow observation of any potential drawdown of water
levels. If a significant drawdown is observed due to a dewatering event we will dewater into affected
wuland using a silt bag to prevent silt from entering wetland.
Second we will continually observe the vegetative state of wetlands that do not hold water year round
but have been delineated due to plant species or soil conditions. If vegetative species are adversely affected
we will dcwater using a silt bag to prevent silt from entering delineated wetland.
Third, mining site/ haul roads are sloped to drain internally into the pit. This will prevent runoff of
sediment/ silt into wetlands. All BMP's noted in existing NPDES permit 4 NCG020565 are in place and
