Coverage for your facility. These permits have specific conditions that must be met in order for you to
be in compliance with your permit. It is your responsibility, as the permit holder, to read and comply
with the conditions contained in the permit.
It is our responsibility, as the issuing authority, to make sure that the operation and maintenance of
your facility complies with the conditions contained in your permit. To assist you in complying with
these conditions, we are attaching a Technical Bulletin specific to your permit requirements. We are
currently in the process of developing our inspection schedule. Therefore, you should have all of
your records up to date as we may be contacting you in the near future to set up an inspection of your
facility.

In accordance with your application for a discharge permit received on April 25, 2000 we are
forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated May
9, 1994 (or as subsequently amended).
In the near future an individual permit will be developed to replace this general stormwater permit. The
new permit will include more monitoring and controls to help better protect the downstream water supply intake
for the City of Greenville. Upon that permit's issuance this certificate of coverage will be rescinded.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the
Federal Water Pollution Control Act, as amended,

Bunting Mine

Pitt County
to receiving waters designated as an unnamed tributary to Johnsons Mill Run, class WSIV NSW waters in the Tar -
Pamlico River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set
forth in Parts I, II, II1, IV, V, VI and VII of General Permit No. NCG020000 as attached.
This certificate of coverage shall become effective November 30, 2001.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

This letter will confirm our conversation and site visit of August 17, 2000, regarding
Greenville Utilities' concerns associated with the issuance of a general permit for the
Clouting Sand Mine. It is our understanding that the wastewater discharge from the mining
operation would be routed through a pond to a canal that discharges into Johnson's Mill
Run. Johnson's Mill Run discharges into the Tar River within the critical area of our
watershed, one-half mile upstream of the raw water intake for the Greenville Utilities
Water Treatment Plant.
Because the wastewater from the mine will be discharged in close proximity to the
drinking water intake, we have heightened concerns about the potential impact on water
quality. Suspended solids that enter the Tar River from any mining operation could make
the raw water more difficult and costly to treat. "there is also a concern that the accidental
release of petroleum products from fuel storage areas or mining equipment could
potentially contaminate the water supply.
Given that the discharge from the mining operation has the potential to affect the drinking
water quality of more than 50,000 customers, it seems appropriate that an individual
NI'DES permit should be issued instead of a general permit. As we understand it, an
individual permit would require monitoring and effluent limitations to ensure adequate
protection for the drinking water supply. Additionally, we request that we be made aware
of any planned future permitted discharges within the critical area of the drinking water
intake.

Enclosed is an application package for a new mine site located on NCSR
1402(Barrus Construction Road) in Pitt County. The mine operator is proposing to permit
approximately 72 acres. This site is adjacent to the Bunting Pit that is permitted by APAC-
Carolina, Inc.(Barrus Construction Company).
The proposed.site is located on land owned by two different companies. Two land
entry agreements have. been completed. There is an existing pond located on the property
owned by APAC-Carolina, Inc that will be used initially as a sedimentiretention pond for
mine dtwatering. A copy of the NPDES application submitted to the Division of Water
Quality, Water Quality Section for this activity is enclosed.
The mine maps show the proposed excavation area to include 58.08 acres. The
proposed screening berm is shown approximately 300' east of the buffer zone and in the
proposed excavation area. The mine operator initially plans to only excavate up to the
proposed berm, but wants the entire area permitted and bonded in case plans change. This
will save the mine operator from having to submit a modification request at a later time.
The screening berm will be moved to the edge of the buffer zone if the area is excavated.
On March 30;-2000; I met with Henry Wicker, US Army Corps of. Engineers,
about the possibility of excavating the Clark Atkinson Canal.. The mine operator is
proposing to maintain a 50' buffer zone along both sides of the canal with this application.
Four copies of the mining application, mine maps, security bond form and a
$1,000.00 review fee are enclosed. If you have any questions or need additional

APPLICATION FOR A MINING PERMIT
2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on
the maps along with their corresponding (approximate) acreage. As a reminder, mining permits
can only be issued for up to 10 years; thus, all mine and reclamation maps must only denote
those activities that are intended to be conducted during the life of the mining permit. All maps
must be of a scale sufficient (see minimum requirements listed below) to clearly illustrate the
following, at a minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f. Outline and acreage of all stockpile areas.
g. Outline and acreage of all temporary and/or permanent overburden disposal areas.
h. Location and acreage of all processing plants (processing plants may be described as to location
and distance from mine if sufficiently far removed).
i. Locations and names of all streams, rivers and lakes.
j. Outline and acreage of all settling and/or processing wastewater ponds.
k. Location and acreage of all planned and existing access roads and on -site haul roads.

C. PROTECTION OF NATURAL RESOURCES

for mine dewatering. Adequate erosion control measures will
be installed at the northeast corner of the existing pond.
The discharge from the pond will flow via a rip rap lined
swale to the existing Clark Atkinson Canal.
c. Will any part of the proposed mine excavation(s) extend below the water table?

APPLICATION FOR A MINING PERMIT
2. a. Will the operation involve crushing or any other air contaminant emissions?
Yes No x If yes, indicate evidence that you have applied for or obtained an air
quality permit issued by the Division of Air Quality or local governing body.
b. How will dust from stockpiles, haul roads, etc., be controlled?
A water wagon or water truck will be used to control dust.
3. Describe in detail the chronological sequence of land disturbing activities and reference the sequence
to the mine map(s). Attach additional sheets as needed.
All erosion control measures or devices will be installed prior
to any land disturbing activity. The screening berm will then
be installed as shown on the mine map. Mining activity will
start in the southwest corner of the proposed site and move -in
an easterly direction. The mine will then advance in a northerly
direction.
4. Describe specific erosion control measures to be installed prior to land disturbing activities and
during mining to prevent offsite sedimentation (include specific plans for sediment and erosion
control for mine excavation(s), waste piles, access/mine roads and process areas), and give a detailed
sequence of installation and schedule for maintenance of the measures. Locate and label all sediment
and erosion control measures on the mine map(s) and provide typical cross-sections/construction
details of each measure. Engineering designs and calculations shall be required when needed to
justify the adequacy of any proposed measures.
An adequate gravel construction entrance will be installed as
shown on the mine map.
A gravel and rip rap spillway with -a rip rap lined swale will
be installed at the northeast corner of the existing pond.
A temporary sediment trap will be installed in the existing
ditch as shown on the mine map. A large portion of the existing
farm ditch will flow into the existing pond with a small ditch
modification at the northwest corner of the pond. This will
provide a longer retention time for sediment removal.
Typical details of these erosion control measures are included
with this mining application.

5. a. How wide a buffer will be maintained between any mining activity and any adjoining permit
boundary or right-of-way? Buffers must be located within the permit boundaries. Buffers along
permit boundaries must be, at a minimum, unexcavated buffers. Show all buffer locations and
widths on the mine map(s).
A minimum 50' unexcavated buffer will be maintained along the
west side and northwest corner of the proposed site.
A minimum 25' unexcavated buffer will be maintained along the
remaining northern boundary and along the northeast side of
the proposed site.
b. How wide a buffer will be maintained between any land disturbing activities within the permit
boundaries and any natural watercourses and wetlands? Buffers along natural watercourses and
wetlands must be undisturbed. Show all buffer locations and widths on the mine map(s).
A minimum 50' undisturbed buffer zone will be maintained along
the Clark Atkinson Canal.

c. Describe what kind of barricade will be used to prevent inadvertent public access along any high
wall area and when it will be implemented. Vegetated earthen berms, appropriate fencing and
adequate boulder barriers may be acceptable high wall barricades. A construction detail/cross-
section and location of each type of barricade to be used must be indicated on the mine map(s).
A 7' high earthen berm will be installed along the west side
of the proposed site as shown on the mine map.
A gate will be installed at the entrance off of NCSR 1402.
Earthen berms will be maintained around the active excavation
as required by the Dept. of Labor; Mine & Quarry Division.
d. Provide a cross-section on the mine map(s) for all fill slopes (berms, wastepiles, overburden
disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any
benches and/or slope drains (with supporting design information) if needed, and the method of
final stabilization.
A cross-section of the Earthen berm is shown on the mine map.
e. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes
including specifications for benching and sloping. Cross -sections for all cut slopes must be
provided on the mine map(s).
A 3 horizontal to 1 vertical or flatter slope angle will be
maintained along the perimeter of the excavation.
f. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -
sections of the mine excavation clearly noting the angles of the cut slopes, widths of all safety
benches and mine benches; and the expected maximum depth of the excavation.

D. RECLAMATION PLAN
1. Describe your intended plan for the final reclamation and subsequent use of all affected lands and
indicate the general methods to be used in reclaiming this land. This information must be illustrated
on a reclamation map and must correspond directly with the information provided on the mine
map (s).
The mine excavation wil be reclaimed as a lake and all adjacent
disturbed areas will be properly revegetated as per the
approved Revegetation Plan. The side slopes to the lake shall
be graded to an angle of 3 horizontal to 1 vertical or flatter.
A minimum 4' average water depth will be maintained.
2. a. Is an excavated or impounded body of water to be left as a part of the reclamation?

6. Describe the method of reclamation of settling ponds and/or sediment control basins.
The existing pond at the SE corner of the site is to be used as a
sediment/retention basin during the majority of the permit life.
The existing pond will be part of the lake at final reclamation,
7. Describe the method of control of contaminants and disposal of scrap metal, junk machinery, cables,
or other such waste products of mining. (Note definition of refuse in The Mining Act of 1971). No
off -site generated waste shall be disposed of on -the mine site without prior written approval
from the NC Department of Environment and Natural Resources, Land Quality Section- and
either the Division of Waste Management (DWM) or local governing body. If a disposal permit
has been issued by DWM for the site, a copy of said permit must be attached to this
application. All temporary and permanent refuse disposal areas must be clearly delineated on the
mine map(s) and reclamation map, along with a list of items to be disposed in said areas.
Any waste generated by the mining operation will be removed and
properly disposed of at a permitted site.
8. Indicate the method of restoration or establishment of any permanent drainage channels to a condition
minimizing erosion, siltation and other pollution. Provide design information, including typical
cross -sections, of any permanent channels to be constructed as part of the reclamation plan. Indicate
the locations) of all permanent channels -on the reclamation map.

9. Provide a schedule of reclamation that indicates the sequence of reclamation and approximate time
frame. If reclamation is to be accomplished concurrently with mining, then clearly indicate on the
mine maps) and reclamation map each segment that is to be mined and reclaimed during each year

reclamation.

10. Describe your plan for revegetation or other surface treatment of the affected areas. This plan must
include recommendations for year-round seeding, including the time of seeding and the amount and
type of seed, fertilizer, lime and mulch per acre. The recommendations must include general seeding
instructions for permanent revegetation and, if necessary, temporary revegetation. Revegetation
utilizing only tree plantings is not acceptable. NOTE: The Revegetation Plan must be approved
and signed by one of the following:
a. Authorized representatives of the local Soil and Water Conservation District;
b. Authorized representatives of the Division of Forest Resources, Department of Environment and
Natural Resources;
c. Authorized county representatives of the North Carolina Cooperative Extension Service,
specialists and research faculty with the Colleges of Agriculture and Life Sciences and Forest
Resources at North Carolina State University;
d. North Carolina licensed landscape architects;
e. Private consulting foresters referred by the Division of Forest Resources, Department of
Environment and Natural Resources;
f. Others as may be approved by the Department.

The "Notice" form, or a facsimile thereof, attached to this application must be sent certified or registered
mail to all landowners who are adjoining (contiguous to) the permit boundaries as indicated on the
mine map(s) . The only exception to the above is if another means of notice is approved in advance by
the Director, Division of Land Resources.
A copy of a tax map (or other alternative acceptable to the Department) must be mailed with the completed
"Notice" form (the proposed overall permit boundaries and the names and locations of all owners
of record of land adjoining said boundaries must be clearly denoted on the tax map).

G. LAND ENTRY AGREEMENT
• We hereby grant to the Department or its appointed representatives the right of entry and travel upon our
lands or operation during regular business hours for the purpose of making necessary field inspections or
investigations as may be reasonably required in the administration of the Mining Act of 1971.
We further grant to the Department or its appointed representatives the right to make whatever entries
on the land as may be reasonably necessary and to take whatever actions as may be reasonably necessary in
order to carry out reclamation which the operator has failed to complete in the event a bond forfeiture is
ordered pursuant to G.S. 74-59.

•A nonrefundable $50.00 permit application processing fee is required for minor permit modifications. Minor permit modifications include ownership transfers, name
changes, bond substitutions and permit renewals where the mine is inactive and fully stabilized. A minor permit modification also includes lands added to a permitted
area, outside of the minimum permit buffer zone requirements, where no plans for mining related disturbance of the added lands have been approved. All other
changes are considered major modifications.
"Acres for new permits and renewal permits means the total acreage at the site. Acres for major modification of permits means that area of land affected by the
modification within the permitted mine area, or any additional land that is to be disturbed and added to an existing permitted area, or both.
