On Rescission requested, the Division of Water Quality received your request to rescind your coverage
under Certificate of Coverage Number NCG020517. In accordance with your request, Certificate of
Coverage Number NCG020517 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Your facility was covered for stormwater discharge under NPDES Permit NCG020517, however, this
permit expired on 12/31/2009. To assure consideration for continuing coverage under your permit, you
must apply to the Division of Water Quality (DWQ) for renewal of your permit. Enclosed you will find a
permit Renewal Application Form, Supplemental Information request, and a Stormwater Pollution
Prevention Plan Certification for your facility. Filing the application form along with the requested
supplemental information will constitute your application for renewal of this pennit. .
The application and supplemental information must be completed and returned to DWQ by May
15, 2012. Failure to request renewal within this time period will result in the inactivation of your expired
permit in our system. Discharge of stormwater without coverage under a valid stormwater NPDES permit
constitutes a violation of N.C. General Statute 143-215.1 and may result in the assessment of civil
penalties of up to $25,000 per day.

This letter is in response to a letter dated j unc 11, 2010 from Rick Shiver about the Watkins
Ndinc.
The mine is closed and has been closed for over a year. WE are in the process of preparing
the proper paper work to subnut an "Ownership Transfer Norm" to transfer the permit to
the current owners of the property.
The "ditch system" that was discharging stor.mwater from the mine pit was not created by
the property owners but ct-eated by people that had trespassed on the property and had been
four wheeling and riding motorcycles on the property. A low spot had formed at the
discharge location and the continual four wheeling and rutting of tires created the "ditch"
allowing water to leave the site. This low spot has been filled and .eater is not being allowcd
to leave the site at this time.
I regard to the violations that are mentioned. The mine has been closed for over a N=car.
The paper work notifying the Division within 90 days of the permitted facility being sold
was inadvertently not submitted. One party thought the other party had submitted the paper
work.
Since the mine has been closed, monitoring reports were not kept and the water leaving the
site was not known. This has since been corrected once we found out water was leaving the
site.

On June 1, 2010, a compliance evaluation inspection was conducted at the Watkins Mine facility,
located in I -folly Shelter, by Division Representative, Linda Willis. The inspection was conducted
to determine whether the facility is in compliance with the conditions required by the certificate
of coverage (NCG020517) issued pursuant to NPDES General Stormwater Permit NCG020000.
Stormwater and/or wastewater discharges from this mine site drain to Turkey Creek in the Cape
Pear River Basin. Turkey Creek is classified SA, ORW waters of the State.
During a phone conversation with Division Representative, Linda Willis, on June 1, 2010, you
indicated that you had sold the property where this mine pit is located. The certificate of
coverage issued pursuant to this General Permit is not transferable to any person except alter
notice to and approval by the Director. The permittee is required to notify the division within
90 days in the event the permitted facility is sold or closed. A record review indicates the
Division has not received any request for transfer of the permit. For your convenience, a copy of
the ownership transfer form is included with this correspondence. Until this permit is transferred
properly you remain the permittee for the certificate of coverage (NCG020517) under the NPDES
General Permit NCG020000, and are responsible for compliance with the permit conditions.
The mine pit is being dewatered through the use of ditch system that discharges a combination
of stormwater and wastewater from the mine pit at the east side of the pit. The discharge is of
extremely poor quality. A sample of the discharge was collected and sent to the State laboratory
for total suspended solids analyses. A portion of the sample was tested for turbidity in the
regional office. Turbidity was measured to be 405 Nephelometric Turbidity Units (NTU). The
stream standard for water classified SA is 25 NTU. You are hereby instructed to discontinue the
discharge from this mine site immediately until the quality of the discharge can be addressed
through appropriate best management practices (BMPs). You should contact Gary Beecher with
the Division of Land Resources (DLR) in the Wilmington Regional Office (910-796-7215) to

Mine sites that conduct active dewatering in close proximity to wetlands are required to develop
and follow an operation and monitoring plan to ensure the dewatering activity is not impacting
adjacent wetlands. Please provide this office with a copy of the O & M plan. If one has not been .
developed for this site, you are hereby notified that an O & M Plan is required. You may contact
Linda Willis at 910-796-7343 for more information concerning the O & M Plan requirements.

On June 1, 2010, a compliance evaluation inspection was conducted at the Watkins Mine facility,
located in Holly Shelter, by Division Representative, Linda Willis. The inspection was conducted
to determine whether the facility is in compliance with the conditions required by the certificate
of coverage (NCG020517) issued pursuant to NPDES General Stormwater Pert -nit NCG020000.
Stormwater and/or wastewater discharges from this mine site drain to Turkey Creek in the Cape
Fear River Basin. Turkey Creek is classified SA, ORW waters of the State.
During a phone conversation with Division Representative, Linda Willis, on June 1, 2010, you
indicated that you had sold the property where this mine pit is located. The certificate of
coverage issued pursuant to this General Permit is not transferable to any person except after
notice to and approval by the Director. The permittee is required to notify the division within
90 days in the event the permitted facility is sold or closed. A record review indicates the
Division has not received any request for transfer of the permit. For your convenience, a copy of
the ownership transfer form is included with this correspondence. Until this permit is transferred
properly you remain the permittee for the certificate of coverage (NCG020517) under the NPDES
General Permit NCG020000, and are responsible for compliance with the permit conditions.
The mine pit is being dewatered through the use of a ditch system that discharges a combination
of stormwater and wastewater from the mine pit at the east side of the pit. The discharge is of
extremely poor quality. A sample of the discharge was collected and sent to the State laboratory
for total suspended solids analyses. A portion of the sample was tested for turbidity in the
regional office. Turbidity was measured to be 405 Nephelometric Turbidity Units (NTU). The
stream standard for water classified SA is 25 NTU. You are hereby instructed to discontinue the
discharge from this mine site immediately until the quality of the discharge can be addressed
through appropriate best management practices (BMPs). You should contact Gary Beecher with
the Division of Land Resources (DI,R) in the Wilmington Regional Office (910-796-7215) to

Please provide this office with the past two years of recorded data. Your NPDES Permit requires
quarterly quantitative (analytical) monitoring for wastewater discharges from pit dewatering. See
Part 11I. Section B. of your permit.
Item IV. Operation and Monitoring Plan
Mine sites that conduct active dewatering in close proximity to wetlands are required to develop
and follow an operation and monitoring plan to ensure the dewatering activity is not impacting
adjacent wetlands. Please provide this office with a copy of the 0 & M plan. If one has not been
developed for this site, you are hereby notified that an O & M Plan is required. You may contact
Linda Willis at 910-796-7343 for more information concerning the 0 & M Plan requirements.
Requested Response
You are directed to respond to this letter in writing within 30 calendar days of receipt of this
Notice. Your response should include the reason for not notifying the Division of the sale of the

Comment: A sample for TSS was taken from the outfall at the east end of the mine
pit. A ditch system is conveying wastewater from the pit to adjacent wetlands. The
discharge was extremely turbid due to stormwater runoff from the road around the east
side. Turbidity was conducted at WiRO, the result was 409 NTU. The owner sold to
another entity and the permit was not properly transferred. The permit was transferred
without notification to the Division or appropriate transfer of ownership.

Comment: Mr. Watkins has sold the mine site to Mr. Keith Stark with Wilmington
Materials. I advised Mr. Watkins that it is his responsibility to notify the Division with a
name/ownership change form and that the permit would remain in his name unless he
follows through. He advised me that the new owner was going'to handle this
paperwork, I advised Mr. Watkins that we have received nothing and that compliance
with the NPDES permit still resides with him. He promised to work on getting the permit
transferred.

Comment: A sample for TSS was taken from the outfall at the east end of the mine
pit. A ditch system is conveying wastewater from the pit to adjacent wetlands. The
discharge was extremely turbid due to stormwater runoff from the road around the east
side. Turbidity was conducted at WiRO, the result was 409 NTU. The owner sold to
another entity and the permit was not properly transferred. The permit was transferred
without notification to the Division or appropriate transfer of ownership.
