On 5/22/2012, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG020516. In accordance with your request, Certificate of Coverage
Number NCG020516 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

In accordance with your application for discharge permit received on January 19, 2000 we are
Forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

Dear Mr. Long:
A stormwater inspection was carried out on August 28, 2009 by Myrl Nisely of the Raleigh Regional
Office (RRO) to determine compliance with the above permits and to gain an understanding of plans for
the future of the mine site. Your help during the inspection was appreciated.
The older of the two permits, NCG020403 expired in 1997, but was never rescinded nor renewed.
Annual fees were no longer paid after 2003. It appears that a more recent permit, NCG020516, may
have been issued 3/31/2003 to supersede or replace the first one. It, too, expired in 2004 without being
renewed, although annual fees continued to be paid through May of this year. As long as the Land
Quality (LQ) permit for this site remains open, these stormwater permits will also be kept in force.
During this inspection you stated that you intend to let the LQ mining permit lapse when it expires on
December 31, 2009. That being the case, both of the stormwater permits are eligible for rescission,
based upon the site conditions observed during this inspection, as described below. Provided you
intend to cease mining, you may request rescission of the stormwater permits. Therefore, soon after
December 31, you must submit a letter requesting rescission of NCG020403 and NCG020516 to this
office (address in footnote) to begin the rescission process.
There were no previous inspections by DWQ at this site. Mining activity was terminated late in 2004.
When active, mine dewatering was taking place, an activity that required quarterly monitoring along
with semi-annual qualitative monitoring of the stormwater discharge point. No records exist to show
that monitoring took place. That is the reason this is a Notice of Violation letter. Enforcement for
failure to follow the permit would be in order if the LQ permit were remaining open. However, with
closure about to occur, this course of action will not be pursued.
The site topography is such that stormwater runs into the ponds created from the mining. Anygjscharge
would occur after the water travels through a long series of ponds and vegetated channels to NorthCarolina

a release point at the northwest corner of the site. Self vegetation has occurred except on many of the
banks, around'0o ds 1 owever, any bank erosion would enter the pond and would not be an
environmental threat to Arthur's Creek, the ultimate receiving stream.
Again, please submit a request for rescission of these two permits once the LQ permit ends. If you have

Stormwater permits NCG020403 and NCG020516
This 239 acre sprawling mine site has been worked by a series of owners since at least the 1920s. Henry Long has a
Land Quality permit for 19.4 acres that expires Dec. 31, 2009. He plans to allow that expiration without any renewal
effort. Much of the gravel taken was for construction of 1-85 and 1-95. The last active mining occurred in late 2004.
The site is a series of holes dug randomly in the search for acceptable material. The result is a great many ponds, large
and small. Some are connected, but many are not. The site has largely self vegetated except for the banks of many
ponds. Any bank erosion will simply go into the pond. There is no chance of sediment being carried offsite, as explained
further below. Learning of Mr. Long's decision to let the permit expire, Land Quality will make a return visit to determine
what reclamation activities will be required before the site is returned to the land owners Sand Ridge Development Corp.,
Inc, for leasing as a hunting and fishing site.
Rainfall is captured by the ponds, and if there is ever enough to leave the site, it travels through the ponds to the
Northwest end of the property to Arthur's Creek. There is considerable time and distance for settling of solids, and the
water travels through wetlands and other vegetation that further removes solids. There is no negative environmental
impact by stormwater discharging at this time. Once the LQ permit expires, these stormwater permits should be
rescinded.
Mr. Long mistakenly thought that sending in a stormwater fee every year kept the permits active. He relied on
consultants to handle permit details, but there are no records of monitoring, A Notice of Violation letter will be issued with
instructions for him to request rescission of both stormwater permits after the Land Quality permit expires.
