The Asheville Regional Office staff have reviewed your request dated April 3, 2019, for a determination that
stormwater discharge outfall (SDO) 002 be granted representative outfall status for stormwater outfall 005. Based
on information and maps provided and a site inspection conducted on May 7, 2019, we are approving this request.
In accordance with 40 CFR § 122,21(g)(7), you are authorized to sample outfall number 002 as a representative
outfall. 'this approval is effective with the next sampling event. We also want to remind you that the permit still
requires Qualitative Monitoring be performed at all SDOS, regardless of representative status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the tiered
response provisions of your permit must address all drainage areas represented by SDO 002, where appropriate.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that
representative outfall status has been approved. if changes in drainage areas, structures, processes, storage
practices, or other activities occur that significantly alter the basis of this approval, representative outfall status
may no longer be valid. You should either resume sampling at all SDOs, or reapply to this office for representative
outfall status based on updated information. if you have any questions or continents concerning this letter, please

Vulcan Construction Materials, LLC (Vulcan) operates its Spruce Pine Quarry facility in
Mitchell County, North Carolina Region under NPDES General Permit — COC No. NCG02051 1,
As Specified in Section D of the NPDES General Permit, we are Living notice that Vulcan
inadvertently failed to obtain a pit water sample from 001 Outfall for the 2°`I quarter of 2018.
Improvements have been made to avoid this from happening again, including re-training of -
employees responsible for obtaining this sample. In addition, Vulcan is working toward making
improvements to Our pit water discharge, which will yield a better water management system.
Our projected target range to have the new system in place is September 2018.
As required under Section D of the permit, Vulcan will continue to perform quarterly monitoring
until we receive four consecutive quarterly samples, for which the results are below the limit for
all parameters.

The Division has reviewed your request for Representative Outfall Status (ROS) at the subject
facility. Based on a site visit and information provided, the request has been approved with the
following modifications:
• Removal of 148-002 from the site plan and monitoring schedule as indicated in the
Inspection Report dated March 21, 2011. This discharge does not meet the definition of a
stormwater outfall.
• Outfall 148-006 is representative of 148-003
The ROS is effective with the next sampling event.

Inspection Summary:
DWO staff was met on site by Jeff Panther and Mark Curtis. A tour was conducted of the facility, observing the
stormwater conveyances and outfalls and site conditions. During the visit, the SPPP manual was reviewed, operational
activities and existing stormwater exposures were discussed. At the time of the inspection the site was found to be in
compliance with the permit. The inspector noted that the facility appeared to maintain good housekeeping practices and
records were found to be in good order. Additional attention should be taken to assure records pertaining to weekly and
post one -half -inch rain event inspections are properly recorded.
The inspection findings indicated that Mr. Panther and his staff are doing an excellent job maintaining stormwater BMPs
and taking a proactive approach.
Upon review of the existing outfalls, it was determined that Outfall 148-002 does not meet the definition of an outfaii, as
the discharge does not reach surface waters. Sampling of this discharge is not required.

Enclosed please find a copy of the Compliance Evaluation Inspection reports from
an inspection conducted on May 22, 2006 by Starr Silvis and me. We were pleasantly
greeted by Mr. Ronny Godman of your staff and guided throughout the inspection.
Please note that the Spruce Pine Quarry currently is operating under two separate
stormwater permits. Evidently when Vulcan purchased the site from Mayland Stone in
March of 1999, Mayland failed to request rescission of their NCG020036 stormwater
permit. Vulcan also requested permit coverage and was granted NCG020511 for
stormwater coverage at the same site.
In order to rectify our permit system, please request rescission of one of these
permits. It is your choice as to which permit you wish to rescind. However, please make
sure that the appropriate owner, Vulcan, is indicated on whichever permit you retain.
Permit rescissions and change of ownership is handled in Raleigh through our
Stormwater Permitting Unit, attention to Bradley Bennett, 1617 Mail Service Center,
Raleigh, NC 27699-1617.
The Spruce Pine Quarry was operating in very good condition at the time of
inspection. Maintenance of best management practices was evident and attention to the
majority of permit conditions has been good. However, the Spruce Pine Quarry was
found to be deficient with some of the requirements of the general stormwater mining
permit. Establishing satisfactory compliance with the permit will require implementation of
measures that fulfill all terms and conditions contained therein. In moving toward the goal

locations and drainage areas.
1. Pit Dewatering — Outfall 001 — This outfall discharges the excess water storage
from the pit. Drainage area is 25 acres and surface is granite deposit and
vegetated overburden slopes.
2. Vehicle Maintenance — Outfall 002 — This outfall treats and discharges run
from the vehicle maintenance area and part of the stockpile area. Drainag
is 2.7 acres and surface is stabilized with crushed stone.

3. Land Disturbing — Outfalls 003 — Collects and treats the stormwater runoff fr to
the overburden storage area. Drainage area is 42 acres and surface is active C
placement with some vegetated slopes. ''
4. Land Disturbing — Outfalls 004 — Collects and treats the stormwater runoff
the plant and stockpile areas. Drainage area is 4.45 acres and surface is
stabilized with crushed stone.

Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

Monitoring Extension Request

• The SPU met on several occasions with the North Carolina Aggregates Association (NCAA) through the
NCG020000 renewal process, beginning in August 2009. Vulcan Materials is a member of NCAA, and a
representative of the company attended the initial meeting.
• The provision that triggers monthly monitoring for failure to sample came out of discussions with industry
representatives during these meetings and was incorporated into the final permit as a result.
• The definition of representative storm event also changed as a result of these discussions with NCAA to
increase sampling opportunities during operating hours. A representative storm event in NCG020000 now
only requires a period of 48 hours of no rain prior to the event.
• An advance copy of the final permit was forwarded to.the Executive Director of the NCAA on December 29,
2009 and subsequently distributed t0'NCAA members. The final NCG020000 permit.was available to all
permittees on the DWQ website when it became effective in January 2010.
• Stormwater sampling requirements are not new with this renewal, even though sampling is now semi-
annual (instead of annual in the previous permit). Vulcan should have already been familiar with the
stormwater sampling requirements.

We are writing in response to your request for an extension to collect the first semi-annual stormwater
sample under this permit. In your letter of June 23, 2010, you requested an extension to August 31" to comply with
sampling requirements at several Vulcan facilities across the state. Your letter cited reasons to support the request
that included:
• Hard copies of the new NCG020000 permit not being received until mid -February, when the permit had
become effective January 1, 2010;
e Spotty weather patterns resulting in storm events during non-ol erating hours that prevent sample
collection; and
The need for additional time to train Sampling Personnel on significant changes in the permit.
One of the reasons for your request was the new provision that monthly monitoring will apply for the
remainder of the permit term, should the mine ever fail to collect a sample during a scheduled monitoring period
(footnote 1 of Table 1 in Part II1). While considering your request, the Stormwater Permitting Unit (SPU) realized this
provision may unfairly affect permittees who obtain coverage under NCGO20000 in the middle of a monitoring
period. The SPU has written up guidance to address this situation and related conflicts in the permit text (see
attachment).
Recognizing there were possible conflicts with this provision that our guidance now addresses, DWQ will
grant your request for an extension to collect a.stormwater sample by August 31, 2010. However, we note that
Vulcan Materials Company should have been prepared to comply with permit monitoring requirements prior to
receiving hard,copies of the permit in mid -February. Specifically:
