Attached is my renewal application for the above referenced NPDES permit. 1 have been
working with the Division of Land Quality to release a portion of acreage now permitted at the
Spruill Mine, While I have been given verbal assurance that the release will be approved, I
cannot wait any longer to submit this application for renewing my NPDES permit. However,
once I have received written release from Land Quality, I will submit a short narrative describing
this significant change in my operations covered by my NPDES permit as required in the
Supplemental Information Required for Renewal of Individual NPDES Stormwater Permit.

SUPPLEMENTAL INFORMATION REQUIRED FOR RENEWAL OF INDIVIDUAL
NPDES STORMWATER PERMIT
Two copies of each of the following shall accompany this submittal in order for the application
to be considered complete:
(Do not submit the site Stormwater Pollution Prevention PIan)

1. A current Site Map from the Stormwater Pollution Prevention Plan. The location of
industrial activities (including storage of materials, disposal areas, process areas and
loading and unloading areas), drainage structures, drainage areas for each outfall,
building locations and impervious surfaces should be clearly noted.
2. A summary of Analytical Monitoring results during the term of the existing permit
(if your permit required analytical sampling). Do not submit individual lab reports.
The summary can consist of a table including such items as outfall number,
parameters sampled, lab results, date sampled, and storm event data.
3. A summary of the Visual Monitoring results. Do not submit individual monitoring
reports. The summary can consist of a table including such items as outfall number,
parameters surveyed, observations, and date monitoring conducted.
4. A summary of the Best Management Practices utilized at the permitted facility.
Summary should consist of a short narrative description of each BMP's in place at
the facility. If the implementation of any BMP's is planned, please include
information on these BMP's.
5. A short narrative describing any significant changes in industrial activities at the
permitted facility. Significant changes could include the addition or deletion of
work processes, changes in material handling practices, changes in material storage
practices, and/or changes in the raw materials used by the facility.

If the final year analytical monitoring of the existing permit term has not been completed
prior to filing the renewal submittal, then the last years monitoring results should be submitted

Disposal Areas: Clean mine overburden as well as from the construction sites and public roads is back hauled to the mine to be used to reclaim
the sandpit shorelines to the appropriate slopes as mandated by the Spruill Mine Permit No. 27-42 and to reclaim a portion of the mine back to

BEST MANAGEMENT PRACTICES
Mine water is pumped in an wooded area next to the sandpit to be absorbed and filtered, and any water that flows or seeps from the wooded
area into the field ditch next to the mine takes that water eastward where it flows south in an intersecting field ditch and then in a collector
ditch. The water flows down that collector ditch to and then under Guinea Road (SR 1214) and then flows along the ditch beside the road into
the swampland next to the road to the south. From the swamp the water flows into Roland Creek, to Tulls Bay, and finally into the Currituck
Sound. It is worth noting, that the Currituck Sound in the recent past has become dramatically more saline and freshwater runoff does not
impact that body of water as freshwater runoff might in other North Carolina sounds.

NCG020508 April 11, 2012, the Division of Water Quality (DWQ) is forwarding herewith the reissued
Certificate of Coverage and stormwater General Permit, This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.)
The following information is included with your permit package:

• A copy of a Technical Bulletin for the General Permit
• Copies of the Discharge Monitoring Report (I)MR) Form

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with

Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by
DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the

Ouality (DWO) is forwarding herewith the reissued stormwater general permit. Please review the new permit tD familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater.. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms -wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWO. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Dear Mr. -Spruill:
Your recent request to have the above referenced mining permit
modified has been approved. The modification is to allow the mine
excavation to extend to a depth of 50 feet below the surrounding
natural ground surface. This approval is contingent upon the
restriction that dewatering activities not occur at this site while
dewatering activities are occurring at the neighboring Flora Pit, Mining
Permit No. 27-02. Devvatering activities shall not be conducted
simultaneously at both mine sites.
Please attach this approval letter to your existing miningpermit
for future reference. The expiration date, mine name and permit
number on the permit document shall remain the same as before this
modification.
The issuance of a mining permit and/or any modification to it
does not supersede local zoning regulations. The responsibility of
compliance with any applicable zoning regulations lies with you.
As a reminder, your permitted acreage at this site is 58 acres
and the amount of land you are approved to disturb is 17.7 acres.

general permit. This permit is issued pursuant to the requirements of North Carolina General Statute

If any parts, measurement frequencies or sampling requirements contained in this permit are
