A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

Hanson Brick is notifying the Department that during the month of August 2015, mine dewatering samples
collected at Outfall No. 3C resulted in exceedances for Turbidity. Samples were collected on 8/26/15, and
lab results were received on 8/28/15.
Even though the TSS concentrations are very impressive at 6.6 mg/L, the turbidity results were higher in
the downstream than the upstream by 73 NTU (upstream = 366 NTU, downstream = 439 NTU). We will
continue to do all we czin to keep TSS concentrations down and research methods to reduce Turbidity.

Hanson Brick is notifying the Department that during the month of October-2014, mine
dewatering samples collected at Outfall No. 3C resulted in exceedances for Turbidity. Samples
were collected at 10:00 AM on 10/09/14, and lab results were received on 10120/14. Please see
below results for all parameters.

Following a site visit, the following was found-
- The approved coagulant was pumping into the water pump inlet correctly.
- The approved flocculent was pumping into the mixing chamber at the discharge end of
the 3-inch water discharge pipe correctly.
- However, the 3-inch discharge line had separated half way to the discharge point which is
actually the inlet end to the secondary treatment pond. This could not be readily seen due
to all the sericea le-spedeza growing around the pipe. Thus, the solids were dropping in
the middle of the pond rather than the start. The pipe has since been repaired.
- Although the secondary pond perimeter was planted with the approved grass/lespedeza
seed schedule in 2010, it seems that the lespedeza took over, and there's not enough
ground cover to control run-off entering the secondary pond.
- The secondary pond needs the accumulated sediment removed in the near future.

Hanson will continue to sample monthly for the life of the permit should there be a discharge.
Following repair of the 3-inch discharge line, the water has been treated properly in the mixing
chamber at the end of the discharge line, and turbidity levels appear to have fallen. Should you

It is the understanding of the Division that Boren Brick — Gulf Mines I and 2 were reclaimed and
released, and storinwater discharges associated with Mine 3 is now covered by permit NCG020504. In
accordance with this information, NPDES General Permit NCG020101 is rescinded, effectively
immediately.
Please be advised that this permit rescission is based wholly upon the activities which would require
general permit coverage at the site have ceased or been eliminated, Division staff has not visited the site
to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging
stormwater to waters of the State without a valid NPDES Permit will subject the responsible party10 a
civil penalty ol' up to $25,000 per day. Enforcement action will be certain for persons that have
voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in
retrospect, you feel the site, still requires permit coverage, you should notify this office immediately.
Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first
apply for and receive a new NPDES Permit.
