The release area isn't an issue, however, there are a couple places where they have disturbed buffer that should not have been touched. One of these areas was previousi determined to be an isolated wetland (in 2007). As such, they had the wetland delineated and were supposed to keep a 50 foot undisturbed buffer around it. This isolated wetiand was surrounded by mine excavation area. Long story short, they have disturbed the area and were issued a notice on noncompliance. They have since had the Corps out (see attached) and the Corps has determined that the area is not a wetland. I need to know whether DWQ agrees that this isn't a wetland and how you want to handle this. Your call will probably affect how we handle things on our end (whether they can modify to mine the area or whether they need to back off again). I need to give them an answer by mid -November (say November 14). I've attached the Corps determination, plus a couple of pictures Gary took of the area in question.
