After looking through our records it was discovered that your NCG020444 permit for Britton Pit Mine is still in expired
status. I e-mailed the renewal form to you back in December of 2011. As of today you request was not received yet. In
case that you did not receive the renewal form I am attaching it again for you. Your contact in Central office in Raleigh
for renewal issues would be Jennifer Jones (919-807-6379).
Please be reminded that any permittee that has not requested renewal at least 180 days prior to expiration, or any
permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to
expiration, will be subject to enforcement procedures as provided in NCGS 143-2153.6 and 33 USC 1251 et. seq.

Brian,
BIMS shows that this permittee is paid -up through 2012, and has been paying his annual fees since 2002, but his
status is 'Expired'. Perhaps he has not received, or has not responded to, our notification that he request
renewal of his coverage. There is no COC past March 17, 2000 in our file.
There is no paperwork in the SPU file suggesting that he requested rescission of the permit coverage. Can you
remind me how to proceed to update RIMS on the status of this permit? I think I need to convert him from
'Expired' to 'Active', right?
And Samir would like me to send him and the permittee a new, updated COC. Do you know where / can find
that?

This e-mail is just a reminder of our telephone conversation on Monday, November 28, 2011.
Mr. Jeff Rose w/ Rose Brothers Paving (252-209-8144) contacted me asking about status of his mining permit. His mine
is located in Bertie County under name Britton Pit Mine (NCG020444). After looking in BIMS I realized that Mr. Rose is
current on his annual fees however, his permit shows as expired as of November 30, 2004. Somehow he did not get
renewal COC for 2004 and 2009. Mr. Rose is planning to start with dewatering of his mine and he asked what he needs
to do in order to proceed. We both agreed that development of an 0&M plan prior to start of dewatering would be a
good idea. I will contact Mr. Rose and request an O&M plan.
You mentioned that you will either mail Mr. Rose new COC or ask Brian to do so. I would greatly appreciate your help.

Mr. Rose,
I contacted Mr. Ken Pickle in DWQ Central office in Raleigh and asked about your permit. Somehow renewal certificates
were not mailed to you for last two renewal periods. Mr. Pickle said that he will make sure to send you the updated
Certificate of Coverage (cover letter of NCG020444 permit). The renewal issue is only an administrative issue and as
long as you are paying your annual fees, you can continue to operate your mine.
After checking your permit further more we realized that the permit was issued with option of dewatering if desired. No
application or fee is needed in order to start dewatering as I might have mentioned in our telephone conversation,
however since this permit was issued originally in 1990's the DWQ will need an approved Operation and Maintenance
(0&M) plan prior to start of dewatering.
If you have any questions or need any help in developing the 0&M plan, please feel free to contact me.

In accordance with your application for discharge permit received on November 25. 1997, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
