On 12/28/2009, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG020347. In accordance with your request, Certificate of Coverage
Number NCG020347 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwatcr to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the StatCs
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES pen -nit coverage.

Both of these mines (Sutton -Pit #2 and Sutton -Pit #4) are reclaimed and mining permits closed back in 2009. Both of
them are turned into the subdivision ponds. We here in Washington Regional office believe that these permits can be
rescinded.

Enclosed please find a copy of the Compliance Evaluation Inspection form from the inspection conducted
on July 20, 2007. The Compliance Evaluation Inspection was conducted by Kristin C Jarman of the
Washington Regional Office. The facility was found to be in Compliance with permit NCG020347.
There is no dewatering going into the retention pond, but if dewatering does take place samples will have to
be taken and qualitative monitoring done (see permit for details).
Please refer to the enclosed inspection report for additional observations and comments. If you or your staff

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:

permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Dear Mr. Sutton:
We received your application for permit coverage under General PermitNCG020000 on April
26, 1999. This letter is to inform you that legislative changes effective January 1, 1999 resulted in a
change to the fee structure for all of the Division of Water Quality's permits. In the case of NPDES
general permits the application fee of $400.00 has been replaced with an annual fee of $80.00. New
applications must submit $80.00 fee along with their application package.
Your application package was submitted with the previous application fee attached. In order for
us to handle this change with a minimal amount of confusion, we are returning your application package,
including the $400.00 fee, and asking you to resubmit the full package along with a new check for
$80.00. We apologize for this inconvenience and hope you can understand our desire to keep all permit
application packages together without having the process of trying to match up forms and checks that
might come in at separate times.
