On November 12, 2008 Mitch Hayes of the Raleigh Regional Office conducted a compliance evaluation
inspection of the subject facility. The assistance of Howard Whitley was gratefully appreciated. Please find the
attached Basin Wide Information Management System (BIMS) inspection checklist summarizing each inspection.
Below is a list of recommendations and findings developed from the inspection:
1. The subject permit became effective January 19, 2005 and will expire December 31, 2009. A request for
permit renewal with fees must be made 180 days prior to expiration in order to discharge after the
expiration date. Please submit all information required on the Notice of Intent (NOI) to the address listed
at the bottom of the NOI. The website for the NOI can be found at

2. The facility has two stormwater retention ponds. The upper pond is upslope of the bottom pond and
catches most of the sediment runoff. Clarified water in the upper pond is conveyed to the bottom pond by
underground piping. There is no discharge point for the bottom pond. There was no indication of
sediment deposition around the perimeter of the bottom pond. Please explain in a written response
whether: 1) the bottom pond meets the definition of 10-year design storm without discharging or 2) if
engineering reports for the upper and lower ponds are unknown.
3. A private consultant, Patrick Shilling, handles monitoring. The last analytical data results were on October
15, 2006. All qualitative monitoring data was up to date and available for review.

for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.

PROJECT INFORMATION
The Brogden Road Pit Mine in Johnston County, NC is located on property owned by
James Paul Edwards, Inc. Approximately 73 acres are under permit with approximately
42 acres allowed for disturbance. For the next 10-years, disturbance is anticipated to be
increased to 60.7 acres. The site also contains a 2 acre LCID Landfill.
The proposed expanded mine area which will increase the allowable disturbance is
located in the farm field in the south-westem portion of the property. At this location,
the ground is relatively flat. Excavation is initially conducted to slightly above the water
table and then a second excavation occurs below the water table. No runoff: occurs from
this mine area and no erosion control is warranted for this excavation.
