On 4/13/2012, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG020283. In accordance with your request, Certificate of Coverage
Number NCG020283 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Dear Mr. Brown:
Staff from the Division of Water Quality, Surface Water Protection of the Raleigh
Regional Office conducted a site visit to Triangle Brick Company, 6523 Highway
55 South; Durham on December 29, 2008. The assistance and cooperation of Mr.
Ricky Merritt was very helpful and appreciated during the inspection.
The following observations were as follow:
The site is only being used as a corporate office and stockpile for Brick
inventory for sale that is brought in from the Merry Oaks location in Chatham
County and Wadesboro location in Anson County. No mining operations are
being performed at the 6523 Highway 55 South location.
The pond on the property is the old mine site. The site has two stormwater
outfalls that discharge to an unnamed tributary to long Branch. The only
stormwater exposure on the site is brick inventory and the corporate office
building.
The Raleigh Regional Office, Surface Water Protection recommend that Triangle
Brick submit a request for permit rescintion of permit NCG020283 for the 6523
Highway 55 South location. If rescintion of your permit is granted. Triangle Brick
must reapply for a Certificate of Coverage as required by NCG020000, before any
mining activity is conducted at the 6523 Highway 55 South location.

Triangle Brick Company , hereby requests, the Division of Water Quality rescind the
above described permit. This is based on your inspection report of December 29, 08
and subsequent recommendation, as stated in your letter of January 27, 2009, to Mr.
Howard Brown, Jr. of this Company.
This request is also based on discussions with you and your observations that
operations have ceased at the Durham Facility, the storage/manufacturing buildings
have been demolished and the area is solely used for sales/administration and final
product(brick) storage therefore stormwater monitoring is no longer required.
It is also our understanding, that other than this letter request and based on the above,
that no further action is required by Triangle Brick other than submittal of this formal
request. If any further actions are needed, in order to rescind -the hermit, or as a result of
actually rescinding the permit please advise before proceeding.
We, at Triangle Brick Company, appreciate the Division working with us on this request
and expect to receive written confirmation of this rescintion.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983,

• A copy of a Technical Bulletin for the general permit

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
enforcement authority of the Division of Water Quality. Your payment should be sent to:

In accordance with your application for discharge permit received on October 27, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division'
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
The stormwater staff of the Water Quality Section is currently looking into the issue of colloidal
materials. This includes clay mining sites and brick manufacturing facilities. Upon completion of the review,
DEM may choose to reopen the general permit or require coverage under another individual or general permit if
the existing permit is determined not to be sufficient to protect water quality.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of' Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other federal or Local governmental permit that may be required.
