In accordance with your request, Certificate of Coverage Number NCG020283 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. The assistance and cooperation of Mr. Ricky Merritt was very helpful and appreciated during the inspection. The following observations were as follow: The site is only being used as a corporate office and stockpile for Brick inventory for sale that is brought in from the Merry Oaks location in Chatham County and Wadesboro location in Anson County. No mining operations are being performed at the 6523 Highway 55 South location. The pond on the property is the old mine site. The site has two stormwater outfalls that discharge to an unnamed tributary to long Branch. The only stormwater exposure on the site is brick inventory and the corporate office building. The Raleigh Regional Office, Surface Water Protection recommend that Triangle Brick submit a request for permit rescintion of permit NCG020283 for the 6523 Highway 55 South location. If rescintion of your permit is granted. This is based on your inspection report of December 29, 08 and subsequent recommendation, as stated in your letter of January 27, 2009, to Mr. Howard Brown, Jr. of this Company. This request is also based on discussions with you and your observations that operations have ceased at the Durham Facility, the storage/manufacturing buildings have been demolished and the area is solely used for sales/administration and final product(brick) storage therefore stormwater monitoring is no longer required.
