Our records indicate that you have been issued a Stormwater.General Permit and a Certificate of
Coverage for your facility. These permits have specific conditions that must be met in order for you to
be in compliance with your permit. It is your responsibility, as the permit holder, to read and comply
with the conditions contained in the permit.
It is our responsibility, as the issuing authority, to make sure that the operation and maintenance of
your facility complies with the conditions contained in your permit. To assist you in complying with
these conditions, we are attaching a Technical Bulletin specific to your permit requirements. We are
currently in the process of developing our inspection schedule. Therefore, you should have all of
your records up to date as we may be contacting you in the near future to set up an inspection of your
facility.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the stale of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983,
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.

Washington County has received the "Notice of Violation of the Mining Act of 1971 " in regards
to Mining Permit No. 94-11 for violation of reclamation of the Washington County mine site near
1-lwy. 308. As previously discussed with your Staff the mine has not been utilized for over a year,
and attempts have been made to complete final reclamation consisting of permanent ground ccl'vcr-
However, due to wet weather conditions we have been ujisuccessful. 'Therefore, Washington
County respectfully requests a sixty (60) day extension to complete the permanent ground cover
and/or vegetation. Weather conditions seem to be providing dryer conditions that will allow the
County to conduct this activity within the next sixty (60) days.

Dear Mr. Smith:
This is. to advise that -the County of --Washington is in
violation of Reclamation Condition No. 4 of Mining Permit No. 94-11
for failure to complete final reclamation at the Washington County
Landfill Cap Borrow Site in Washington -County within two (2) years
of completion of mining. The Annual Reclamation Report submitted
to this office in 1996 stated that mining stopped at this site on
October 8, 1994. In accordance with the permit and the Mining Act
of 1971, final reclamation of the entire mine site should have been
completed by October 8, 1996. An inspection by personnel of the
Land Quality Section's Washington Regional Office on March 25, 1997
revealed that although the site had been backfilled, an adequate
permanent groundcover has not been established do all areas
affected by mining activities at this site. Expiration of the
permit only precludes further mining operations; reclamation
requirements continue to remain in effect. Section 74-56 bf the
Mining Act of 1971 mandates initiation of bond forfeiture
proceedings for failure to reclaim in accordance with the
reclamation plan. Also, civil„penalties of up to $500.00 per day
for each day of the violation may be assessed under G.S. 74-64.

Please contact Ms. Judy Wehner, Assistant State Mining
Specialist, immediately at Land Quality Section, P. 0. Box 27687,
Raleigh, NC 27611, (919) 733-4574 to indicate your intention to
comply with the Act. Only the issuance of a mining permit, and not
the mere submittal of an application, will enable you to lawfully
resume mining operations. You are required to submit an
application for a new mining permit and it must be approved before
you may continue mining. You may elect to close and completely
reclaim the mine and not apply for a new permit.
To correct the current violations and bring the site into
compliance, you must take the following corrective actions within
the time specified:
(A) If you desire to continue mining operations at the site,
you must:
Complete and file the attached application form for
a new mining permit for this site along with the
required corresponding mine maps. The appropriate
mining permit application processing fee is also
required (see attached fee schedul"e). No mining
operations may be conducted until a mining permit
is issued for this site.
This corrective action must be completed WITHIN 30
DAYS OF RECEIPT OF THIS NOTICE OF VIOLATION.
(B) If you desire to permanently close the mine, you must:
Prepare seed bed for all affected areas. Upon
completion, seed and mulch the prepared areas.
This corrective action must be completed WITHIN 15
DAYS OF RECEIPT OF THIS NOTICE OF VIOLATION.
and
Provide a permanent ground cover sufficient to
restrain erosion on all areas affected for the
purpose of mining as per the approved Revegetation
Plan contained in expired Mining Permit No. 94-11.
This corrective action must be completed WITHIN 90
DAYS OF RECEIPT OF THIS NOTICE OF VIOLATION.-

A penalty may be assessed for violations committed prior to
your receipt of this Notice. A penalty will be assessed for
violations committed after receipt of this Notice. The amount of
the penalty shall be up to $500.00 a day for failure to reclaim the
site in a timely manner and as per the reclamation conditions of
the permit. Should you fail to comply with the terms of this
Notice within the prescribed time frames, additional enforcement
action will be taken. Such action may result in the issuance of an
injunction, initiation of bond forfeiture proceedings or the
imposition of a criminal penalty.
The responsibility for understanding and complying with the
requirements of the Act rests upon the individuals and firms who
are subject to its requirements. The responsibility also rests
with you for notifying this office of your plans to correct the
violations.
The subject site will not be considered in compliance with the
Act until you have obtained a valid mining permit and/or
satisfactorily completed the required reclamation work.
Please do not hesitate to contact Mr. Floyd Williams, Regional
Engineer, at (919) 946-6481 or Ms. Wehner, as noted above,
regarding any questions you might have on this matter.
