On November 22, 2011, Kevin Barnett of the Division of Water Quality, Asheville Regional
Office, performed a site inspection at your facility located off Lyle Downs Road in Macon
County.
The site was unoccupied at the time of inspection, so no file review was performed. It was
discovered during the inspection, that the processing area was unstable and was a source of
sediment to an un-named tributary to Little Tennessee River (Class: B), as was a waste spoils pile
on the opposite side of the creek from the process area. Downstream of the process area were
two ponds which were turbid and contained settled sediments. (one of these ponds may be
offsite on the Tomaszkiewicz property)
A plan to evaluate the streams and ponds, both on and off site must be submitted to the attention
of Kevin Barnett, at the letterhead address. In addition to the stream evaluation, you must also
include a sediment removal plan for any lost material to surface waters (streams and ponds).
This must include the following
a. The Plan must address removal of accumulated sediment from all surface waters.
You must secure an environmental consultant experienced in stream restoration to
assist you with developing your Plan; and obtaining any necessary approvals. It is
recommended that your consultant contact Kevin Barnett of the Asheville
Regional Office for additional guidance during Plan development. The Plan
should include:

In response to your renewal application for continued coverage under stormwater General Permit NCG020000
the Division of Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S.- Environmental Protection Agency, dated October 15,
2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG020000
• A copy of a Technical Bulletin for the General Permit
• Two copies of the Tier 21 Exceedence Discharge Monitoring Report (DMR) Form for Stormwater
• One copy each of the Annual Summary DMR Forms for Stormwater and Wastewater
• Two copies of the Limit Violation DMR Form for Wastewater
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with
respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to
familiarize yourself with all the changes in the reissued permit. If your Certificate of Coverage (COC) restricts
authorization to discharge stormwater only (or other limited terms) based on your original application, or
subsequent modifications to your COC, you must continue to meet these requirements or contact the Stormwater
Permitting Unit to request a modification of this renewal COC.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part II:
• Section B — Language referencing PAMS has been changed. Flocculants may now be used if evaluated
by the Division and administered in accordance with maximum application doses and other requirements.
• Part III:
• Section A — The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the
mining industry, in lieu of a Stormwater BMP Plan.
• Section A - Inactive mines may be inspected on a reduced schedule: at least once per month and after
0.5" (or more) of rain. To qualify, inactive mines must possess an "Inactive Renewal" from DLR or certify
to DWQ the site has been stabilized. The permittee must notify the DWQ Regional Office of inactive
status. Discharges from inactive mines must still be monitored on the same schedule as active mines.

• Section B — Revised provisions require that stormwater discharges be sampled twice per year (instead of
annually), and that the sampling results be compared to new benchmark values. (The previous cut-off
concentrations have been removed.)
• Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three
response actions, based on the first benchmark exceedence (Tier One) and the second consecutive
benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
(reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring
shall be done until three consecutive monitoring events show no benchmark exceedences.
• Section B — This part contains a new provision that four exceedences of any benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may
direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the
implementation or installation of specific stormwater control measures.
• Section B —The definition of "Representative Storm Event" (RSE) now allows 48 hours (instead of 72
hours) of little or no precipitation to precede an RSE.
• Section B — Stormwater discharges from a basin designed to contain the 10-year storm must now be
monitored.
• Sections B & C — Failure to monitor according to'permit terms triggers monthly monitoring for the
remainder of the permit.
• Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil & Grease
parameter in the previous permit.
• Section D -- Qualitative monitoring must now be conducted during the same representative storm event
as the analytical monitoring.
• Section D —The permittee is required to keep a written record of his response to problems identified by
his qualitative monitoring observations.
• Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the
permittee may be required by DWQ to perform corrective action.
• Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for
some Stormwater Discharge Outfalls (SDOs).
• Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that
mines change the monitoring frequency, apply for.an individual permit, implement in -stream monitoring,
install or modify structural stormwater controls, or implement other controls.
• Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP and
recorded in the Annual Summary DMR.
• Section E — A lower TSS Wastewater limit for PNA waters is included in the permit.
• Section E — All mining operations are now required to monitor TSS in wastewater effluent discharges (not
only industrial sand mines). However, TSS limits only apply to industrial sand mining operations.
• Section E — Turbidity limits on effluent discharges have been removed; however, turbidity standards still
apply in the receiving waters.
• Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with
dewalering activities that have the potential to drain wetlands or other surface waters).
• Section E — ATC Requirements have been, changed for clarity. These requirements are now outlined for
Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle
Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR).
• Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified. Fecal coliform
monitoring is now required for all process and mine dewatering_wastewater discharges to SA waters.
Part IV:
• Section E — Items 1. and 2. require submittal of a new reporting form: the Annual Summary DMR. This
annual summary of the anal ty ica! monitoring results should be submitted to the DWO Central Office by
March 1 of each year.
• Section E — Exceedences and violations must be sent to the appropriate DWQ Regional Office within 30
days of receipt from the lab.
• Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling
period in the SPPP. "No flow" or "No Discharge" must also be reported on the Annual Summary DMR
form.

RE: Stormwater Runoff Plan
Rose Creek Mine has a stormwater plan to ensure that contaminants do not
enter surface waters via stormwater that comes in contact with any unstabilized
overburden, raw materials, intermediate products, finished products, byproducts
or waste products. This stormwater BMP is also for disturbance areas and
outside process areas.
Rose Creek Mine will maintain a vegetative border surrounding the mining area.
Materials are generally dug out of the mine once or twice a year. After each
mining operation, grass seed will be planted in any disturbed area. Haystraw or
a similar product will be spread to ensure containment of any new runoff.
Rose Creek Mine will maintain storm runoff cutouts originating from the mine
road at sufficient intervals. Currently these cutouts are placed at 12 feet, 48 feet
and and 84 feet from the mine road origination. These cutouts will be inspected
on the 15t of each month to ensure that their capacity is not at or above a level of
50%. A written record of the inspection will be available upon request.

The processing fee for your facility is based on the design or permitted flow,
whichever is appropriate, listed in the first four categories of facilities. Sludge
renewals are based on total acres of land permitted. If the facility covered by this
permit contains some type of treatment works, a narrative descriptor of the sludge
management plan that is in effect at the facility must be submitted with the
application for renewal.
The Environmental Management Commission adopted revised rules on October 1, 1990
(attached), requiring the payment of an annual fee for most permitted facilities. You
will be billed separately for that fee (if applicable), after your permit is approved.
Please be advised that this permit must not be allowed to expire. If the renewal
request is not received within 1.80 days prior to the permit's expiration date as
required by 15 NCAC 2I{ .0211, you will be assessed an automatic civil penalty. This
civil penalty by North Carolina General Statute may be as much as $10,000 per day. If
a permit renewal request is not received 180 days before permit expiration, a civil
penalty of at least $250 will. be assessed. Larger penalties may be assessed depending

on how late the request is made. In addition, any permit renewal request received
after the permit's expiration date will be considered as a new application and will be
required to pay the higher permit application fee.

Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

continued operation of a 20,000 GPD wastewater recycle system which consists of three sediment
settling ponds in series: pond A is 33' by 18' by 25'; B is 15' by 36' by 15'; C is 25' by 12' by
l 5', a recirculating pump system, and all other piping and appurtenances to serve the Rose Creek
Mine and Campground ruby mining operation with no discharge of wastes to the surface waters,
pursuant to the application received on September 14, 1989, and in conformity with the project
plan, specifications, and other supporting data subsequently filed and approved by the Department
of Environment, Health and Natural Resources and considered a part of this permit. .
This permit shall be effective from the date of issuance until November 30, 1994, shall
supersede Permit No. 4784R, which was issued on August 17, 1983, and shall be subject to the
following specified conditions and limitations:
This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.

5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Penruttee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.
6. The sludge generated from these treatment facilities must be disposed of in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the sediment ponds shall not be. less than two feet at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Permittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
14. Any duly authorized officer; employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site and facility at any reasonable time for the
purpose of determining compliance with this permit; may inspect or copy any records that
must be kept under the terms and conditions of this permit; or may obtain samples of
groundwater, surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute I43-215.6.
17. The issuance of this permit does not preclude the Perrrtittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

18. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office,
telephone no. 704/251-6208, as soon as possible, but in no case more than 24 hours or on
the next working day following the occurrence or first knowledge of the occurrence of any
of -the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of pumps, aerators, compressors, etc.
C. Any failure of a pumping station, sewer line, or treatment facility resulting in a
by-pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d . Any time that self -monitoring information indicates that the facility has gone out of
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
19. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time.

Campground, there is an annual administration and compliance
monitoring fee of $150.00 which is required. A bill will be mailed
annually on 'an 'anniversary date to be determined by the Division of
Environment Management. It is usually the first day of the month of
permit issue.
The compliance inspection conducted August 16, 1989, indicated a
the recycle system was not operating as designed. The third settling
pond was overflowing allowing inorganic solids to enter Rose Creek.
As per our discussion the wastewater treatment facility is a

1 . Design Loading 0.02 MGD
2. Type - It is proposed to construct and operate a 0.02 MGD inorganic
solids settling wastewater treatment facility consisting of three
settling ponds in series -and a 3 N.P. recirculation pump to allow
reuse of the wastewater so that there is no discharge to surface
waters.
3. Final disposition of spoils will be stockpiled for use as fill dirt.

PART III - E ALUATIN AND REOONHENDATIONS:
The Asheville Regional Office recommends that a Permit be issued as
soon as possible. The applicants would like to be in operation by the
middle of May, 1978.

An inspection covering= tIe-'operational and maintenance aspects of the waste-
water treatment facility servint the 4K's Star Garnet Mine was conducted on
April 14, 1977. Mr. Max L. Haner, Environmental Chemistry Consultant and
Mr. Jerold W..Ellis', Environmental Engineering -Technician-, conducted the inspec-
-tion. A copy of the report is transmitted herewith.
The inspection -is self=explanatory. The waster -inter treatment facility was
not operational at the time of the inspection and consequently -no effluent samples
were taken.

Geiseral. Statute 143-215 is.North Carolina's . principal water
pollution amtnoT legislation.. It requires - •F at . wastewater, discharges

plans and specifications for a wastewater ,treatrent facility must be
submitted to this Office fov review and aWroval . Approval in the form
of a Permit is granted only after it has been dQtenrdned that the pro-
posed Wastewater treatment faCilxty will.protectr the rec #.virzg strum
in accordance with this State's 147ater Quality Standards''.
Those portions of the water Quality Standards which would.apply to'
your gem mine are that the discharge to the receiving stre m must have '
