In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permiftee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.

December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit

Tubb Mill Quarry, Franklin, N.C.
Dear Mr. Anderson:
As we discussed during your visit to the Tubb Mill Quarry in
Franklin, N.C. on 10-12-95, Harrison Const. Co. would like to con-
struct a new pond system for washing stone at the Franklin site.
The system will be very similar to the one completed at the Dillsboro,
N.C. crusher described in permit #NCG 020247. The dimensions,
capacities, and flow rates will be the same as the Dillsboro system.
(see the attached drawings of the Dillsboro System) Drawing #1 shows
the location at the Tubb Mill Quarry. It will be possible to con-
struct the new ponds at an elevation that will allow stormwater
overflow drainage into the Quarry Pit. The walls of the existing
concrete ponds will be raised and improved to increase their ca-
pacity and to provide a filtered pickup point.

request for authorization to construct.

sent on September 25, 1995 concerning non- payment of 1995 -1996 Annual Fees.
Your letter of September 27, 1995, indicated Permit No. WQ0006077 was replaced
on May 6, 1994, when this recycle system became permitted under NPDES General Permit
No. NCG020245. A review of our files indicated your assessment of this matter is correct.
The revocation letter was generated due to an error within our computer database.
Permit No. WQ0006077 has been removed from our tracking systems. By copy of
this letter I am requesting the Budget Office clear any record of this NOV being issued. As
General Permits do not require the payment of annual fees, we are also returning your
check for $225.00.
We regret any inconvenience this error may have caused. The Division of

(3) settling ponds with approximate volumes of 935,000 gallons, 576,000 gallons, and
396,000 gallons, respectively, a 1,000 GPM replenishing pump with approximately 275
lineal feet of 6-inch force main, a 500 GPM washwatr_r pump with approximately 330
lineal feet of 3-inch force main, associated pipes, valves and appurtenances to serve
the Tubb Mill Quarry -Sand Washing Plant; with no discharge of wastewater to the
surface waters of the State, pursuant to the application received March 30, 1987, and
in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Natural Resources and Community
Development and considered a part of this permit.

This permit shall be effective from the date of issuance until September 1,
1992, and shall be subject to the following specified conditions and limitations:
I. This permit shall become voidable unless the facilities have been constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. In event the facilities fail to perform satisfactorily, the Per.mittee shall take
such immediate corrective action as may be required by this Department.
6. Solids, sludges, or other pollutants remover[ or resulting from the wastewater
treatment process shall he contained and disposed of in such a manner as to
prevent any r_ontnm.inati.on of the surface or ground waters of the State.
7. Diversion or, bypassing of the untreated wastewater from the wastewater, recycle
system is prohibited.
8. The fACil&ieS shall be effectively mnintninecl and operated as a non -discharge
system to prevent the discharge of any wastewater into the surfar_a waters of the
State.
9. Fr.eebonrd in the settling ponds shall not be less than one foot at any time.

This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.
6. The sludge generated from these treatment facilities must be disposed of in accordance with

General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
8. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the three (3) lagoons shall not be less than one foot at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Permittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit; may inspect or copy any records that must be
kept under the terms and conditions of this permit; or may obtain samples of groundwater,
surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.

19. NoncompIiance l otification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone no.
(704) 251-6208, as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of pumps, aerators, compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-
pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self -monitoring information indicates that the facility is not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
20. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of
the wastewater treatment facilities. The operator must hold a certificate of the type and
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. The Permittee must also employ a

21. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its

9/01/92. We have not received a request for renewal from you as of this date.
A renewal request shall consist of a letter .requesting renewal. and completion of
the enclosed application, submitted in triplicate. A processing fee must be submitted
with the request. Please find attached a copy of the 15 NCAC 2H .0205(c) regulations.
The processing fee for your facility is based on the design or permitted flow,
whichever is appropriate, listed in the first four categories of facilities. Sludge
renewals are based on total acres of land permitted. If the facility covered by this
permit contains some type of treatment works, a narrative descr.i.pton of the sludge
management plan that is in effect at the facility must be submitted with the
application for renewal.
The Environmental Management Commission adopted revised rules on October. 1, 1.990
(attached), requiring the payment of an annual fee for most permitted facilities. You
will be billed separately .for that fee (if applicable), after your permit is approved.
Please be advised that this permit must not be allowed to expire. If the renewal
request is not received within .1.80 days prior to the permit's expiration date as
required by 15 NCAC 211 .0211., you will be assessed an automatic civil penalty. This
civil penalty by North Carolina General Statute may be as much as $10,000 per day. If
a permit renewal request is not received 1.80 days before permit expiration, a civil
penalty of at least $300 will. be assessed. Larger penalties may be assessed depending
