Hanson Aggregates appreciates the opportunity to respond to observations noted in your
January 26, 2009 inspection report. On December 4, 2008, Hanson evaluated its Stormwater
Pollution Prevention Plans (SWPPPs) and found that the plans needed improving to better
demonstrate compliance with the permit requirements, including areas noted during your
inspection. As a result, Hanson acquired professional services to update the SWPPPs, including
items noted in 1 (4) of your inspection report.
Please see attached Stormwater Best Management Practices Plan, Employee Manual for
Implementing BMPs, and Plant Manager Responsibilities Summary. Should you have any

This Stormwater Best Management Practices Plan satisfies the requirements specified
in the General NPDES Permit NCG020, Part III, Section A. A "Best Management
Practice" (BMP) is defined as "measures or practices used to reduce the amount of
pollution entering surface waters. BMPs may take the form of a process, activity, or
physical structure". This plan describes Best Management Practices that were used in the
original construction of this facility, 13MI's that have been used in modifications since the
original construction, BMPs that should be followed for any future modifications, and
BMP activities that are used for ongoing inspections and maintenance.
'Phis plan should be reviewed annually to assure that existing BMPs are being
followed, and to determine if any changes are necessary to assure compliance with the
permit requirements. This plan is part of the overall Stormwater Pollution Prevention
Plan.
Item 1. This site has been planned, constructed, and maintained in accordance with NC
Mining Permits 32-07 & 68-06, and specifically in accordance with the 13MPs detailed in
the Sediment and Erosion Control plans submitted and approved as part of the permit
process. Tile Sediment and Erosion Control Plan was designed "to ensure that
contaminants do not enter surface waters via stormwater that comes into contact with any
unstabilized overburden, raw materials, intermediate products, finished products,
byproducts, or waste products located on the site covered by this permit." Any land
disturbance on this site must be in accordance with the current BMPs detailed in the
Sediment and Erosion Control Plan. If any land disturbance is necessary that is not
shown on the plan, the plan must be modified to reflect these changes, and the new plan
is to be submitted to the NCDENR Division of Land Quality for a modification of the NC
Mining Permit. Please refer to the approved Sediment and Erosion Control Plan for
specific descriptions of Best Management Practices associated with Sediment and
Erosion Control Structures.
Item 2. Stormwater Runoff and Runon are managed on this site by the sediment and
erosion control structures as detailed in the Sediment and Erosion Control Plan.
Stormwater runoff and runon shall be diverted into ponds or basins that reduce any
pollutants in stormwater before leaving the site. Some of the stortrtwater is used for
process wash water or for dust suppression. Tile approved Sediment and Erosion Control
Plan shall use appropriate BMPs including but not limited to: vegetative swales, bet -Ills,
channels, use of reclaimed mine areas, and reuse of collected stormwater.
Item 3. The stormwater BMPs described in the Sediment and Erosion Control Plan shall
be regularly inspected and maintained as described in the attached "Employee Manual for
Implementing BMP's". This manual describes specific scheduled inspections necessary
to properly maintain the sediment and erosion control structures on this site. A log shall
be maintained of all inspections. Any required maintenance or repair of sediment and
erosion control structures should be reported to management.
Item 4. The Sediment and Erosion Control Plan that has been approved as part of the NC
Mining Permits 432-07 & 68-06 shall be implemented at this site. No land disturbing
activity not covered by the existing plan shall be performed at this site without making
prior application with NCDENR Division of Land Quality for modification of the plan.
A copy of the Mining Permit and the approved Sediment and Erosion Control Plan shall
be maintained on the site at all times.
Item 5. In addition to the regular inspections and maintenance as described in the
"Employee Manual for Implementing BMPs", this site shall routinely practice Preventive
Maintenance Inspections and Good Flousekeep Practices. Equipment utilized during
mining activity on this site must be operated and maintained in such a manner as to
prevent potential or actual pollution of the surface water or groundwater of the state.
Duels, lubricants, coolants, and hydraulic fluids, or any other petroleum products shall not
be discharged on the ground or into surface waters. Spent fluids shall be disposed of in a
manner so as not to enter the surface waters or groundwater of the state and in accordance
with applicable federal disposal regulations. Any spilled fluids shall be contained and
cleaned up to the maximum extent practicable and disposed of in a manner that does not
allow their entry into the surface waters or groundwater of the state.
Item 6. This site shall provide secondary containment for bulk storage of liquid
materials, storage of Section 313 of Title III of the Superfund Amendments and
Reauthorization Act (SARA) water priority chemicals, or storage of hazardous liquid
substances to prevent leaks and spills from contaminating stormwater runoff. These
secondary containment measures are described in the Spill Prevention, Control, and
Countermeasures flan and in associated tank inspection records.
Employee Manual for Implementing Best Management Practices
The following manual provides instructions for implementing the Best Management
Practices as outlined in the Best Management Practices Plan and in the Storm Water
Pollution Prevention Plan.
The BMP Plan is written and reviewed under the direction of the Environmental
Manager. Specifically, he is responsible for Items 1, 2, 4. and 6. He should review the
requirements of the NPDES permit and assure that they are being met. lie should assure
that the Sediment and Erosion Control Plan associated with the NC Mining Permit meets
the requirements of the BMP Plan. He is responsible for submitting any required
modifications ofthe Sediment and Erosion Control Plan with the Mining Permit to keep
the site in compliance with the NPDES permit. He should respond to any questions,
concerns, or notifications of maintenance or repair issues with any of the BMPs at this
site. lie should regularly review inspection reports of the BMPs and implement any
necessary repairs or maintenance. lie should regularly review the BMP plan and any
records or logs to assure compliance. lie should review the Discharge Monitoring
Reports, and if any samples are out of compliance, take immediate measures to correct
the issue and bring the site into compliance.
Please refer to the attached Plant Manager Responsibilities page for a summary of
the Plant Manager's responsibilities in implementing the BMP Plan. The Plant
Manager is responsible for Items 3 and 5 in the Best Practices Management Plan. All
stormwater BMPs shall be inspected by the Plant Manager or his designee at least once
every 7 days and within 24 hours after any storm event that results in a discharge. He
should follow the guidelines as described in the "Weekly BMP Inspections of'Sediment
and Erosion Control Structures". The Plant Manager is responsible for maintenance and
repair of the BMP structures, under the guidance of the Environmental Manager. Ifany
visible sedimentation is seen leaving the site, corrective action shall be taken to reduce or
eliminate the discharge of sediments. The Plant Manager is responsible for keeping a log
of inspections of'BMPs as well as a log of any maintenance or repairs to BMPs. He
Should also maintain a file containing NPDES and SDO sampling records and test results.
He is also responsible for maintaining monthly rainfall data at this location.
The Plant Manager is also responsible for Preventive Maintenance Inspections and
Good Housekeeping Practices as described in Item 5 of the Best Management Practices
Plan. All reasonable measures must be taken to prevent petroleum products and other
pollutant fluids from entering the surface water or groundwater. Fuel Tanks, lubricants,
and other such materials should be stored and used in accordance with the provisions and
requirements of the SPCC plan.

Staff from the Division of Water Quality, Surface Water Protection of the Raleigh
Regional Office conducted a site visit to Hanson Aggregates, North Durham
Quarry, 1423 Bacon Road, Rougemont. The assistance and cooperation of Mr.
Thomas Thacker was very helpful and appreciated.
I. The following observations were as follow:
1. This mine has three settling ponds. The first accepts silt water from stone
wash. The second pond accepts supernatant from the first pond. The third
pond accepts supernatant from the second pond. The third pond supernatant is
used for dust control at times.
2. All analytical work performed by Tritest. The facility has performed its
analytical and qualitative monitoring as required.
3. This facility does implement its Best management Practices Plan (BMPS) but
does not have a written manual for plan implementation.
4. This facility must create a written employee manual for implementing its
BMPs. The BMP manual must address instructions to all employees and staff
on implementation. The BMP manual must comply with all six items of Part
III Section A: Stormwater Best Management Practices (BMPS) Plan of
Stormwater General Permit NCG020000, A Stormwater Best Management
Practices Plan is required pursant to Part III, Section A, 1-6 of your
Stormwater Permit. Please provide a response to this letter describing how
you are in compliance with these requirements such that new and existing
employees understand expectations.

On February 5, 2008, Vicki Webb and Autumn Hoban, of the Division of Water Quality (DWQ), Raleigh Regional
Office, performed a stormwater compliance evaluation inspection of the quarry. Your assistance and
cooperation was helpful and appreciated. Inspection findings are listed below.

Hanson Aggregates mines sand and rock at the Rougemont - N. Durham Quarry. Stormwater runoff and .
process wastewater generated at such facilities is regulated by General Permit NCG020000. DWQ has
therefore issued Hanson Aggregates Southeast certificate of coverage, NCG020088, which became effective on
January 19, 2005 and expires on December 31, 2009. .
The facility has two stormwater outfalls and operates a closed loop recycle system for process wastewater. The
facility washes product and dewaters to three settling basins that are part of a closed loop system. The spoils at
the site are contained in sediment basins.
The facility was in compliance with permit requirements.
The three settling basins have adequate freeboard and the ability to equalize volume in the basins as -needed,
An engineer's certification was obtained for the recent addition of the third process water settling basin and n'o A
to C is required. Spoils from the clean -out of the settling basins are removed to two sediment basins. The
discharge and stormwater from the two sediment basins flows through stormwater pipes and rip -rap, before
discharging to a nearby creek.

Two outfalls, not previously noted, and not previously identified in the permit, discharge water from the spoils
sediment basins, through a stormwater pipe with a rip -rap pad to a nearby creek. The discharge may be
considered sheet flow, but a review of the outfalls status is warranted prior to the renewal of the permit. These
outfalls may be added upon the next permit cycle.
As part of the inspection, sampling was conducted at outfall #1 that discharges to an unnamed tributary of Little
River. Lab results are attached.
It is our goal to insure the quality of the surface waters of this State.

Inspection Summary:
The facility was in compliance with permit requirements.
The facility has two stormwater outfalls and operates a closed loop recycle system for process wastewater. The facility
washes product and dewaters to three settling basins that are part of a closed loop system. The spoils at the site are
contained in sediment basins.
The three settling basins have adequate freeboard and the ability to equalize volume in the basins as needed. An
engineer's certification was obtained for the recent addition of the third process water settling basin and no A to C is
required. Spoils from the clean -out of the settling basins are removed to two sediment basins. The discharge and
stormwater from the two sediment basins flows through stormwater pipes and rip -rap, before discharging to a nearby
creek.
These two outfalls, are not previously noted, and not previously identified in the permit. The discharge may be considered
sheet flow, but a review of the outfalls status is warranted prior to the renewal of the permit. These outfalls may be added
upon the next permit cycle.
As part of the inspection, sampling was conducted at outfall #1 that discharges to an unnamed tributary of Little River.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Midland Midfloc 1309 at their maximum application rates at the above facilities will not cause toxicity in the respective

appropriate water quality standards in the receiving waters at each location.

Carolina and the U. S. Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be a written petition conforming to Chapter 150E of the North

modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the
Federal Water Pollution Control Act, as amended,

is hereby authorized to operate or continue operation of a treatment system for mine dewatering and/or recycle
systems process wastewater overflow with the discharges of treated wastewater and discharge stormwater from a
facility located at
North Durham Quarry
1532 Bacon Road
Rougemont
Durham County
to receiving waters designated as Buffalo Creek in the Neuse River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I,11, 11I
and IV of General Permit No. NCGO20000 as attached.
This Certificate of Coverage shall become effective April 7, 1995.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

In accordance with your application for discharge permit received on March 17, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management, The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local. governmental permit that may be required.
