POST OFFICE BOX 9296 GREENSBORO, NORTH CAROLINA 27429-9296 Subject: Request for Remission of Civil Penalties Pursuant to G.S. 143-215.6A(f) Enforcement Case File No. PC-2019-0042 Guilford County Dear Mr. Witcher: The Environmental Management Commission's (EMC) Committee on Civil Penalty Remissions (Committee) shall make the final agency decision on your request for remission of the subject civil penalties on March 5, 2020. Based upon your submitted remission request, please see the checked item below: ® The EMC Chairman has considered the written record and determined that an oral presentation is necessary. Please arrive prepared to present your remission request. You will be allotted approximately five minutes to present. Be advised that the Committee cannot consider any information other than that submitted in the original remission request. Please note, the State Bar's Opinion regarding the unauthorized practice of law affects your method of presenting to the Committee: ➢ If you are an individual or business owner and are presenting to the Committee, then you do not need legal representation. However, if you intend on having an individual speak on your behalf regarding the factual situations, such as an expert, engineer, or other consultant, then you shall also be present in order to avoid violating the State Bar's Opinion on the unauthorized practice of law. ➢ If you are a corporation, partnership, or municipality and are presenting to the Committee, then your representative shall review the State Bar's Opinion to ensure they are not practicing law without a license if the representative is not a licensed attorney. Presentation of facts by non -lawyers is permissible. Be advised that the Committee may choose not to proceed with the case hearing if the Committee is informed that a potential violation regarding the unauthorized practice of law has occurred. The Committee will convene at 12:30 PM, or immediately following the closing of the regularly scheduled EMC business meeting. Committee meetings are held in the Archdale Building's Crime Control & Public Safety Conference Room (G24D), located at 512 North Salisbury St. in Downtown Raleigh (see enclosed map). The length of EMC meetings is determined by its agenda, and the amount of discussion given to each topic. EMC meetings often extend into the early afternoon. You are advised to arrive for the Committee meeting no later than 12:30 PM in order to ensure your opportunity to present your case (if applicable) in the event the Committee begins at its appointed time.
