The Turbidity result from our first quarter process water sample was above the action level of 50 NTU's. We had determined that the pit water elevation was lower than normal while we were working on the lower benches in the quarry, which resulted in a turbidity level of 56.32 NTU. We had another discharge in the following quarter and this water sample grab resulted in a much less than the action level of 13.69 NTU. We believe the spike in the turbidity was out of the norm and we have a better handle on it now. Based on a site visit and information provided, the request has been approved and is effective with the next sampling event. We also want to remind you that the permit still requires Qualitative Monitoring be performed at all SDOs, regardless of representative status. The permit also requires that Vulcan continue to sample SDO number 147-001 as a wastewater discharge. By notice of this letter the Vulcan Morganton Quarry site is to sample SDO 147-001 and SDO 147-002 during a discharge event and does not have to gather those samples within the first 30 minutes of discharge. Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that representative outfall status has been approved as well as sampling approval outside the first 30 minute time range. If changes in drainage areas, structures, processes, storage practices, or other activities occur that significantly alter the basis of this approval, representative outfall status may no longer be valid. You should either resume sampling at all SDOs, or reapply to this office for representative outfall status based on updated information. Went through some paperwork and reiterated importance of data transference and documentation. Cleared up some questions regarding these issues. Discussed sampling and no flow reporting. I will get back with them on consensus regarding gathering samples within the first 30 minutes vs not sampling at all if they cannot get sample in first 30 minutes. Vulcan will be requesting Representative Outfall Status (ROS) for Outfall #3 and #4 which during the inspection did not pose any concerns to receiving waters. Once ROS is granted Qualitative and erosion control inspections will continue for outfalls 3# and #4 areas to make sure rills/gullies don't form, etc. Analytical and Qualitative Monitoring are required at Outfalls #1 and #2 which suffice in representing this quarrys discharge to surface waters. This outfall could have a small potential to receive wastewater (WW), but did not appear to be during the inspection. The wash screenings goes through 2 basins to clean stone stockpiles without an apparent discharge. So, as long as they can maintain no discharge of the wash water then SDO #2 is to be analytically monitored as stormwater (SW). SD0#1 is to be analytically monitored as WW. It also had minor sediment deposited at the outfall. The minor deposit at the outfall did not go beyond the outfall small area or impact receiving waters. This outfall will require continuous maintenance since the only treatment unit is a small rock dam. SDO#2 discharge flowed to a small trib through a nice wetland to the river. In your letter of June 23, 2010, you requested an extension to August 315t to comply with sampling requirements at several Vulcan facilities across the state.' Your letter cited reasons to support the request that included: Hard copies of the new NCG020000 permit not being received until mid -February, when the permit had become effective January 1, 2010; Spotty weather patterns resulting in storm events during non -operating hours that prevent sample collection; and • The need for additional time to train Sampling Personnel on significant changes in the permit. One of the reasons for your request was the new provision that monthly monitoring will apply for the remainder of the permit term, should the mine ever fail to collect a sample during a scheduled monitoring period (footnote 1 of Table 1 in Part 111). While considering your request, the Stormwater Permitting Unit (SPU) realized this provision may unfairly affect permittees who obtain coverage under NCG020000 in the middle of a monitoring period. The SPU has written up guidance to address this situation and related conflicts in the permit text (see r, attachment). Recognizing there were possible conflicts with this provision that our guidance now addresses, DWQ will grant your request for an extension to collect a stormwater sample by August 31, 2010. However, we note that Vulcan Materials Company should have been prepared to comply with permit monitoring requirements prior to receiving hard copies of the permit in mid -February. Vulcan Materials is a member of NCAA, and a representative of the company attended the initial meeting. • The provision that triggers monthly monitoring for failure to sample came out of discussions with industry representatives during these meetings and was incorporated into the final permit as a result. • The definition of representative storm event also changed as a result of these discussions with NCAA to increase sampling opportunities during operating hours. A representative storm event in NCG020000 now only requires a period of 48 hours of no rain prior to the event. • An advance copy of the final permit was forwarded to the Executive Director of the NCAA on December 29, 2009 and subsequently distributed to NCAA members. The final NC6020000 permit was available to all permittees on the DWQ website when it became effective in January 2010. • Stormwater sampling requirements are not new with this renewal, even though sampling is now semi- annual (instead of annual in the previous permit). Mine dewatering and/or discharges of process wastewater, including commingled stormwater. Stormwater discharges from other plant areas where the stormwater has contacted areas directly related land disturbance and process areas. Stormwater discharges from on -site vehicle maintenance areas. 5.1 Process Water and Stormwater Sampling/Analysis Program Refer to Table 1 for required sample frequency and analytical parameters. There are two appropriate sampling locations at the Morganton Quarry which will be used to sample various process water and stormwater discharges. Each outfall to be sampled is listed below along with a brief description of each outfall's type of discharge. The discharge from the pond is outfall 147-001. The shop and vehicle maintenance areas drain to the pit and is discharged as process water. Therefore no maintenance sampling is required. Outfalls 147-002 and 147:004 both receive runoff primarily from yard and material stockpile areas. Slace_.47_-= receives flow from the largest area, it is the appropriate sampling point to monitor this type of runoff. Former Outfall 147-003 was the discharge from the large pond northwest of the shop which is now the process water outfall. Future outfalls 005 through 011 may be installed in the coming years. They are all outfalls associated with anticipated land disturbing activity on new property as the quarry site expands. The following table summarizes the total additional outfalls at this site which will not require sampling. The abovementioned outfalls that will be sampled have been linked to the following outfalls based on the overall type of discharge each additional outfall will represent.
