On August 11, 2016, Samir Dumpor and Gary Novak of the Division of Energy, Mineral,
and Land Resources, Washington Regional Office, visited the Clarks Quarry facility and met on
site with you, to perform a compliance inspection of a NPDES General Stormwater permit
number NCG020171 issued to Martin Marietta Materials, Inc.. During the site visit and file
review, it was discovered that site is in very good order and that all required documents
including SPPP and all monitoring results were present. The monitoring results are all
performed in timely manner and are within the benchmark values.
In general, the site is in very good condition, and no non-compliance issues were discovered:

Craven County
The Washington Regional Office (WaRO) Division of Water Quality (DWQ) received an acceptable O&M Plan for
the subject operation on July 1, 2011 (attached). This acceptance fulfills the requirements of the letter sent to
Nuwan Wijesuriya dated December 23, 2010.
Acceptance of the O&M Plan does not relieve the operation from complying with all applicable rules and
regulations. No negative impacts are allowable to wetlands or other waters of the state (including onsite waters of
the state).
Notes: Stormwater Discharges Require Monitoring. If a stormwater discharge occurs, analytical and
qualitative monitoring shall be promptly implemented.
DWQ contact is required prior to any operational changes with the potential to impact waters of the state.

Operation and Monitoring Plan 0&M Plan for
Clarks Quarry — Outfall 002
Description of Plan
The purpose of this 0&M Plan is to ensure compliance with the conditions of the stormwater
Generaf Permit No. NCG020000 in connection with the implementation of outfall 002.
Due to pit expansion south of the rail line at Martin Marietta's Clarks Quarry a logistical need
arose for an additional Pit Discharge Outfall (002). Currently the pit water is discharged through
existing outfall 001 into Caswell Branch, the new outfall (002) will discharge further upstream of
outfall 001 into Caswell Branch. Prior to dewatering of pit water (groundwater comingled with
stormwater) through outfall 002, the water will flow through a pit clarification pond. The pit
clarification pond is designed to enable settling out of sediment particles thereby improving the
quality of water to be discharged, and as the new pit expands it will allow for even more settling
time thereby minimizing the potential to impact water quality.
In addition, a rip rap lined plunge pool is to be constructed at the outlet of the clarification pond
to slow down the discharge flow rate to an acceptable non -erosive velocity prior to exiting
through outfall 002. Both the clarification pond and plunge pool are measures that will aid in
ensuring that no negative impacts occur to the Waters of the State. The pit clarification pond
and plunge pool design has been approved through the Division of Land Resources, land Quality
Section. Design details of the clarification pond and plunge pool are included in the appendix of
this 0&M Plan.
The volume of pit water that will be discharged through outfall 002 will not change from what is
currently and historically been discharged through outfall 001.

Operation Plan
Wastewater/Process water
This site is covered under the starmwater General Permit No. NCG02D000 (COC Number
020171). In the case of outfall 002, only Mine dewatering wastewater effluent limitations and
monitoring requirements will apply since the Central Office of the Division of Water Quality has
agreed that once stormwater comingles with wastewater it is considered to be wastewater.
The following monitoring frequency and requirements will be followed with respect to
discharges from outfall 002:

If turbidity of the receiving stream exceeds these levels due to natural background conditions, the
existing turbidity level shall not be increased. If theturbidity exceeds these levels as a result of .
wastewater discharges, the permittee must immediately institute monthly monitoring for all
parameters. The permit allows the permittee to monitor turbidity in the effluent or up- and
downstream of the discharge point: however, the permittee should consider regular turbidity
sampling up- and downstream of the discharge(s) when feasible to ensure compliance with water
quality standards.
The permittee shall complete the analytical samplings of wastewater discharges in accordance with
the schedule specified in Table 9. Failure to comply with quarterly monitoring in accordance with
permitterms for anyone calendar quarter immediately triggers monthly monitoring for all
parameters forthe remaining permitterm.
The following Monitoring Schedule will be followed with respect to discharge sampling for
outfall002 throughout the duration of the permit and during the permit renewal process:

1. Maintain quarterly monitoring during permit renewal process (unless an exceedence or failure to
manitor prompts monthly monitoring). If atthe expiration of the General Permit, the permlttee has

Stormwater
With respect to stormwater, currently there are no Land Disturbance stormwater outfalls at this
site around the pit areas since the overburden disposal berms around the site are vegetated and
stabilized, and any runoff from the active stripping area flows back into the pit thereby
comingling with wastewater. The Central Office of the Division of Water Quality has made the
determination that once stormwater comingles with process/wastewater it is then considered
wastewater. At which point only effluent parameters associated with wastewater need to be
analyzed during sampling of the discharge. The same would apply to stormwater coming from
vehicle maintenance areas, and at this site the stormwater from the vehicle maintenance areas
does indeed comingle with wastewater.
There is however a stormwater outfall that exists at the office area. There exists a culvert under
the customer truck scale haul road that carries stormwater from a low drainage area offsite. The
stormwater after passing through the culvert flows through a vegetated buffer prior to leaving
Martin Marietta property. We propose to build a basin south of the culvert to treat this
stormwater. It is our intention to build the basin, using machinery onsite, as large and deep as
feasible to allow it to contain the stormwater and have it infiltrate into the ground, thereby
eliminating the runoff. However, we will still continue to monitor this area in case a stormwater
discharge does occur. In which case, we would implement the analytical and qualitative
monitoring requirements as called for by the stormwater General Permit No. NCG020000. More
information can be found in the Stormwater Pollution Prevention Plan (SPPP) that has been
developed for Clarks Quarry.
Monitoring Plan
Plant management shall conduct effluent monitoring as previously indicated. If any of the
effluent limitations is exceeded then the monitoring frequency will switch from quarterly to
monthly for that parameter for the remaining duration of the permit. In addition, any samples
analyzed that exceed a wastewater effluent limit shall be submitted to the applicable Regional
Office of the Division of Water Quality on a Discharge Monitoring Report Form and delivered to
the Division Central Files no later than 30 days from the date that Martin Marietta receives the
sample analysis from the laboratory.
If an exceedance of effluent limits does occur, flocculants on the list approved by the Division of
Water Quality will be used in accordance with the maximum application dose, to bring the
discharge back into compliance with the standards set forth by the stormwater General Permit
No. NCG020000.

reference.
2. A copy of the dischargelsample data collected for NCG020171 since January 1, 2010 (Discharge
Monitoring Reports (DMR), Stormwater Discharge Outfall Forms (SDO), etc.).
3. Designate/highlight on the DLR plan set for clarification, the area(s) of expansion which account for the
24 acres of this modification.
4. Present the details of the existing and proposed wastewater discharge(s).
5. Delineate on the DLR plan set, all wetlands and/or surface waters that are located within 400 linear feet of
the mine excavation(s) and' detail measures, methods, and/or restrictions which prevent wetland or
stream degradation. (Wetland delineations, stream calls, calculations, descriptions, etc_ may be utilized
to present this information.)
Following the receipt of the requested additional information, the DWQ review will resume and upon plan
approval, a written response will be distributed. No dewatering activities associated with the subject permit

The Division of Environmental Management has recently evaluated all existing individual permits for potential
coverage under general permits currently issued by the Division. 15A N.C.A.C. 2H .0127 allows the Division to
evaluate groups of permits having similar discharge activities for coverage under general permits and issue
coverage where the Division finds control of the discharges more appropriate in this manner. The Division has
determined that the subject discharge qualifies for such coverage. Therefore, the Division is hereby issuing the
subject Certificate of Coverage under the state-NPDES general permit no. NCG020000 which shall void NPDES
Permit NC0061191. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the
US Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as subsequently
amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to
you, you have the right to submit an individual permit application, associated processing fee and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please
take notice this Certificate of Coverage is not transferable. Part I1, EA. addresses the requirements to be followed
in case of change of ownership or control of this discharge.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement wastewater treatment or disposal facilities. Construction of any
wastewater treatment facilities will require issuance of an Authorization to Construct from this Division.
Failure to abide by the requirements contained in this Certificate of Coverage and respective general permit may
subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C. Please note that the general permit does require
monitoring in accordance with federal law. The monitoring data is required to be submitted to the Division no later
than January 31 for the previous year in which sampling was required to be performed.

This coverage will remain valid through the duration of the attached general permit. The Division will be

1997 had a turbidity.reading of 104 ntu's; the permitted monthly average limitation is 50 ntu's.
Tliis reading,'along with previously reported permit exceedances, is attributed to excessive rainfall amounts
and the subsequent flooding caused by Hurricane Fran. This storm caused significant erosion and sediment
deposition in around the active pit area. Several corrective measures and considerations have been taken
thus far to bring this facility back into compliance with the NPDES effluent limitations.
Mine dewatering is accomplished by pumping groundwater and stormwater runoff which collects in the pit
sump through a series of clarification ponds prior to discharge to Caswell Branch. These ponds have been
cleaned out and accumulated sediment and vegetation removed from around each of the weir boxes to allow
for more efficient settling. Flocculate additions are also being reevaluated and will be adjusted if deemed
necessary.
It is hoped that measures taken thus far will remedy this situation. Subsequent samples taken on February
4, 18 and 28`h reported turbidity reading of 59ntu's, 10 ntu's and 3ntu's, respectively, yielding a monthly

In accordance with the conditions of General Permit No. NCG020000, this letter is to serve as written
notification as to Martin Marietta's intentions in the aftermath of Hurricane Fran which occurred on
September 5, 1996.
Due to high sustained winds and extensive rainfall amounts, a number of the Martin Marietta Aggregate
facilities regulated by the Washington Regional Office experienced major pit flooding, elcctrical failure and
structural damage. In order to return to normal operating conditions, emergency measures are being
implemented -to remove stormwatcr which has accumulated within the respective pits. During the
dewatering process, discharge flow amounts may be significantly higher than normally reported. An
explanation as to the specifics of the storm will be included on the Discharge Monitoring Report (DMR)
for each facility where a permit exceedance is experienced.

A letter dated April 19, 1995 has been received by this office stating that the required -
Certificate of Completion for the Closed Loop System in the above referenced permit has
not been submitted to your office. Martin Marietta's files indicate that this certification was
submitted with letter dated March 30,1994 to the Permits and Engineering Unit in Raleigh.
An additional requirement of the permit is that Martin Marietta notify the Regional Office
in advance of the start-up of the system. This call. was "made .on' March 25, 1994 to the -.�.
Washington Regional Office. The inspector that handles Craven County was not in at the
time and Ms. Lynn Hardison stated that she would make sure that the appropriate person
- would get the , information. During this -call it 'Was -stated that 'the." system -would be
operational on March 28, -1994.

In accordance with your application for an NPDES general permit Authorization to Construct
received February 3, 1994 by the Division, we are herewith forwarding the subject Authorization to
Construct under the state-NPDES general permit for a'mining facility and one set of final approved plans
and specifications. Authorization is hereby granted for the construction and operation of a closed loop
settling pond system at Clarks Quarry. This Certificate of Coverage is issued pursuant to the requirements
of North Carolina and the US Environmental Protection Agency Memorandum of Agreement dated
December 6, 1983 and as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit
are unacceptable to you, you have the right to submit an individual permit application and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and
binding. Please take notice this permit is not transferable. Part H, EA. addresses the requirements to be
followed in case of change of ownership or control of this discharge.
The Authorization to Construct is issued in accordance with Part H, Section E of NPDES General
Permit No. NCG020000, and shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in Permit No. NCG020000.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Washington Regional Office, telephone number 919/946-6481, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, the Certificate of Coverage, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box

statutes, rules, regulations, or ordinances which may be required by the Division of Environmental
Management or permits required by the Division of Land Resources, the Coastal Area Management Act or

cells designed to receive wash water from the existing process plant. Fines washed from the
crushed stone will settle in these ponds allowing the clean water to be recirculated to the
plant. Certificate of Coverage #NCG020171 under General Permit #NCG020000 currently
covers this facility and includes the operation and maintenance of this type of system. As
required the detailed drawings of the proposed system have been sealed by a Professional
Engineer.
The pipes and weirs included in this system have been sized to handle a design flow of 7200
gallons per minute. The ponds will be constructed with 2-foot of freeboard and all surface
flow will be directed around the system. Average water depth will be 32 feet with only
approximately 5.5 feet of water elevation above natural ground elevation. All external slopes
will be a maximum of 3:1 and will be seeded upon completion.
Also included with this information is a copy of the site plan with the location of these cells
shown and check #99-020720 in the amount of $200.00 to cover the permit review.

General Permit No. NCGO2000 has been developed for mining operations to control and monitor
stormwater discharges.
The General Permit replaces the existing NPDES discharge permits which covered mine dewatering
only. Stormwater is now an important factor that must be monitored by collecting rainfall data and
water samples. Stormwater discharges can cause serious off -site sediment problems if proper erosion
control devices have not been installed.
Themining permit, erosion and sediment control plan and the reclamation plan are considered an
important part of this General Permit and must be available on the site at all times. The.mining permit is
included as a condition of the General Permit. A violation of the mining permit could also result in, a
violation of the General Permit.
1 All erosion control facilities must be inspected every seven (7) calendar days and within
24 hours of a rainfall event that flows off the property.
2) The erosion control facilities must be inspected by visual observation for the Six (6)
items noted on the attached "Site juspe tiglt_RgUg "
3) The "Site Inspection Report" must be completed and signed as dictated by the stormwater
events. These reports must be maintained on site and made available to agency
personnel.
4) Logs must be kept of all sampling data and activities taken to implement. "l_t
Management Practices." The log and plan must be kept on site for the duration of the
permit term.
The permittee must report by phone to Environmental Services (919/781-4550) or to the
State Water Quality Section at 919n33-5083 if any non-compliance occurs which may
endanger health or the environment. If unsure, call anyway. The following must also be
reported within twenty-four (24) hours:
A) Any unanticipated bypass or upset which exceeds any effluent limitation.
B) Violation of a maximum daily discharge limitation listed in the permit (handled
by Environmental Services).
A written submission shall also be provided within five (5) days of the time the permittee
becomes aware of the circumstances.

6) Visible sediment found off -site is one of the major concerns of the State. This item will
be closely monitored. Inspection Reports must include adequate details of measures
taken to correct the condition as well as any measures taken to clean up the sediment
found off -site.

The General Permit covers stormwater discharges from the following three areas of the mining
operation:
(1) Pit _Dewaterine Same as existing NPDES permit requirements,
(2) GradingQperations Must sample one per year during a normal rainfall
event. Must also record inches of rainfall and hours
of duration. Sample where water leaves property.
(3) Shoff Must sample once every 20 months (3 times during
5-year permit period). First sample due within 6 months of
permit coverage. Must also record inches of rainfall and
hours of duration. Flow through the outfall device can be
based on drainage area. Must sample between April and
November.
1) Sampling requirements for grading operations and shop areas must be done during a
reoresentative storm event which is: A rainfall event that is between 0.2 and 0.8 inches
and has a duration of greater than 3 hours preceded by at least 72 hours (3 days) in which
no storm event measuring greater than 0.1 inches has occurred_
2) Containment required for all storage tanks larger than 660 gallons or aggregate storage of
greater than.1,320 gallons.
3) Best Management Practices (BMP Plan) will include the erosion control plan,
containment structures, waste oil handling, oil filter disposal, etc. These plans to be
developed by Environmental Services.
4) Sampling requirements for retention ponds:
Detains for 24 hours the runoff from 1" rain — Collect a grab sample within 30
minutes.
• Capacity to hold 10-year storm -- Visual observations for 6 items noted on "Site
Inspection Report".
• Capacity to hold 25 year storm — No sampling.
