This acceptance fulfills the requirements of the letter sent to Nuwan Wijesuriya dated December 23, 2010. Acceptance of the O&M Plan does not relieve the operation from complying with all applicable rules and regulations. No negative impacts are allowable to wetlands or other waters of the state (including onsite waters of the state). Notes: Stormwater Discharges Require Monitoring. Due to pit expansion south of the rail line at Martin Marietta's Clarks Quarry a logistical need arose for an additional Pit Discharge Outfall (002). Currently the pit water is discharged through existing outfall 001 into Caswell Branch, the new outfall (002) will discharge further upstream of outfall 001 into Caswell Branch. Prior to dewatering of pit water (groundwater comingled with stormwater) through outfall 002, the water will flow through a pit clarification pond. The pit clarification pond is designed to enable settling out of sediment particles thereby improving the quality of water to be discharged, and as the new pit expands it will allow for even more settling time thereby minimizing the potential to impact water quality. In addition, a rip rap lined plunge pool is to be constructed at the outlet of the clarification pond to slow down the discharge flow rate to an acceptable non -erosive velocity prior to exiting through outfall 002. Both the clarification pond and plunge pool are measures that will aid in ensuring that no negative impacts occur to the Waters of the State. The pit clarification pond and plunge pool design has been approved through the Division of Land Resources, land Quality Section. Design details of the clarification pond and plunge pool are included in the appendix of this 0&M Plan. The volume of pit water that will be discharged through outfall 002 will not change from what is currently and historically been discharged through outfall 001. v Operation Plan Wastewater/Process water This site is covered under the starmwater General Permit No. NCG02D000 (COC Number 020171). In the case of outfall 002, only Mine dewatering wastewater effluent limitations and monitoring requirements will apply since the Central Office of the Division of Water Quality has agreed that once stormwater comingles with wastewater it is considered to be wastewater. The permit allows the permittee to monitor turbidity in the effluent or up- and downstream of the discharge point: however, the permittee should consider regular turbidity sampling up- and downstream of the discharge(s) when feasible to ensure compliance with water quality standards. The permittee shall complete the analytical samplings of wastewater discharges in accordance with the schedule specified in Table 9. Failure to comply with quarterly monitoring in accordance with permitterms for anyone calendar quarter immediately triggers monthly monitoring for all parameters forthe remaining permitterm. Monitoring periods remain constant throughout the five-year permit term (from January1, 2010 to December3l, 2014), Stormwater With respect to stormwater, currently there are no Land Disturbance stormwater outfalls at this site around the pit areas since the overburden disposal berms around the site are vegetated and stabilized, and any runoff from the active stripping area flows back into the pit thereby comingling with wastewater. The Central Office of the Division of Water Quality has made the determination that once stormwater comingles with process/wastewater it is then considered wastewater. At which point only effluent parameters associated with wastewater need to be analyzed during sampling of the discharge. The same would apply to stormwater coming from vehicle maintenance areas, and at this site the stormwater from the vehicle maintenance areas does indeed comingle with wastewater. There is however a stormwater outfall that exists at the office area. There exists a culvert under the customer truck scale haul road that carries stormwater from a low drainage area offsite. The stormwater after passing through the culvert flows through a vegetated buffer prior to leaving Martin Marietta property. We propose to build a basin south of the culvert to treat this stormwater. It is our intention to build the basin, using machinery onsite, as large and deep as feasible to allow it to contain the stormwater and have it infiltrate into the ground, thereby eliminating the runoff. However, we will still continue to monitor this area in case a stormwater discharge does occur. In which case, we would implement the analytical and qualitative monitoring requirements as called for by the stormwater General Permit No. NCG020000. More information can be found in the Stormwater Pollution Prevention Plan (SPPP) that has been developed for Clarks Quarry. Monitoring Plan Plant management shall conduct effluent monitoring as previously indicated. If any of the effluent limitations is exceeded then the monitoring frequency will switch from quarterly to monthly for that parameter for the remaining duration of the permit. In addition, any samples analyzed that exceed a wastewater effluent limit shall be submitted to the applicable Regional Office of the Division of Water Quality on a Discharge Monitoring Report Form and delivered to the Division Central Files no later than 30 days from the date that Martin Marietta receives the sample analysis from the laboratory. If an exceedance of effluent limits does occur, flocculants on the list approved by the Division of Water Quality will be used in accordance with the maximum application dose, to bring the discharge back into compliance with the standards set forth by the stormwater General Permit No. NCG020000. The General Permit replaces the existing NPDES discharge permits which covered mine dewatering only. Stormwater is now an important factor that must be monitored by collecting rainfall data and water samples. Stormwater discharges can cause serious off -site sediment problems if proper erosion control devices have not been installed. Themining permit, erosion and sediment control plan and the reclamation plan are considered an important part of this General Permit and must be available on the site at all times. The.mining permit is included as a condition of the General Permit. A violation of the mining permit could also result in, a violation of the General Permit. 1 All erosion control facilities must be inspected every seven (7) calendar days and within 24 hours of a rainfall event that flows off the property. 2) The erosion control facilities must be inspected by visual observation for the Six (6) items noted on the attached "Site juspe tiglt_RgUg " 3) The "Site Inspection Report" must be completed and signed as dictated by the stormwater events. These reports must be maintained on site and made available to agency personnel. 4) Logs must be kept of all sampling data and activities taken to implement. "l_t Management Practices."
