A tour was conducted of the facility, observing the stormwater conveyances and outfalls and site conditions. During the visit, the SPPP manual was reviewed, operational activities and existing stormwater exposures were discussed. At the time of the inspection the site was found to be in compliance with the permit. The inspector noted that the facility appeared to maintain good housekeeping practices and records were found to be in good order. It was determined that outfall 107-006 is not an official outfall and can be removed from the site plan. 006 discharges to the basin that disharges through 107-001. During the visit, the following was clarified: * 107-001 discharges wastewater > 107-002 discharges stormwater from the vehicle maintenance area All other outfalls discharge only stormwater. In your letter of June 23, 2010, you requested an extension to August 315t to comply with sampling requirements at several Vulcan facilities across the state. Your letter cited reasons to support the request that included: •' _- Hard copies'of the new NCG020000 permit not being received until mid -February, when the permit had become effective January 1, 2010; • Spotty weather patterns resulting in storm events during non -operating hours that prevent sample collection; and r The need for additional time to train Sampling Personnel on significant changes in the permit. One of the reasons for your request was the new provision that monthly monitoring will apply for the remainder of the permit term, should the mine ever fail to collect a sample during a scheduled monitoring period (footnote 1 of Table 1 in Part III). While considering your request, the Stormwater Permitting Unit (SPU) realized this provision may unfairly affect permittees who obtain coverage under NCG020000 in the middle of a monitoring period. The SPU has written up guidance to address this situation and related conflicts in the permit text (see attachment). Recognizing there were possible conflicts with this provision that our guidance now addresses, DWQ will grant your request for an extension to collect a stormwater sample by August 31, 2010. However, we note that Vulcan Materials Company should have been prepared to comply with permit monitoring requirements prior to receiving hard copies of the permit in mid -February. Vulcan Materials is a member of NCAA, and a representative of the company attended the initial meeting. • The provision that triggers monthly monitoring for failure to sample came out of discussions with industry representatives during these meetings and was incorporated into the final permit as a result. • The definition of representative storm event also changed as a result of these discussions with NCAA to increase sampling opportunities during operating hours. A representative storm event in NCG020000 now only requires a period of 48 hours of no rain prior to the event. • An advance copy of the final permit was forwarded to the Executive Director of the NCAA on December 29, 2009 and subsequently distributed to NCAA members. The final NCG020000 permit was available to all permittees on the DWQ website when it became effective in January 2010. • Stormwater sampling requirements are not new with this renewal, even though sampling is now semi- annual (instead of annual in the previous permit). Mine dewatering and/or discharges of process wastewater, including commingled stormwater. Stormwater discharges from other plant areas where the stormwater has contacted areas directly related land disturbance and process areas.. Stormwater discharges from on -site vehicle maintenance areas. 5.1 Process Water and Stormwater Sampling/Analysis Program Refer to Table 1 for required sample frequency and analytical parameters. There are four appropriate sampling locations at the Enka Quarry which will be used to sample various process water and stormwater discharges. Each outfall to be sampled is listed below along with a brief description of each outfall's type of discharge. This sample location receives runoff from yard, material stockpile and railroad areas. Note: There are a total of 8 discharge points (7 Stormwater, 1 process water) at the Enka Quarry site. Mine dewatering flows and runoff from yard, land disturbing, and process areas which drain to the active pit are pumped to the old pit. Washwater is withdrawn from and recycled to the old pit. If the water level in the old pit rises too high, a discharge will occur through an overflow culvert at outfall 107-001. Outfell 107-002 is the discharge point for the runoff from the area around the shop (vehicle maintenance activities). Most of the material stockpile and yard areas which do not drain to the pit drain at multiple locations to a small stream which traverses the north end of the property, through the stockpile area, and then joins Hominy Creek. Outfalls 107-003, 107- 008, 107-009 and 107-010 all discharge into this tributary which leads to Hominy Creek. Considering outfall 107-010 receives a Larger portion of the discharge, and also a percentage of runoff from the railroad area, this outfall has been selected as the representative outfall for all material stockpile and yard areas. Outfalls 107-005 and 107-006 each receive a small amount of runoff from general access road areas. Outfall 107-005 is the representative outfall for these runoffs. • The following table summarizes the total additional outfalls at this site which will not require sampling. The abovementioned outfalls that will be sampled have been linked to the following outfalls based on the overall type of discharge each additional outfall will represent. All outfall locations are indicated on the partial mine map in Appendix I. Documentation of representative outfall status should be kept on site within the Mineral Mining Plan. Laurie Moorhead and 1 conducted the inspections. The facility was found to be in Compliance with permit NCG020151. Messrs. Weldon Peek, Gary McMahan, and Willie Breedlove assisted us during the inspection. Their help was appreciated. The facility has an adequate Stormwater Best Management Practices Plan. The facility is also conducting monitoring as required by the permit. There are, however, several items that need to be addressed. The Stormwater-Best Management Practices Plan indicates the presence of seven outfalls. The Plan also indicates that one outfall is being sampled as representative of 4 of the other outfalls. Though the inspectors concur that the land use draining to these outfalls is indeed similar, written concurrence from the DWQ Director is necessary (NCG02000 Part IV Section D (6)). Until the Director grants representative outfall status monitoring must occur on all outfalls. While the inspector concurrs that the monitored outfall is indeed representative of the additional outfalls the Permittee must request, in writing, representative status. Until representative status is granted all outfalls must be monitored. The facility should evaluate the integrity of the secondary containment surrounding the 55 gallon drums.
