Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215. l and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently
amended.) The following information is included with your permit package:

Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMI-R. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment or decree.

Enclosed please find a copy of the Compliance Evaluation Inspection reports from
inspections conducted on March 30, 2006 by Starr Silvis and me. We were pleasantly
greeted by Mr. Danny Seay of your staff and guided throughout the inspections. .
The facilities were found to be deficient with requirements of their respective
permits NCG020148 and NCG020147. Establishing satisfactory compliance with the
permits will require implementation of measures that fulfill all terms and conditions
contained therein. In moving towrird the goal of full compliance, the inspectors suggest
immediate implementation of the following actions, along with any others that the facility's
owners judge appropriate:
At the Rutherford County site, evaluate the toxicity concerns associated with the
use of Cat -Floc TL as noted in the attached inspection report.
At the Rutherford County site, address the erosion at the wastewater outfali as
referred to in the enclosed inspection report.
At the Rutherford County vehicle maintenance facility, provide secondary
containment for fuels and petroleum products and remove all contaminated soil
with proper disposal.
At the Polk County site, secure the stormwater pond outfall to address possible
failure from infill and erosion.

Prepare a site map of both mine sites that illustrates all ponds and outfalls, labeling
outfalls sequentially for each site.
Prepare stormwater BMP implementation plans for both mine sites as described in
the subject permits that include documentation of all inspections of stormwater
best management practices, including the required 7-day and the ones following a
rainfall event.
To assist with the implementation of the subject permits, copies are included here
along with technical bulletins. Discharge monitoring forms are included for your
assistance in recording monitoring data from wastewater and stormwater outfalls.
Please refer to the enclosed inspection reports for additional observations and
comments. If you or your staff have any questions, please call me at 828-296-4500
ext.4664.
It was a pleasure to meet and work with your superintendent, Mr. Danny Seay,
during the inspections. Our office welcomes the opportunity to work with Mr. Seay in the
future as we bring both facilities into compliance with your stormwater permits.

The facility consists of a quarry with minor dewatering and a rock crusher. Vehicle maintenance is
conducted at the Rutherford County site (NCG020148). There are two stormwater outfalls with one also
containing process wastewater. stormwater from the entrance road drains into a pond which captures the
mine dewatering water and other wastewater from the site. This waste stream outfall drains offsite before
joining a receiving'strearn not observed during the inspection.
A second stormwater outfall draining a stormwater settling pond joins the waste stream from the above
noted wastewater pond before leaving the property, This pond's discharge pipe was observed to be close
to the level of the berm. It is recommended that the stormwater pond outfall be addressed in order to
prevent failure of the pond.
The facility did not have a copy of the stormwater permit or certificate of coverage. The best management
plan as required by the stormwater permit has not been prepared. It is recommended that the operator
review the existing permit requirements and seek assistance in plan preparation and implementation.

In accordance with your application for discharge permit received on March 3, 1994, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Divsion of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage. ?
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
