t Reference is made to your request for rescission of the subject Stormwater
NPDES Permit. Staff of the Division of Water Quality have confirmed that this permit
is no longer required. Therefore, in accordance with your request, NPDES Permit
No. NCG020142 is rescinded effective immediately.
If in the future you wish to discharge stormwater to the State's surface waters,
you must first apply for and receive a new Stormwater NPDES Permit. Discharge of
stormwater from this type of facility without a valid NPDES Permit may subject the
responsible party to a civil penalty of up to $10,000 per day.
If you have any questions or wish to discuss this matter further, please

In accordance with your application for discharge permit received on February 3, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December b, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Divsion of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by -the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

This certificate of coverage shall become effective March 31, 1994

PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

Design Capacity) The Subject facility, as per Division of Land
Resources, is permitted (Permit No.53-04) for an area of 250
acres, where 76 acres of disturbance is allowed at any one time.

management requirements for clay pits, all sedimentation
ponds are required to be constructed to withstand a 25 year
rain event. (SEE COMMENTS)

As per Erosion and Sedimentation controls - Brickbat
filters are placed along ditches, streams, and storm water
conveyances in order to retain sediments. The sedimentation
basins (associated with both the clay pits and the petroleum
contaminated soil holding pads) have perforated risers (and
brickbat filters) designed for reduction of large settlable
material.

rain events will result in runoff from this clay mine.
Data developed from the Biological Assessment Group on
a different mining operation indicates chronic runoff
associated with clay mining will degradate water
quality. Suspended colloids from clays increase
turbidity, lower light conditions, and decrease DO. As
a result, macro -invertebrate structure and fish species
composition will be (and likely have been) adversely
impacted from this mining activity.

PART IV - EVALUATION AND RECOMMENDATIONS
I was unable to determine a difference between Sediment/
Erosion control devices (as required by Division of Land
Resources) and storm water control devices.
For clay pits the Division of Land Resources requires
brickbat filters placed along ditches, streams, and storm water
conveyances in order to retain sediments. The sedimentation
basins (associated with both the clay pits and the petroleum
contaminated soil holding pads) having perforated risers (and/or
brickbat filters) designed for large settlable material are also
required. These devices are in place to reduce sedimentation,
they DO NOT necessarily slow rain event surface water runoff from
a respective mining operation.
Due to a RRO Memorandum (dated March 9, 1993) regarding
turbid runoff of clay pits into Clay Creek, the Biological
Assessment Group conducted a study of Clay Creek to determine if
this drainage was impacted by clay mining runoff. The result of
benthos collections, fish community structure, and physical
chemical sampling show that Gulf Creek is negatively impacted.
Similarly, it is clear from visual inspection that colloids
emanating from mining activities at Lee Brick & Tile Company is
also adversely impacting Buffalo Creek.
Rain water runoff from Lee Brick and Tile will degradate
water quality. Due to storm water runoff from the site,
suspended colloids will be increased and violations of stream
turbidity standards will occur. Also, the increased turbidity
will promote scouring, lower light conditions, and lower DO
concentrations. As a result, macro -invertebrate structure and
fish species composition will and likely have been adversely
impacted from this mining activity.
It is important to understand that the problems associate with
this site are not unique to Lee Brick & Tile Company. Similar
situations are likely found in almost every clay mining
operation. Unlike many short term construction sites, where
turbidity problems often occur after rain events, this operation
(and others like it) is a long term mining site. The Raleigh
Regional Office is currently seeking direction/support from the
Central Office regarding the clay pit matter, in general. Lee
Brick and Tile Company has been inspected by RRO water quality
staff and the Land Management File has also been reviewed. The
RRO believes that this facility has met current General Permit
Storm Water requirements as per NCG02000 and thus recommends
issuance of NCG020142.
