Sullins, Director Division of Water Quality October 15, 2008 Subject: Stormwater Compliance Evaluation Inspection M J Price Borrow Pit Permit No. NCG020131 Halifax County The information and site tour you provided during my Division of Water Quality (DWQ) stormwater inspection on October 13, 2008 were appreciated. The facility was in compliance. Observations and comments are: The flat surface of the pit has not been disturbed for over a year, and significant vegetation is helping stabilize the soil. Further, the footprint originally permitted by Land Quality has not yet been reached, so the watershed is still fairly small in relation to the plan that called for construction of a sediment trap and a discharge point. Such a discharge structure has not yet been built. Instead, two retention ponds exist that settle any solids draining from the pit following pit activities. At this time, drainage passes through about 30 feet of weedy vegetation to reach the first retention pond. Overflow from there goes to the second retention pond. Dense vegetation kept us from closely observing that second pit, but the topography suggests that no discharge has occurred from that pond. Permit Part III Section A(3) requires inspection within 24 hours of any rain that produces a discharge. It is required that a path to the second retention pond be cleared and maintained to provide access for making these observations. You have maintained a log of frequent visits, at least two per month, and often more. In the future, please note in that log any rain events (date and inches of rain) and the observation of whether a discharge from the second pond resulted. Part III Section B requires analytical sampling if there is a discharge (see Table I). You report that no sampling has been done because no discharge has occurred. In the future please submit an annual report to DWQ Central Files, 1617 Mail Service Center, Raleigh, NC 27699 containing either sampling data or a form stating "No Discharge during 200x". Section B(3) further requires Qualitative observation during a discharge, per Table 5. Attached is the most recent version of that reporting form. Part III Section C would appear to be the portion of the permit that most aptly applies to borrow pits. However, the sampling and observing there are required when dewatering and pumping are done. Up to now, there has been no dewatering process used. Klimck, P.E., Director Division of Water Quality On March 12, 2007, Mr. Shannon Langley and Ms. Stephanie Brixey of the Raleigh Regional Office conducted an inspection of the premises at 2725 Silk Hope Gum Springs Road. Our office received a complaint stating that vehicle fluid, such as gasoline, antifreeze, steering and brake fluid was allowed to run out onto the ground. Based on our findings there was no evidence to the claim. We do recommend that some type of sediment erosion control be implemented. Some suggestions that were discussed during our meeting were silt screens, planting grass or perhaps cutting terraces into the cleared area.
